NOTICE OF DECISION
The Short Subdivision Committee has completed review of your boundary line adjustment (BLA)
application (No. L07 -042), and determined that it complies with all applicable City code
requirements. The City SEPA Responsible Official has previously determined that this application
does not require a SEPA threshold determination because it is categorically exempt.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project
submittal, preliminary approval is granted subject to the conditions stated below.
There are three basic steps in the approval process: (1) Preliminary Approval; (2) Final Approval;
and (3) Recording. Each of these steps, along with the conditions of approval, miscellaneous
comments, and information on appeal procedures specific to your BLA are described below.
1. Preliminary Approval
This letter constitutes your preliminary approval. The application was reviewed by the
Tukwila Short Subdivision Committee and approved with conditions. The conditions
imposed are to ensure the BLA is consistent with the Criteria for Preliminary Approval
listed at TMC 17.08.030 in the Tukwila Subdivision Code.
PRELIMINARY APPROVAL CONDITIONS
1. Transportation Impact Fee applies to the future Building Permit(s). See Pavement Mitigation
and Transportation Impact Fees Bulletin no. A3 — enclosed.

2. Transportation Concurrency Test Fee applies to the future Public Works Permit. See City of
Tukwila - Resolution No. 1627 — enclosed.
3. The applicant shall apply for a Public Works (PW) type `C' permit for approval. A Street Use
will be part of this permit and require bonding, insurance, and a Hold Harmless Agreement for
work within the public right -of -way.
4. Install all required site improvements. Access roads built to Public Works and Fire Department
standards must be provided to all lots, and extension of the sewer and water lines to the lots
shall be approved by the appropriate utility and conform to the Conceptual Water and Sewer
Plan dated June 23, 2008. You will need to obtain all required permits prior to beginning any
construction. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433 -0179
for a Public Works (PW) type `C' permit for approval. As -built plans shall be provided to the
Public Works Department prior to final approval.
5. All utilities including power are required to be underground, per City of Tukwila ordinance.
6. Civil site plans shall be designed per City of Tukwila standards, details, and specifications. An
infrastructure design and construction manual is available at the Public Works Department and
on the City of Tukwila website.
7. Provide site development plan with Public Works permit submittal. Plans shall be signed and
stamped by a Washington State Licensed Engineer. See red -lined Civil plan sheet (Conceptual
Water and Sewer Plan) — enclosed.
8. The water provider is the City of Tukwila, not Water District No. 125 as shown on Civil Plan
sheet — see redlined Civil Plan Sheet, enclosed.
9. Separate easement documents and maintenance agreements for any common infrastructure
(utility lines, access roads /driveways) shall be submitted to PW for review and approval prior to
final of PW infrastructure permit:
a. Provide a draft copy of Private Ingress/Egress & Utility Easement and Maintenance
Agreement. (1) This document shall be recorded prior to recording of the BLA Map, and
the recording number be shown on the BLA Map. (2) The Private Ingress/Egress & Utility
Easement should include language stating who will maintain the paved area and utilities,
and by what portion. (See sample enclosed.)
b. Provide a draft copy of the Private Sanitary Sewer Easement (within a portion of the
proposed Lot A, for the benefit of proposed Lot B). This document shall be recorded prior
to recording of the Final BLA Map, and the recording number be shown on the BLA Map.

c. Provide a draft copy of the Private Sanitary Sewer Easement (within a portion of the
proposed Lot D, for the benefit of proposed Lot C). This document shall be recorded prior

d. Public Works will prepare a Private Joint Sanitary Sewer Easement and Maintenance
Agreement (between proposed Lots A and B). This document shall be recorded prior to
recording of the Final BLA Map, and the recording number be shown on the BLA Map.

e. Public Works will prepare a Private Joint Sanitary Sewer Easement and Maintenance
Agreement (between proposed Lots D and C). This document shall be recorded prior to
recording of the Final BLA Map, and the recording number be shown on the BLA Map.

10. Show on plans the location of the closest fire hydrant. Prior to development of Lots A, B, C or
D, there must be a fire hydrant within 250 feet of all building sites. If the fire hydrant is not
capable of a 1000 gallon per minute flow the future houses will be required to provide interior
sprinklers, to be approved by the Fire Department. This requirement must be stated on the face
of the recorded plat, and must be met prior to issuance of any building permits for Lot A, Lot B,
or Lot C, or Lot D.
11. Addresses for each new lot are shown on the enclosed redlined survey. Add addresses to the
Final Recording Mylar.
12. An address post shall be installed at the entrance to the development along 44 Place South,
showing the assigned addresses for all lots.
13. The fmal grading plan must show a flat area below any second story rescue windows for Fire
Department ground ladder placement. If unable to provide a suitable flat area adjacent to the
houses please contact the Tukwila Fire Marshal's office.
14. Pursuant to TMC 18.50.050 (5), the front door for the dwelling units on Lot A and Lot D shall
face 44 Place South. The west sides of Lot A and Lot D shall be considered the front yard for
each lot (requiring a minimum 20 foot setback from the property line), and the north side of Lot
D and the south side of Lot A shall be considered second fronts (requiring a 10 foot setback
from the property line).
15. Submit a set of recording documents in either legal or record of survey format that meet the
King County Recorder's requirements and contain the following items:
1. A survey map as described in the application checklist that is consistent with all of
the conditions of approval. The surveyor's original signature must be on the face of the plat.

APPEALS
This BLA approval decision may be appealed to the Hearing Examiner. One administrative appeal
of the decision on the BLA is permitted. If no valid appeals are filed within the time limit, the
decision of the Department will be final.
In order to appeal the decision a written notice of appeal must be filed with the Department of
Community Development within 21 days of the issuance of the Notice of Decision (10/21/2008).
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116.

5. Appeal fee of $110.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact person
authorized to receive notices-on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of
the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant,
and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised
in the Notice of Appeal.
Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The
Hearing Examiner's decision on the appeal is the City's final decision. A party who is not
satisfied with the outcome of the administrative appeal process may file an appeal in King County
Superior Court from the Hearing Examiner's decision pursuant to the procedures and time
limitations set forth in RCW ch. 36.70C.
2. Final Approval
The next step is to apply for a Public Works Type `C' permit to install the required site
improvements, and to comply with the conditions of approval and submit the necessary
documents (survey, legal descriptions, and other required paper work).
All taxes and fees assessed against the property must be current prior to final approval.
Please check with the King County Assessor's Office and the City of Tukwila Finance
Department prior to submitting final documents. After the documents have been found to
be in order, and the all of the requirements of the BLA have been met, the Chair of the Short
Subdivision Committee signs your boundary line adjustment which constitutes a grant of
final approval.
Expiration
The final approved BLA must be filed with the King County Department of Records by
September 30, 2009, one year from the date of this preliminary approval or the application
will expire. The City may grant a single one year extension if requested in writing prior to
the expiration date.

3. Recording
The signature of the Chairman of the Short Subdivision Committee certifies that your
boundary line adjustment application is ready for recording. It is your responsibility to
record the City approved boundary line adjustment documents with the King County
Department of Records. You will need to pay the recording fees and submit your approved
original BLA to King County. The BLA is not complete until the recording occurs and
copies of the recorded documents are provided to the Department of Community
Development.
After recording, the County returns the recorded original to the City of Tukwila within 4 -6
weeks, at which time your BLA is considered complete. You can shorten this processing
time by hand - delivering a copy of the recorded BLA to the project planner.
In many circumstances, building permits on the property may not be issued until a copy of
the recorded BLA (or original) is returned to the Department of Community Development.

Your application for a 4 -lot Boundary Line Adjustment is considered complete on July 11, 2008 for
the purposes of meeting state mandated time requirements.
This determination of complete application does not preclude the ability of the City to require that
you submit additional plans or information, if in our estimation such information is necessary to
ensure the project meets the substantive requirements of the City or to complete the review process.
One question that we are requesting additional information for is ownership for this property
(parcel #3347400840) and the adjacent property to the north (parcel #3347400825), for which
Cramer Northwest currently has a BLA pending final approval (Ng BLA, file number L07 -048).
It appears that the ownership of these two properties may be the same. If this is the case, frontage
improvements to include curbs, gutters, and sidewalks may be required along 44 Place South
since these two contiguous applications involve development of more than four lots. Please
provide us with ownership history for both of these properties, going back at least five years.
This notice of complete application applies only to the permits identified above. It is your

Existing Conditions:
This project is located at 12034 44th Place South Tukwila, WA. The site is
approximately 0.95 acres. There is an existing house with a gravel driveway and
a concrete pad. The rest of the site covered with grass with a few outlying trees.
The drainage on the site is from north east to south west. No significant amounts
of upstream flow enter the site.
Proposed Conditions:
This site will be divided into four lots. Access to these lots will be via an access
road which connects to 44 PL S. The existing house, gravel driveway and
concrete pad will be removed.

II. CONDITIONS AND REQUIREMENTS SUMMARY
The core requirements of the King County Surface Water Design Manual
(KCSWDM) have been or will be provided as follows:
Core Requirement #1, Discharge at the Natural Location:
The site's drainage pattern is sheet flow from the northeast to the
southwest toward 44 PL S. Runoff from the proposed improvements will
be dispersed to follow the original drainage path to 44 PL S.
Core Requirement #2, Offsite Analysis:
An offsite analysis is provided in Appendix A.
Core Requirement #3, Flow Control:
Runoff from the proposed improvements will be conveyed via dispersion
trenches.
Core Requirement #4, Conveyance System:
A conveyance system has been designed to direct runoff to the existing
drainage system on 44 PL S. Conveyance system calculations will be
provided at a future date.
Core Requirement #5, Erosion and Sediment Control:
An erosion and sediment control plan will be designed. Some of the ESC
measures to be provided are a stabilized construction entrance, silt fence,
inlet protection and seeding.
Core Requirement #6, Maintenance and Operations:
A maintenance and operations manual will be submitted at a later date.
Core Requirement #7, Financial Guarantees and Liability:
The owner will provide this information prior to permit issuance.
Core Requirement #8, Water Quality:
This site does not require water quality.

SOIL LOG :
As requested, soil log holes were dug at the above referenced parcel of land The test hole locations
have been flagged and numbered for future reference.
Soil logs - #1: 0 — 20", dark brown loam, 20" — 48" gray silt loam mottling at 12 ".
#2: 0 —11" disturbed soil, 11" — 26" gray silt loam, 26" -- 52" black fine sand,
water filled to 43 ", mottling at 11 ". This soil may be fill material.
#3: 0 — 9" disturbed soil, found old metal bar at 8" — 9 ", 9" — 47"
gray salt loam, distinct heavy mottling at 11 ".
Soil log # 1: 15.00" — 19.25." ® 07.00 MPI.
Soil log # 2 : 16.00" - 25.00" @ 03.30 MPI. (see soil log)
Soil log # 3 : 17.00" — 19.00" @ 15.00 MPI.
Based on infiltration rates and soils observed, onsite infiltration is not appropriate for this site
in the areas of soil log # 2, and soil log #3. Based on the mottling observed a seasonal high water
table appears to be 11.00" from the surface of the ground. The area of soil log #1 appears to be appropriate
for onsite infiltration. No significant storm water issues were observed on this site or surrounding properties.

TASK 3 FIELD INSPECTION
A field inspection was conducted on May 21, 2008 to inspect the onsite
drainage system of the site. Offsite drainage systems were also inspected
downstream approximately 1/4 mile(s) from the discharge point of the site. The
inspection involved investigation of the ten specific items of a Level 1
Inspection per the King County Surface Water Design Manual, 2005. The
inspection yielded the following findings:
1. There were no problems observed during the site visit.
2. There is no existing drainage system in place for this site.
3. There were no existing or potential flooding problems observed.
4. There were no existing or potential sedimentation, scouring or
bank sloughing problems observed.
5. No significant destruction of aquatic habitat or organisms was noticeable.
6. Qualitative data such as land use, impervious surfaces, topography, and
soil types were noted and can be found in Task 4 information.
7. Information was collected on pipes, ditches, and structures. This
information is also included in the Task 4 information.
8. Tributary basins delineated in Task 1 were verified.
9. Neighbors at the intersection of 44 PL S and 48 Ave S and at the
intersection of S122nd St and 48 Ave S. were contacted during the site
visit. They report that since the pump station was added at the end of S
122 St. there has been no drainage problems in the area.
10. The weather conditions at the time of the inspection were clear and cold.

After a thorough field inspection and a detailed resource review, existing or
potential problems were not found. No mitigation is required. The proposed
improvements will not produce a significant impact of any possible future
problems to the existing drainage patterns once the site has been stabilized
and the runoff has been controlled via dispersion trenches.
A temporary erosion and sedimentation control plan will be created at the final
design stage to minimize the transport of sediment -laden runoff to the
downstream conveyance system.
