On February 27, 2008, the City requested additional information from you and as of the date of this letter, nothing has been received. According to Tukwila Municipal Code (TMC) 18.104.130 A.1.b, "If the applicant fails to provide a requested correction or additional information within 90 days of the request the Department may cancel the application due to inactivity." The lot consolidation applications were submitted on October 1, 2007. A notice of complete application was sent to you on October 26, 2007. On October 30, 2007, I sent you a letter requesting a survey to verify your property lines. I received an email from you of an (unstamped) survey on December 13, 2007 which indicated that a neighbor's home is encroaching onto your property. The City cannot approve a lot consolidation that would create non - conforming lots; I sent you a letter on February 28, 2008, requesting direction on how you wanted to proceed. The letter also stated that without the additional information, the permits would expire on May 28, 2008, 90 days from the date of that letter. Since there was no response received from you to address the encroachment raised in the Febniary 27, 2008 and more than 90 days has passed since the date of that letter, the city has cancelled the application files. If you wish to pursue these lot consolidations, new applications must be filed. The issue preventing this permit from moving forward is the encroachment of a neighbor's house onto approximately half of lot 16. The City of Tukwila cannot approve a lot consolidation that would create non- conforming lots. Consolidated lots must be at least 6500 square feet and all structures on a site must meet required building setbacks. Please let me know how you would like to proceed. Typically, the City allows ninety days for an applicant to provide additional information to continue with an application. If you require additional time, please submit a request in writing by March 17, ninety days from the date of my last request for information. If you do not submit additional information, this permit will expire ninety days from today on May 28 2008. Jim Haggerton, Mayor Also, it has come to my attention that your parcels are up for sale. Please be advised that you are listing for sale two groups of three parcels that may not be buildable. If you can take 500 feet from lot 16 and provide the existing house with necessary setbacks (5' on the side and 10' in the rear), you could meet the13,000 sf needed for two buildable lots. If you sell these two groups of lots to two separate owners, you could be preventing the opportunity to create two legal parcels. Your boundary line adjustments for all parcels cannot be approved under these circumstances. In order to grant preliminary approval, Tukwila Municipal Code TMC 17.08.030 requires that: (2) The adjustment will not create non - conforming lots with respect to zoning dimensions and area standards, zoning setbacks and lot area coverage standards." The City of Tukwila cannot approve your BLA with a neighbor's house encroaching on your property.
