The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. There are three basic steps in the short plat approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. Provide the following easement documents: a. A draft copy of Private Ingress/Egress & Utility Easement and Maintenance Agreement. (1) Verify that legal owner(s) name(s). This document shall be recorded prior to recording of the Final Short Plat Map, and the recording number be shown on the short plat map. (2) The Private Ingress/Egress & Utility Easement should include language stating who will maintain the paved area and utilities, and by what portion. (See sample enclosed.) b. Owner shall sign with Notary, a Private Sanitary Sewer Easement Agreement (within the Western portion of proposed Lot 1, for the benefit of proposed Lot 2.) This document shall be recorded prior to recording of the Final Short Plat Map, and the recording number be shown on the short plat map. (See sample enclosed.) 3. Install all required site improvements, including those proposed in the application and those identified in this letter as conditions of approval. Civil site plans shall be designed per City of Tukwila standards, details, and specifications. Provide site development plan with Public Works permit submittal. Plans shall be signed and stamped by a Washington State Licensed Engineer. All infrastructure shall be in accordance with approved Civil Plans, dated 9/18/2007, by the Concept Group, including: a. Extension of the sewer and water lines to the lots shall be approved by the appropriate utility. As -built plans shall be provided to the Public Works Department prior to final approval. b. Access roads built to Public Works and Fire Department standards must be provided on all lots. This requirement must be met prior to issuance of any building permits. An infrastructure design and construction standard manual, is available at the Public Works Department and on the City Web Site. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433 -0179 for a Public Works (PW) type `C' permit for approval. A Street Use will be part of this permit and require bonding, insurance, and a Hold Harmless Agreement for work within the Public Right -of -Way. 4. All sawcut areas within 40 Ave. South shall be shown and labeled on the Civil plan sheet(s), if applicable. Overlay of full street width and a Pavement Mitigation fee shall apply, as street pavement is less than three (3) years old. See Pavement Mitigation Bulletin no. A3 — enclosed. 5. Transportation Impact Fee applies to the future Building Permit(s). See Pavement Mitigation and Transportation Impact Fees Bulletin no. A3 — enclosed. Traffic Short Plat L07 -075 Page 2 of 5 SM • Concurrency Certificate Application and test fee required as part of any Building Permit and/or Public Works Permit. See application and Resolution No. 1627 — enclosed. 6. Storm drainage for roof drains, foundation drains, and paved areas shall be infiltrated and/or dispersed on -site, or detention provided. Drainage design for the site shall be reviewed as part of the PW infrastructure permit and shall meet City of Tukwila Surface Water Ordinance Requirements. However, the detention vault will require a separate building permit and structural review. Contact the Tukwila Public Works Department for submittal and design requirements. 7. Pursuant to the Tukwila "underground ordinance ", all utilities shall be placed underground. 8. A water assessment fee applies to the future Building Permit for the new water connection. The Duwamish single family connection fee is $4,055.34 until January 31, 2008. 9. The final grading plan must show a flat area below any second story rescue window for Fire Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses please contact the Tukwila Fire Marshal's office. 10. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: a. A survey map as described in the application checklist that is consistent with all of the conditions of approval and revised to reflect the red -lined site plans dated 9/13/07 by the Concept Group. The surveyor's original signature must be on the face of the plat. See attached. b. Existing and proposed legal descriptions for all lots. c. Separate easement document with legal descriptions for any common access /utility infrastructure. APPEALS This short plat approval decision is appealable to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time, limit the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (12/04/2007). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: Short Plat L07 -075 Page 3 of 5 SM • 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $205 [$105 in LDR]. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. 2. Final Approval Expiration The next step is to install the required site improvements, comply with the conditions of approval and submit the necessary short plat documents (survey, legal descriptions, and other required paper work). All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. e. The final approved short plat must be filed with the King County Department of Records by November 13, 2008, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. Short Plat L07 -075 Page 4 of 5 SM 3. Recording Sincerely, The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. The building department commented: The existing house that is located 0.8' from the north property line will not be issued any building permits for any future alterations, additions, or remodels until this is mitigated or house is moved. This comment is not intended to apply to maintenance needs that would require a permit but to prevent an increase in non - conformity from the structure. Currently, the owner is in a difficult situation and doesn't have enough money to begin putting in the infrastructure per the conditions stated in Preliminary Short Plat Approvals. Grantor represents that: (a) Grantor is the owner of the Property which is unencumbered except by easements, reservations, and restrictions of record not inconsistent with the intended use of the Property and any existing first mortgage or deed of trust given in good faith and for value, the existence of which has been disclosed in writing to Beneficiary; and (b) The Property is not presently and will not during the term of this Deed of Trust be used for any agricultural purposes. 4. Promises of Grantor. Grantor promises: (a) To keep the Property in good repair and not to remove, alter or demolish any of the improvements on the Property without first obtaining Beneficiary's written consent; (b) To allow representatives of Beneficiary to inspect the Property at any reasonable hour and to comply with all laws, ordinances, regulations, covenants, conditions and restrictions affecting the Property; (c) To pay on time all lawful taxes and assessments on the Property; (d) To perform on time all terms, covenants and conditions of any prior mortgage or deed of trust covering the Property or any part of it and pay all amounts due and owing thereunder in a timely manner; (e) To see to it that this Deed of Trust remains a valid lien on the Property superior to all liens except those described in Section 3(a) and to keep the Property free of all encumbrances which may impair Beneficiary's security. Sale, Transfer or Further Encumbrance of Property. Loan is personal to Grantor and the entire Debt shall become immediately due and payable in full upon sale or other transfer of the Property or any interest therein by Grantor by contract of sale or otherwise including, without limit, any further encumbrance of the Property. 6. Curing of Defaults. If Grantor fails to comply with any of the covenants in Section 4, including all the terms of any prior mortgage or deed of trust, Beneficiary may take any action required to comply with any such covenants without waiving any other right or remedy it may have for Grantor's failure to comply. Repayment to Beneficiary of all the money spent by Beneficiary on behalf of Grantor shall be secured by this Deed of Trust. At Beneficiary's option, advance may be made against the Credit Agreement to pay amounts due hereunder Such shall not relieve Grantor from liability for failure to fulfill the covenants in Section 4. The amount spent shall bear interest at the rates from time to time applicable under the Credit Agreement and be repayable by Grantor on demand. Although Beneficiary may take action under this paragraph, Beneficiary is not obligated to do so. 7. Remedies For Default. (a) Prompt performance under this Deed of Trust is essential. If Grantor does not pay any installment of the Debt or other amount due hereunder on time, any other event occurs that entitles Beneficiary to declare the unpaid balance of the Debt due and payable in full under the Credit Agreement, if Grantor fails to comply with any other term, condition, obligation or covenant contained in the Credit Agreement or this Deed of Trust or any rider thereto, any other deed of trust, mortgage, trust indenture or security agreement or other instrument having priority over this Deed of Trust or if any representation of Grantor herein was false or misleading, the Debt and any other money whose repayment is secured by this Deed of Trust shall immediately become due and payable in full, at the option of Beneficiary, and the total amount owed by Grantor shall thereafter bear interest at the rate(s) stated in the Credit Agreement. Beneficiary may then or thereafter advise Trustee of the default and of Beneficiary's election to have the Property sold pursuant to Trustee's power of sale in accordance with applicable law and deliver to Trustee any documentation as may be required by law. Trustee may postpone any such sale by providing such notice as may be required by law. Condemnation; Eminent Domain. In the event any portion of the Property is taken or damaged in an eminent domain proceeding, the entire amount of the award, or such portion as may be necessary to fully satisfy the obligation secured by this Deed of Trust, shall be paid to Beneficiary to be applied to the obligation in the same manner as payments under the Credit Agreement. 9. Fees and Costs. Grantor shall pay Beneficiary's and Trustee's reasonable costs of searching records, other reasonable expenses as allowed by law and reasonable attorney's fees in any lawsuit or other proceeding to foreclose this Deed of Trust, in any lawsuit or proceeding which Beneficiary or Trustee prosecutes or defends to protect the lien of this Deed of Trust, in any other action taken by Beneficiary to collect the Debt, including without limitation any disposition of the Property under the State Uniform Commercial Code, and any action taken in bankruptcy proceedings as well as any appellate proceedings. 10. Reconveyance. Trustee shall reconvey the Property to the person entitled thereto on written request of Beneficiary or following satisfaction of the obligations secured hereby and Beneficiary and Trustee shall be entitled to charge Grantor a reconveyance fee together with fees for the recordation of the reconveyance documents, unless prohibited by law. 11.
