Central Ave. #104 Kent, WA 98032 RE: Boundary Line Adjustment L07 -048 PRE06 -039 12016 and 12018 44 Place S Dear Ms. Kondelis, • City of Tukwila Department of Community Development Jack Pace, Director The Short Subdivision Committee completed a review of your boundary line adjustment application (No. L07 -048) in November 2007, at which point a revision letter was sent along with redlined plans indicating changes that need to be made for the proposed boundary line adjustment to meet applicable codes. Plans were resubmitted for our review in April 2008 to address the redlines and revisions of the November 2007 revision letter. We have not yet received a copy of final revised set of plans for signature by our Short Subdivision Committee, along with copies of the required easement and maintenance agreements. Your next steps are to (1) resubmit plans (in either legal or record of survey format) for signature, with copies of required easement and maintenance agreements; and (2) submit plans signed by the Tukwila Short Subdivision Committee for recording at the King County Recorder's Office. These two steps are outlined below: 1. Submittal for Signatures by the Tukwila Short Subdivision Committee Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: 1. A survey map as described in the application checklist that includes the revisions outlined in redlined plans and a letter sent to Cramer Northwest, Inc. (attention was to Ryan Neal, the project manager for this application at the time), dated November 16, 2007. The surveyor's original signature must be on the face of the survey. 2. The fire protection requirement as shown in the redlined plans needs to be shown on the face of the recorded BLA. Existing and proposed legal descriptions for all lots. 4. A separate easement and maintenance agreement for the proposed ingress, egress and utilities easement. This easement should include language stating who will maintain the paved area and utilities, and by what portion. 2. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your boundary line adjustment application is ready for recording. It is your responsibility to record the City approved boundary line adjustment documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original boundary line adjustment to King County. The boundary line adjustment is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your boundary line adjustment is considered complete. You can shorten this processing time by hand- delivering a copy of the recorded boundary line adjustment to the project planner. In many circumstances, building permits for a property may not be issued until a copy of the recorded boundary line adjustment (or original) is returned to the Department of Community Development. Expiration Please respond to this letter within 90 days (by April 16, 2009) with submittal of the items needed to obtain signatures by the Tukwila Short Subdivision Committee, or with a letter explaining when the expected date of submittal will be. If we do not receive a response by April 16, 2009, this Boundary Line Adjustment application will be expired. Item 5, regarding relocation of the existing fence, is for the applicant's consideration but is not a requirement for final approval. 1) A signed and notarized Affidavit of Ownership and Hold Harmless Permission to Enter Property, signed by the property owner(s). The Affidavit submitted with the application materials was signed by a Mr. Raymond Ng, whose name is not on the title report submitted with the BLA application materials. See blank copy of the Affidavit — enclosed. 2) Add the tax parcel number to the existing legal description. 3) A separate easement and maintenance agreement shall be executed for the proposed ingress, egress and utilities easement. This easement should include language stating who will maintain the paved area and utilities, and by what portion. A draft copy should be provided for review by the City of Tukwila prior to final approval — see enclosed sample. 4) The fire protection requirement as shown in the redlined plans needs to be shown on the face of the recorded BLA. 5) The existing fence on the north side of the property represents a significant encroachment depending upon who it belongs to. No Modification of Previous Easements. The Parties intend and agree that nothing contained herein shall nullify any existing easements, and said easements remain in full force and effect except as modified by this document. 5. Indemnity. Grantees shall indemnify, defend and hold harmless Grantors and their agents and employees from and against any expenses, damages, claims or liabilities arising from physical damage to persons or property caused by the exercise of any of the rights of Grantees granted by this Easement Grantors shall indemnify, defend and hold harmless Grantees and their agents and employees from and against any expenses, damages, claims or liabilities as a result of Grantors' or any third party's past, present or future interference with Grantees' rights granted hereunder or use of the Easement Area. 6. Binding Effect. The covenants, terms, conditions, and restrictions of this Agreement shall be binding upon and inure to the benefit of the Parties hereto and their respective personal representatives, heirs, successors and assigns and shall run with the land. All firt re owners and occupants shall have the same right to enforce the covenants, terms, conditions, and restrictions as the original parties to this document. 7. Attorneys' Fees. In any proceeding brought to enforce this Easement or to determine the rights of the Parties under this Easement, the prevailing party shall be entitled to collect, in addition to any judgment awarded by a court, a reasonable sum as attorneys' fees, and all costs and expenses incurred in connection with such a lawsuit, including attorneys' fees, expenses of litigation, and costs of appeal. For purposes of this Easement, the prevailing party shall be that party in whose favor final judgment is rendered or who substantially prevails, if both Parties are awarded judgment.
