SEPA Determination: The City SEPA Responsible Official has previously:

categorically exempt.
Decision on Substantive Permit: The Acting Community Development Director has determined that the
application for a lot consolidation does comply with applicable City and state code requirements and has
approved that application.
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.

1. The name of the appealing party.

No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing
Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to
challenge either the conditions which were imposed by the MDNS decision or the failure of the Department
to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing
Examiner.
A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in
King County Superior Court from the Hearing Examiner's decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 days of the
issuance of this Decision, that is by Thursday, September 27, 2007, at 5:00 p.m..
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:

association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.

V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the
Hearing Examiner based on the information presented to the Acting Community Development Director
who made the original decision. No new evidence or testimony will be permitted during the appeal
hearing. Parties will be allowed to present oral argument based on the information presented to the
Acting Community Development Director before their decision was issued. The Hearing Examiner's
decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision

is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The
City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit
applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The
project planner is Carol Lumb, who may be contacted at 206 - 431 -3661 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes.
Contact the King County Assessor's Office for further information regarding property tax valuation changes.

NO PROTEST LOCAL IMPROVEMENT DISTRICT AGREEMENT
THIS AGREEMENT ( "Agreement ") is made and entered into by Mr. Darshan Jourha,
owner and developer of the property; and the City of Tukwila, a Washington municipal corporation
( "City ").
1. Property. Owner is the majority owner of certain real property located in the City
and legally described on Exhibit "A" attached hereto and incorporated herein by this reference
("Property").
2. Development. Owner applied for and received approval through a decision by the
City's Hearing Examiner for a lot area variance to develop one single family residence on a 5,000
sq. ft. parcel in the Low Density Development district. A condition of the lot area variance
approval is the execution of a "no protest" agreement to participate in any future local improvement
districts for the construction of sidewalks or other urban infrastructure along South 124 Street.
3. Improvement Projects. The City anticipates one or more Local Improvement
Districts ( "LID ") will be formed to complete the following future projects:
A. Construction of sidewalks or other urban infrastructure along S. 124 Street.
( "Improvements ").
4. Waiver of Right to Protest. Owner agrees to participate in and waive protest of
formation of an LID for the purpose of completing any or all of the Improvements.
Owner shall retain the right to protest the methodology and/or specific amount of any LID
assessment.
5. Power of Attorney to initiate LID. Owner hereby appoints the City as his /her
attorney -in -fact to act on their behalf for the purpose of executing a petition to initiate an LID as
set forth in RCW 35.43.120. Said power of attorney to execute a petition to initiate an LID
extends only to the LIDs that are the subject of this Agreement.
6. Term. This Agreement shall commence on the first date on which all parties have
executed the Agreement and shall remain in full force and effect for a period of ten (10) years from
that date.
7. Binding Effect. This Agreement touches and concerns the development of the
Property and shall constitute a covenant running with the Property. This Agreement shall be
binding upon and inure to the benefit of the parties and their successors, heirs, assigns, and personal
representatives.
8. Applicable Law. This Agreement shall be governed by and construed in accordance

with the laws of the State of Washington. Jurisdiction over and venue of any suit arising out of or
related to this Agreement shall be exclusively in the state and federal courts of King County,
Washington.
9. Attorneys' Fees. In the event that any suit or other proceeding is instituted by any
party(ies) to this Agreement arising out of or pertaining to this Agreement, including but not limited
to filing suit, or requesting an arbitration, mediation, or other alternative dispute resolution process
(collectively, "Proceeding "), and appeals and collateral actions relative to such a suit or Proceeding,
the substantially prevailing party(ies) as determined by the court or in the Proceeding shall be
entitled to recover its reasonable attorneys' fees and all costs and expenses incurred relative to such
suit or Proceeding from the substantially nonprevailing party(ies), in addition to such other relief as
may be awarded.
10. Entire Agreement. This Agreement contains the entire agreement between the
parties with respect to this matter. It may not be modified except in a writing signed by all parties
against whom enforcement of the modification is sought.
11. Waiver. The waiver by a party of a breach of any provision of this Agreement by
another party shall not operate or be construed as a waiver of any subsequent breach by that party.
No waiver shall be valid unless in writing and signed by the party against whom enforcement of the
waiver is sought.
12. Severability. If for any reason any portion of this Agreement shall be held to be
invalid or unenforceable, the holding of invalidity or unenforceability of that portion shall not affect
any other portion of this Agreement and the remaining portions of this Agreement shall remain in
full force and effect.

NO PROTEST LOCAL IMPROVEMENT DISTRICT AGREEMENT

1. This building site is comprised of Lots 23 and 24 of Block 7 of Allentown Addition and was the
subject of a zoning variance request, land use file L07 -043, to approve construction of a single family
home on a parcel that does not meet the City's minimum lot size. As part of the approval of the
zoning variance, the applicant was required to consolidate the two substandard lots into one
substandard lot. This lot consolidation was approved under land use file L07 -038. The lot
consolidation was approved on September 11, 2007, however the lot consolidation has not been
recorded with King County. Proof of the recorded lot consolidation must be provided before Planning
can review the building permit application. A copy of the approval letter is enclosed for your review.
2. Another condition of approval of the variance was signing a "No Protest Local Improvement District
Agreement" prior to issuance of the building permit. A copy of the Agreement is enclosed. Please
sign and return this Agreement to the City and we will record it with King County.
THIS AGREEMENT ( "Agreement ") is made and entered into by Mr. Darshan Jourha,
owner and developer of the property; and the City of Tukwila, a Washington municipal corporation
( "City ").
NO PROTEST LOCAL IMPROVEMENT DISTRICT AGREEMENT
1. Property. Owner is the majority owner of certain real property located in the City
and legally described on Exhibit "A" attached hereto and incorporated herein by this reference
( "Property").
2. Development. Owner applied for and received approval through a decision by the
City's Hearing Examiner for a lot area variance to develop one single family residence on a 5,000
sq. ft. parcel in the Low Density Development district. A condition of the lot area variance
approval is the execution of a "no protest" agreement to participate in any future local improvement
districts for the construction of sidewalks or other urban infrastructure along South 124 Street.
3. Improvement Projects. The City anticipates one or more Local Improvement
Districts ( "LID ") will be formed to complete the following future projects:

A. Construction of sidewalks or other urban infrastructure along S. 124
4. Waiver of Right to Protest. Owner agrees to participate in and waive protest of
formation of an LID for the purpose of completing any or all of the Improvements.
Owner shall retain the right to protest the methodology and/or specific amount of any LID
assessment.
5. Power of Attorney to initiate LID. Owner hereby appoints the City as his/her
attorney -in -fact to act on their behalf for the purpose of executing a petition to initiate an LID as
set forth in RCW 35.43.120. Said power of attorney to execute a petition to initiate an LID
extends only to the LIDs that are the subject of this Agreement.
6. Term. This Agreement shall commence on the first date on which all parties have
executed the Agreement and shall remain in full force and effect for a period of ten (10) years from
that date.
7. Binding Effect. This Agreement touches and concerns the development of the
Property and shall constitute a covenant running with the Property. This Agreement shall be
binding upon and inure to the benefit of the parties and their successors, heirs, assigns, and personal
representatives.

8. Applicable Law. This Agreement shall be governed by and construed in accordance
with the laws of the State of Washington. Jurisdiction over and venue of any suit arising out of or
related to this Agreement shall be exclusively in the state and federal courts of King County,
Washington.
9. Attorneys' Fees. In the event that any suit or other proceeding is instituted by any
party(ies) to this Agreement arising out of or pertaining to this Agreement, including but not limited
to filing suit, or requesting an arbitration, mediation, or other alternative dispute resolution process
(collectively, "Proceeding "), and appeals and collateral actions relative to such a suit or Proceeding,
the substantially prevailing party(ies) as determined by the court or in the Proceeding shall be
entitled to recover its reasonable attorneys' fees and all costs and expenses incurred relative to such
suit or Proceeding from the substantially nonprevailing party(ies), in addition to such other relief as
may be awarded.
10. Entire Agreement. This Agreement contains the entire agreement between the
parties with respect to this matter. It may not be modified except in a writing signed by all parties
against whom enforcement of the modification is sought.
11. Waiver. The waiver by a party of a breach of any provision of this Agreement by
another party shall not operate or be construed as a waiver of any subsequent breach by that party.
No waiver shall be valid unless in writing and signed by the party against whom enforcement of the
waiver is sought.
12. Severability. If for any reason any portion of this Agreement shall be held to be
invalid or unenforceable, the holding of invalidity or unenforceability of that portion shall not affect
any other portion of this Agreement and the remaining portions of this Agreement shall remain in
full force and effect.

We have reviewed the material submitted for the lot consolidation and have two corrections that
are needed before it can be circulated for approval:
1. Show the distance to the closest hydrant on the drawing. If a hydrant is not located right
next to your parcel, you may put a symbol for the hydrant just to one side of the parcels
that are being consolidated and put the distance to the hydrant next to or under the
symbol.
2. The final lot consolidation drawing must be prepared in ink. Any writing on the drawing
must be neat and legible, otherwise the Recorder's Office will not accept the drawing for
recording. I have enclosed information provided by King County Records and Elections
Division on the formatting requirements for materials that will be recorded with King
County. I am also enclosing several examples of other hand drawn lot consolidations to
illustrate the amount of information that should be noted on the plan drawing — a scale (1
inch equals 10 ft., 20 ft. etc.) dimensions of lots, line(s) to be eliminated, location of
utility hook ups, the street location and as noted under 1 above, the location of the closest
hydrant. If you are not typing the information, the lettering needs to be neat and clearer
so it can be easily read and recorded.

RE: Document Legibility for Digital Imaging
It has come to our attention that documents submitted for recording and digital imaging
do not always meet minimum legibility requirements and do not make a quality
reproduction. It is our goal to increase awareness of these requirements and improve the
quality of images stored without causing unnecessary rejection of documents submitted
for recording.
We are obligated by RCW to reject documents for recording not suitable for producing
legible reproductions.
RCW 65.04.015 "Legible and capable of being imaged" means all text, seals,
drawings, signatures, or other content within the document must be legible and
capable of producing a readable image, regardless of what process is used for
recording."
RCW 65.04.045 In part, "All text within the document must be of sufficient color
and clarity to ensure that when the text is imaged all text is readable ... and
have all seals legible and capable of being imaged."
RCW 65.04.048 In part, "Documents which do not meet legibility requirements
must not be recorded as a nonstandard recording."
In short, the goal of imaging a recorded document is to be able to reproduce it, either by
viewing or printing, and accurately extract information from the reproduction. The
real test is not whether the original document is legible to the human eye but whether the
scanned image is legible.

It would require a highly subjective analysis of the submitted document to try to guess
whether it would produce a legible reproduction so we have set up a test scanner station
that will quickly scan the document and display it.
If the information can be accurately extracted (viewed and/or printed), then the document
is legible.
Documents will not be accepted for recording if content
is not legible where an expectation of legibility exists.
It is our hope that submitters of documents will be able to reduce the number of rejected
documents (and prevent business delays) by screening for the following:
1. Dot - Matrix printing generally produces poor quality images. If necessary for
multi -part forms, use high - density mode or a pen, or typewriter with a dark color
ink.
2. Faded ribbon or weak color. Use black or dark blue.
3. Scribbled non - legible entry line -outs and corrections on forms. Fill out a new
form.
4. Photocopy too light or dark. Recopy and change settings.
5. Other formatting requirements (see attached).

Standard Formatting Requirements for Recording Documents
(Pursuant to RCW 36.18.010 and 65.04.045)
Beginning 1/1/1997 all documents submitted for recording in the State of Washington must conform to standards required by RCW
36.18 and 65.04. A cover sheet is required for documents that do not contain the necessary index fields or margins on the 1 page.
For Documents signed after 1996, all pages must have a 1" clear border in order to use a cover sheet.
1) ALL PAGES:
a) Documents submitted for recording must be able to be digitally scanned and reproduce a legible
copy, including notary seals (raised notary seals must be smudged prior to recording). Documents
that contain illegible portions will not be accepted for recording.
b) Nothing may be affixed to pages (no item can be taped, stapled, etc. — no cut and paste)
c) Page must be 8 %" x 14" or less
d) Font size must be at least 8 -point (This is 8 -point type)
e) Paper and ink color must be capable of being imaged. Watch for color of highlighting, some
colors copy dark, obscuring text. Dot - matrix printers generally produce unacceptable results.
2) MARGINS:
a) 1s page 3" top margin, 1" sides and bottom margin — or 1" on all sides with a cover sheet.
i) Return address shall be in the 3" top margin
b) Subsequent pages of same document must have 1" margin on all sides
c) Incidental writing and notary seals in margins are allowed.
3) FIRST PAGE:
a) Title
b) Reference # for assignments and releases
c) Grantor(s) and Grantee(s)
d) Legal description (not needed on assignments, releases, etc.)
e) Tax parcel ID# required if there is a legal description (not needed on liens, assignments, releases,
etc.).
4) Certified copies of previously recorded or filed documents may be recorded with a completed cover
sheet.
5) EXCEPTIONS:
a) The following exceptions for formatting standards can be recorded without a cover sheet:
i) IRS Tax Liens and releases
ii) UCC terminations in which the original UCC fixture filing was completed prior to January 1,
1997 and the termination statement is on the fixture filing
iii) Documents previously recorded (in any recording office) may have recording information in
the margins.
b) The following exceptions for formatting standards can be recorded with a properly completed
cover sheet:
i) Documents which are formatted to meet court requirements (filed documents)
ii) death certificates
iii) documents signed prior to 1997
iv) military discharges
v) National UCC Forms
vi) Marriage certificates from outside the state of Washington
vii) Any document, one of whose original signer is deceased or otherwise incapacitated
viii)Documents executed outside of the United States
ix) Certified copies of documents
