Mullet, Mayor The Short Subdivision Committee has completed review of your short plat application (No. L07- 051), and determined that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the short plat approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. The existing garage on Lot 1 and shed on Lot 2 shall be demolished prior to final approval. You may demolish the garage after obtaining a permit from the City (contact the Permit Center at 206 - 431 - 3670). Plans submitted with the future Public Works permit shall show where parking will be provided for at least two cars each on Lot 1 and Lot 2. 2. Short Plat Survey shall be modified to include the following redlines: 1. On sheet 1 of 2 of the Short Plat Survey, please provide the following: a) Delete easement provisions. b) Tax Parcel Number shall be shown next to the existing legal description per redlined comment. c) "No Parking Allowed" shall be added to note 1 on page 1 of 2, per redlined comments. 2. On Sheet 2 of 2 of the Short Plat Survey, please provide the following: a) Show the nearest fire hydrant and distance to the south property line measured by means of vehicular travel on sheet 2 of 2. b) On sheet 2 of 2 show length of 10' private storm drain easement across lot 2. c) Do not show the garage and shed. 3. Access road, utilities, undergrounding of power, and extension of the sewer and water lines to the lots shall be approved by the appropriate departments and/or utility and conform to the Westar Short Plat Civil Plans dated July 2007. As -built plans shall be provided to the Public Works Department prior to final approval. Install all required site improvements, including those proposed in the application and those identified above as conditions of approval. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433 -0179 fora Public Works (PW) type `C' permit for approval. A Street Use will be part of this permit and require bonding, insurance, and a Hold Harmless Agreement for work within the Public Right -of -Way. 4. A Transportation Impact Fee applies to the future Building Permit(s). A Traffic Concurrency fee of $300 will need to be paid as a condition of final short plat approval. A3 and Traffic Concurrency Certificate Application — Enclosed. 5. Separate easement documents and maintenance agreements for any common infrastructure shall be submitted to PW for review and approval prior to final of PW infrastructure permit including the following: 1. A joint use driveway (with legal description and graphic depiction) 2. A 10' private drainage easement 3. An 8' private sanitary sewer and storm drainage easement across the adjacent property to the east. 6. Prior to development of Lots 1 or 2, the following will be required: There must be a fire hydrant within 250 feet of all building sites. If the fire hydrant is not capable of a 1000 gallon per minute flow the future houses will be required to provide interior sprinklers, to be approved by the Fire Department. This requirement must be stated on the face of the recorded plat, and must be met prior to issuance of any building permits for Lot 1 or Lot 2. 7. The final grading plan must show a flat area below any second story rescue windows for Fire Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses please contact the Tukwila Fire Marshal's office. 8. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: 1. A survey map as described in the application checklist, amended to reflect redlines and consistent with all of the conditions of approval. The surveyor's original signature must be on the face of the plat. 2. Existing and proposed legal descriptions for all lots. 3. Separate easement document with legal descriptions for any common access /utility infrastructure. 4. Separate joint Maintenance Agreements for the access road and drainage system. Westar Short Plat L07 -051 JR Page 3 of 6 10/05/2007 8:37:00 AM H:\Short Plats \Westar \Westar PrelimApproval.doc APPEALS This short plat approval decision is appealable to the Hearing Examiner One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS may raise such issues as part of the appeal . If no valid appeals are filed within the time limit the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (10/26/2007). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $105. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. Final Approval The next step is to install the required site improvements, comply with the conditions of approval and submit the necessary short plat documents (survey, legal descriptions, and other required paper work). All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. Expiration The final approved short plat must be filed with the King County Department of Records by October 5, 2008, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. 3. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. The eastern half of the site consists of overgrown vegetation. Access to the site is provided by 35th Avenue S, which is located along the west side of the site. In the proposed conditions the existing house will remain, the eastern portion will be cleared and the existing detached garage will be demolished. CORE REQUIREMENTS Core Requirement #1: Discharge at the Natural Location In the existing conditions, runoff from the site sheet flows east onto two adjacent parcels. The flow is eventually collected by the conveyance system located along 37th Avenue S. In the developed condition, a catch basin and pipe system will collect runoff from the new paved access, roof and footing drains and will be tightlined into a new perforated pipe infiltration system. The perforated pipe will be connected to an overflow catchbasin that is tightlined through a drainage easement through the two adjacent parcels, and will connect with the conveyance system along 37th Avenue S. Core Requirement #2: Off -site Analysis See Section 3. A Level 1 downstream analysis was prepared by The Blueline Group and dated May 4, 2007 and is included in the appendix of this report. Core Requirement #3: Flow Control See Section 4. The site is exempt from flow control, since in the developed conditions there will be less than 10,000 square feet of new impervious surface added (Exemption #2). A perforated pipe will be used to infiltrate as much water as possible prior to the flow being routed out to the storm drainage system in 37th Avenue S. The project is located at 14060 35th Avenue S in Tukwila, WA. More generally, the site is located in the Southwest 1 /4 of Section 15, Township 23 N, Range 4 E, W.M. Please see the vicinity map below. The eastern half of the site consists of overgrown vegetation. Access to the site is provided by 35th Avenue S, which is located along the west side of the site. Page 2 A site visit was conducted on Thursday, April 19, 2007 to determine the upstream basin tributary to the site and downstream drainage course within a 1 /4 mile from the site. Detailed descriptions of each basin are provided in Task 4 of this report. In the proposed conditions the existing house will remain, the eastern portion will be cleared and the existing detached garage will be demolished. The parcel will be subdivided into two lots with associated utilities. Please reference Figure 2 - Developed Conditions Exhibit included in the Appendix. The following is a summary of some of the findings from the information used in preparing this report (see the Appendix for exhibits). • According to the 1979 King County Soils Map, there is no soil data for the site. • The site is located in within the Southgate Creek Sub -basin of the Duwamish River Drainage Basin. • The site does not contain any identified wetlands. • The site does not contain any streams and is not located within a floodplain. • The site is not located in an Erosion Hazard Area. • The site is not located in a Landslide Hazard Area. • The site is not located in a Seismic Hazard Area. Job #07 -030 May 4, 2007 Westar Short Plat Level 1 Downstream Analysis Page 4 I Westar Short Plat Level 1 Downstream Analysis I Task 3: Field Inspection I A site visit was conducted on Thursday, April 19, 2007 on a clear and sunny day. The site consists of parcel 15230491563 which currently contains a single story house, detached I garage and associated driveway area. Below are the descriptions of the tributary upstream basin and the downstream drainage course from the project. I U PSTREAM BASIN The upstream basin tributary to the site consists of the eastern half of 35th Avenue S along the western boundary line. Currently there are no storm drainage improvements along the east side and runoff from the east half of the roadway sheet flows onsite. Current I improvements along 35th Avenue include approximately 22 feet of asphalt with a gravel shoulder. A drainage system along the west side of the street consists of culverts and I ditches which collect runoff from the west half of 35th Avenues S. I DOWNSTREAM DRAINAGE PATH The downstream drainage path was determined from the site to the approximate 1 /4 mile downstream point, near the intersection of S 140th Street and Tukwila International I Boulevard. Please reference Figure 3 - Downstream Drainage Exhibit and Off -site Analysis Drainage System Table included in the Appendix. I The site g enerally slopes 5 -6% towards the east and all onsite runoff sheet flows onto the I two adjacent parcels (1523049083 and 1523049081). Runoff from the two adjacent parcels and the site continues to sheet flow east towards 37th Avenue S where it is collected I by a curb and gutter along the west side of the street (Point A). Catch basins located within the flow line collect the runoff and convey the flow north through a 12 -inch conveyance system. I At the intersection of 37th Avenue S and S 141st Street, the 12 -inch conveyance system I continues west along S 141st Street (Point B). The system is located along the south side of the street within a gravel shoulder, and continues west towards Tukwila International I Boulevard. I I Job #07 -030 -, Page 5 May 4, 2007 Job #07 -030 May 4, 2007 Westar Short Plat Level 1 Downstream Analysis At the intersection of S 141st Street and Tukwila International Boulevard, the 12 -inch conveyance system connects with the large conveyance system along the west side of the boulevard (Point C). Recent improvements to Tukwila International Boulevard include curb, gutter, sidewalk and storm drainage system. The flow continues north past the 1/4 downstream point (Point D) within the large conveyance system. There was no evidence of erosion or inadequate capacity at any point along the downstream drainage course. The downstream conveyance system will have adequate capacity in the developed conditions. Page 6 Westar Short Plat Level 1 Downstream Analysis Task 4: Drainage System Description Job #07 -030 May 4, 2007 a The project is exempt from Core Requirement # 3, Flow Control, since there will be less than 10,000 square feet of new impervious added in the proposed conditions. The project is also exempt from Core Requirement # 8, Water Quality, since the project will create less than 5,000 square feet of new Pollution Generating Impervious Surface (PGIS) in the proposed conditions. Runoff from the developed site will be routed through a perforated pipe within a gravel filled trench to provide some infiltration. Overflow from the perforated pipe will be routed through the adjacent properties along the east side of the site, and will connect with the conveyance system located within 37th Avenue S. Page 7 Job #07 -030 May 4, 2007 Westar Short Plat Level 1 Downstream Analysis Task 5: Mitigation of Existing or Potential Problems There are no existing downstream problems or drainage complaints located within the downstream drainage path of the project. There was no evidence of erosion or inadequate capacity at any point along the downstream drainage course. The downstream conveyance system will have adequate capacity in the developed conditions. The Temporary Erosion and Sedimentation Control (TESC) plan will be designed in accordance with the 1998 KCSWDM standards. All TESC facilities will be periodically inspected and maintained as necessary during construction to minimize impacts to the downstream system. City review is required to ensure that development and infrastructure requirements are satisified, the action is consistent with the Tukwila Comprehensive Plan, and the plat is properly recorded. REQUIREMENTS: Short plats are administratively approved and do not require a public hearing. However, short plats of 5 -9 lots are required to provide public notice, environmental review and to meet the development standards specified for subdivisions (creating over nine lots). PROCEDURE: At the time you submit your application you must have all of the items listed on the attached "Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to your project. Please discuss this waiver request with City staff either at a pre - application meeting or at the time of application submittal. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached checklist. If not complete City staff will mail you a letter outlining what additional information is needed. If you do not submit requested materials within 90 days from the City's request for additional information the City may cancel your application. The short plat process consists four steps: 1. Preliminary approval: Approval of lot patterns, access and infrastructure schematic design. 2. Infrastructure permit approvals: Approval of detailed construction drawings (when applicable). 3. Construction of required infrastructure such as access roads and utilities. 4. Final approval and recording: Final City approval of all construction, City Council acceptance of any infrastructure or property to be turned over to the City and recording with King County. Final documents must meet the King County Recorder's Format requirements. PRELIMINARY APPROVAL: Once the application is complete it will be reviewed by the Short Subdivision Committee, made up of representatives of the Fire, Public Works and Community Development Departments. The Committee will issue a decision to approve, modify or deny the application based on the review criteria. (FMC 17.12.020.C) CRITERIA FOR PRELIMINARY APPROVAL OF SHORT PLATS: The Short Subdivision Committee shall base its decision on an application on the following criteria: 1. The proposed Short plat is in conformance with the Tukwila Comprehensive Plan and any other such adopted plans. 2. Appropriate provisions have been made for water, storm drainage, erosion control and sanitary sewage disposal for the short plat, which are consistent with current standards and plans. 3. Appropriate provisions have been made for road, utilities and other improvements, which are consistent with current standards and plans. 4. Appropriate provisions have been made for dedications, easements and reservations. 5. The design, shape and orientation of the proposed lots are appropriate to the proposed use for which the lots are intended and are compatible with the area in which they are located. 6. The short plat complies with the relevant requirements of the Tukwila Subdivision Ordinance. 8. The short plat complies with the relevant requirements of the Tukwila Zoning Ordinance and other relevant local regulations. CONSTRUCTION PERMIT APPROVAL: If installation of infrastructure or other site work is required as a condition of preliminary approval you must apply for and receive any required construction permits from the City of Tukwila or other agencies. Information about Tukwila utility, grading, paving, trenching and hauling permits may be found at www.ci.tukwi la.wa.us /pubwks /pwpermit.htm . Due to project phasing or engineering considerations applicants may apply to the Public Works Director to defer portions of the on -site improvements until after recording the final short plat. The applicant shall include a list of specific deferred improvements, a cost estimate from the contractor who will do the work and a financial warranty equal to 150% of the cost. The warranty may be cash, an assigned savings account or an irrevocable letter of credit. FINAL APPROVAL: After the preliminary approval conditions have been met, an application for final approval shall be submitted to DCD for final review. A complete final application shall consist of the documents required for recording including: 1. Final recording documents in record of survey format, including: a. Before and after legal descriptions of the affected lots, b. Affidavit of Ownership signed and notarized by all owners c. Original stamp and signature of the surveyor 2. All easements and maintenance agreements ready for recording as separate documents, 3. Any required bonds or other financial guarantees, 4. Other documentation necessary to demonstrate the conditions of the approval have been met. (TMC 17.12.030(c)) CRITERIA FOR FINAL APPROVAL OF SHORT PLATS: 1. All requirements for short plats as set forth in the Subdivision Code are met. 2. All terms of the preliminary short plat approval have been met. 3. The requirements of Chapter 58.17 RCW, other applicable state laws, and any other applicable City Ordinances have been met. 4. All required improvements have been installed in accordance with City standards or an improvement agreement with financial guarantee pursuant to TMC 17.24.030 has been entered into by the applicant and accepted by the City. 5. That the plat is technically correct and accurate as certified by the land surveyor responsible for the plat. Preliminary approval is valid for one year from the date of the Notice of Decision. The short plat documents must be recorded within that year period or the application will expire. A single one year extension may be granted by the City if signficant progress has occurred and the extension is requested prior to the expiration of the approval. Upon receiving approval from the City, the applicant will be responsible for picking up the documents from DCD and recording them with King County Recorders Office. A copy of the recorded documents must be returned to DCD to finalize the approval process. The short plat shall not be deemed complete until the City receives these documents.
