NOTICE OF DECISION
The Short Subdivision Committee has completed review of your short plat application (No. L07-
073), and determined that it complies with all applicable City code requirements. The City SEPA
Responsible Official has previously determined that this application does not require a SEPA
threshold determination because it is categorically exempt.
This letter serves as the Notice of Decisibn per TMC 18.104.170. Based on the latest project
submittal, preliminary approval is granted subject to the conditions stated below.
There are three basic steps in the short plat approval process:
1. Preliminary Approval
PO 6t eC This letter constitutes your preliminary approval. The application was reviewed by the
, Tukwila Short Subdivision Committee and approved with conditions. The conditions
4 imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval
listed at TMC 17.12.020 C in the Tukwila Subdivision Code.

PRELIMINARY APPROVAL CONDITIONS

1. Prior to development of Lot 2, either of the following will be required: (1) There must be a fire
hydrant within 250 feet of all building sites, capable of a 1000 gallon per minute flow; or (2) the
future house will be required to provide interior sprinklers, to be approved by the Fire
Department. This requirement must be stated on the face of the recorded plat, and must be met
prior to issuance of any building permits for Lot 2.

2. The final grading plan must show a flat area below any second story rescue windows for Fire
Department ground ladder placement. If unable to provide a suitable flat area adjacent to the
houses please contact the Tukwila Fire Marshal's office.
4. No parking will be allowed within the private access/Fire Department turnaround.

The existing shed cannot remain on Lot 2 on its own because a shed must be accessory to a
house on the same lot. You may demolish the shed after obtaining a permit from the City
(contact the Permit Center at 206 - 431 - 3670). Prior to final approval (after the shed has been
demolished), remove the shed from the short plat survey.
c - ) Storm drainage for roof drains, foundation drains, and paved areas shall be infiltrated and/or
dispersed on -site, or detention provided. Drainage design for the site shall be reviewed as part
of the PW infrastructure permit and shall meet City of Tukwila Surface Water Ordinance
Requirements. Contact the Tukwila Public Works Department for submittal and design
requirements.
Transportation Concurrency Test Fee ($300) applies to the future Public Works Permit. See
City of Tukwila Traffic Concurrency Certificate Application and Resolution No. 1627 —
enclosed.
A separate easement and maintenance agreement in recordable format is required for the access
and utility easement. The easement agreement shall include a metes and bounds legal
description, and shall be submitted to PW for review and approval prior to final of PW
infrastructure permit.
Install all required site improvements, including those proposed in the application and those
identified above as conditions of approval, according to the Short Plat Civil Plans prepared
by Geodetic Surveying Services dated August 2007. You will need to obtain all required
permits prior to beginning any construction. For water and sewer permits, contact the
individual provider District. For City of Tukwila utilities, contact Tukwila Public Works at
(206) 433 -0179 fora Public Works (PW) type `C' permit for approval. A Street Use will be
part of this permit and require bonding, insurance, and a Hold Harmless Agreement for work
within the Public Right -of -Way.
9. Revise civil plans for Public Works permit submittal to include the information listed below
(items a -c), as well as those changes indicated on the red -lined Civil plan sheet — enclosed.
An infrastructure design and construction standard manual is available at the Public Works
Department or on the City of Tukwila website.
Pursuant to the Tukwila "underground ordinance ", all utilities serving Lot 2 shall be placed
underground. With submittal for the Public Works permit, revise plans to show how power
and telecommunications will be provided to Lot 2. If you choose to locate utilities serving

Lot 1 underground as part of the same permit, show this on the revised plans submitted with
applications materials for the Public Works permit.
Turfstone /grasscrete is only allowed on private property. As part of the Public Works
permit, asphalt will need to be extended from the street right of way into Lot 1 a distance
equal to at least 1 foot. Revise civil plans submitted with the Public Works permit to show
this extension of asphalt from the street connecting to the private access and utility
easement.
c) 'Prior to issuance of the Public Works Permit, indicate where parking will be provided for
Lot 1 (at least 2 spaces are required). Parking areas may be constructed of asphalt pavement
or Turfstone /grasscrete, and must follow the provisions of TMC 8.25.020, including the
followin• sections (B) and (E):

specified in TMC 8.25.020C, shall not be parked in setbacks except in front yard or
side street setbacks when in a driveway that provides access to an approved parking
location and is in conformance with TMC Title 18."

10. Submit a set of recording documents in either legal or record of survey format that meet the
King County Recorder's requirements, are revised to include the enclosed redlines, and
contain the following items:
1. A survey map as described in the application checklist that is consistent with all of
the conditions of approval. The vertical datum used must be stated on the survey. The
surveyor's original signature must be on the face of the plat.
2. Existing and proposed legal descriptions for all lots.
3. Separate easement document with legal descriptions for any common access /utility
infrastructure and maintenance agreements.
APPEALS
This short plat approval decision is appealable to the Hearing Examiner. One administrative
appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid
appeals are filed within the time limit the decision of the Department will be final.
In order to appeal the decision a written notice of appeal must be filed with the Department of
Community Development within 21 days of the issuance of the Notice of Decision (01/29/2008).
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116.

1. The name of the appealing party.

2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact person
authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision,
including any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of
the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant,
and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised
in the Notice of Appeal.
Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The
Hearing Examiner's decision on the appeal is the City's final decision. A party who is not
satisfied with the outcome of the administrative appeal process may file an appeal in King County
Superior Court from the Hearing Examiner's decision pursuant to the procedures and time
limitations set forth in RCW Chapter 36.70C.
The next step is to install the required site improvements by applying for a Public Works
Type C permit, and comply with the conditions of approval and submit the necessary short
plat documents (survey, legal descriptions, and other required paper work).
All taxes and fees assessed against the property must be current prior to final approval.
Please check with the King County Assessor's Office and the City of Tukwila Finance
Department prior to submitting final documents. After the documents have been found to
be in order, and the all of the requirements of the short plat have been met, the Chair of the
Short Subdivision Committee signs your short plat which constitutes a grant of final
approval.
1. The final approved short plat must be filed with the King County Department of Records by
January 8, 2009, one year from the date of this preliminary approval, or the application

3. Recording
In many circumstances, building permits on the short platted property may not be issued
until a copy of the recorded short plat (or original) is returned to the Department of
Community Development.

The signature of the Chairman of the Short Subdivision Committee certifies that your short
plat application is ready for recording. It is your responsibility to record the City approved
short plat documents with the King County Department of Records. You will need to pay
the recording fees and submit your approved original short plat to King County. The short
plat is not complete until the recording occurs and copies of the recorded documents are
provided to the Department of Community Development.
After recording, the County returns the recorded original to the City of Tukwila within 4 -6
weeks, at which time your short plat is considered complete. You can shorten this
processing time by hand- delivering a copy of the recorded short plat to the project planner.

NOTICE OF SHORT PLAT EXPIRATION
A one -year extension was granted for the Matevosov Short Plat (Tukwila file number L07 -073) on January
14, 2009, extending preliminary short plat approval to January 8, 2010. The subdivision title allows for only
one extension of not more than one year; therefore, your application for a two lot short plat has expired as
of January 9, 2010.
In order to obtain preliminary approval again, you will need to submit a new short plat application. Please
note that the City of Tukwila will be adopting new stormwater regulations in 2010 that may change the
stormwater requirements under which the previous preliminary approval was obtained for the Matevosov
Short Plat.

NOTICE OF INCOMPLETE APPLICATION
Your application for a 2 -lot Short Plat located at 12091 44th Pl. S has been found to be incomplete.
In order to be a complete application, the following must be submitted to the permit center:
1) Two copies of a Title Report for the property, which is dated within 45 days of
application filing. The Title Report must clearly establish the property's status as a
legal lot of record, ownership, and all known easements and encumbrances.
2) A printed computer plat closure or demonstrated mathematical plat closure on all
lots, streets, alleys, and boundaries. Allowable error of closure shall not exceed one
foot in 5,000 feet.
Upon receipt of these items, the City will re- review them for completeness and will mail you
written notification of completeness or incompleteness within 14 days.
This application will expire if we do not receive the additional information within ninety days of the
date of this letter unless an extension is granted pursuant to Section 18.104.070(E).

This Bulletin summarizes permits Public Works (PW) issues for onsite development and for activities in
the right -of -way. Public Works permits can be issued as part of a building permit or as a Miscellaneous
permit.
Most Public Works permit fees are flat rates, except for Type C permit fees, which are based on the value
of the construction work. For Type C permits, PW collects a base application and plan review fee when
the application is submitted and a Permit Issuance and Inspection fee when the permit is issued. Flat rate
permit fees are due when the permit is issued. After the permit is issued, PW may assess additional fees
for Revisions and inspections. These additional fees must be paid before the PW Final Inspection occurs.

Type C permit fees are based on the value of the construction work. The City collects an
Application Fee when the application is submitted and a Permit Issuance and Inspection fee
when the permit is issued.
Applicable permits having flat rates are added to the calculated fees and are due when the permit
is issued.
You may use this form to estimate PW Permit fees. This is an estimate only. Actual fees may
vary. If you do not provide contractor bids with your permit application, Public Works will
review the cost estimates for reasonableness and may adjust estimates.
The permit fee covers the cost for two reviews and two inspections. The permit fee does not
include fees for additional reviews, additional inspections, or for revisions to approved plans.
These fees are charged separately and must be paid before PW Final Inspection.

Three activities trigger a Type C permit. They are 1) Construction
in the right -of -way, 2) Construction on private property, and 3) Grading. The following
information should help you determine if you need a Type C permit.
Type C Construction
Issued for 180 days for activities in the right -of -way and/or on private property. These activities
include sewer, water, surface water, grading, street improvements, boring, culverts, curb cuts,
paving, driveways, fences, landscaping, painting/striping, sidewalks, trenching, or utility
installation/repair.
This Bulletin should not be used as a substitute for codes and regulations. Your project will be reviewed for
specific compliance to codes and regulations.

Expiration — The concurrency test notice shall expire 90 days after issuance unless the applicant submits a SEPA or other documentation pursuant to
TMC 21.04. If the submittal is made within 90 days, the test notice shall be valid for one calendar year from the date of issuance of the notice. Once
the associated development permit or building permit is approved, the final concurrency certificate shall be valid for 2 years or as long as the
developer possesses a valid building permit for the development. Extensions may be granted in accordance with TMC 9.50.

INFORMATI
A short plat (or short subdivision) is the division of property into nine (9) or fewer lots. City review is required to
ensure that development and infrastructure requirements are satisified, the action is consistent with the Tukwila
Comprehensive Plan, and the plat is properly recorded.
REQUIREMENTS: Short plats are administratively approved and do not require a public hearing. However,
short plats of 5 -9 lots are required to provide public notice, environmental review and to meet the development
standards specified for subdivisions (creating over nine lots).
PROCEDURE: At the time you submit your application you must have all of the items listed on the attached
"Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to
your project. Please discuss this waiver request with City staff either at a pre-application meeting or at the time of
application submittal. Within 28 days of receiving your application, City staff will determine if it is complete based
on the attached checklist. If not complete City staff will mail you a letter outlining what additional information is
needed. If you do not submit requested materials within 90 days from the City's request for additional information the City may
cancel your application.
The short plat process consists four steps:
1. Preliminary approval: Approval of lot patterns, access and infrastructure schematic design.
2. Infrastructure permit approvals: Approval of detailed construction drawings (when applicable).
3 Construction of required infrastructure such as access roads and utilities.
4 Final approval and recording: Final City approval of all construction, City Council acceptance of any
infrastructure or property to be turned over to the City and recording with King County. Final documents
must meet the King County Recorder's Format requirements.
PRELIMINARY APPROVAL: Once the application is complete it will be reviewed by the Short Subdivision
Committee, made up of representatives of the Fire, Public Works and Community Development Departments.
The Committee will issue a decision to approve, modify or deny the application based on the review criteria.
(TMC 17.12.020.C) CRITERIA FOR PRELIMINARY APPROVAL OF SHORT PLATS:
The Short Subdivision Committee shall base its decision on an application on the following criteria:
1. The proposed Short plat is in conformance with the Tukwila Comprehensive Plan and any other such adopted
plans.
Appropriate provisions have been made for water, storm drainage, erosion control and sanitary sewage disposal for
the short plat, which are consistent with current standards and plans.
Appropriate provisions have been made for road, utilities and other improvements, which a
current standards and plans.
Appropriate provisions have been made for dedications, easements and reservations.
The design, shape and orientation of the proposed lots are appropriate to the proposed use
intended and are compatible with the area in which they are located.

(TMC 17.12.030(c)) CRITERIA FOR FINAL APPROVAL OF SHORT PLATS:
1. All requirements for short plats as set forth in the Subdivision Code are met.
2. All terms of the preliminary short plat approval have been met.
3. The requirements of Chapter 58.17 RCW, other applicable state laws, and any other applicable City Ordinances`
have been met.
4. All required improvements have been installed in accordan ce with City standards or an improvement agreement
with financial guarantee pursuant to TMC 17.24.030 has been entered into by the applicant and accepted by the
City.

7. The short plat complies with the relevant requirements of the Tukwila Subdivision Ordinance.

CONSTRUCTION PERMIT APPROVAL: If installation of infrastructure or other site work is required as a.
condition of preliminary approval you must apply for and receive any required construction permits from the City of
Tukwila or other agencies. Information about Tukwila utility, grading, paving, trenching and hauling permits may
be found at www.ci.tukwila .wa.us /pubwks/pwpermit.htm
Due to project phasing or engineering considerations applicants may apply to the Public Works Director to def
portions of the on - site improvements until after recording the final short plat. The applicant shall include a l ist`
of specific deferred improvements, a cost estimate from the contractor who will do the work and a financial`
warranty equal to 150 %d of the cost. The warranty may be cash, an assigned savings account or an irrevocable
letter of credit.
FINAL APPROVAL: After the preliminary approval conditions have been met, an application for final
approval shall be submitted to DCD for final review. A complete final application shall consist of th
documents required for recording including:
. Final recording documents in record of survey format, including:
a. Before and after legal descriptions of the affected lots,
b. Affidavit of Ownership signed and notarized by all owners
c. Original stamp and signature of the surveyor
2. All easements and maintenance agreements ready for recording as separate documents,
3. Any required bonds or other financial guarantees,
4. Other documentation necessary to demonstrate the conditions of the approval have been met.
Preliminary approval is valid for one year from the date of the Notice of Decision. The short plat document
ust be recorded within that year period or the application will expire. A single one year extension may bE
granted by the City if signficant progress has occurred and the extension is requested prior to the expiration o
the approval.
Upon receiving approval from the City, the applicant will be responsible for picking up the documents from
DCD and recording them with King County Recorders Office. A copy of the recorded documents must b
eturned to DCD to finalize the approval process. The short plat shall not be deemed complete until the City
eives these documents.
