The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. NOTICE OF DECISION This letter serves as the Notice of Decision per TMC 18.104.170. Based on the_ latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the short plat approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. PRELIMINARY APPROVAL CONDITIONS 1. Record the following addresses with the short plat: a. Lot 1: 4260 South 148 Street b. Lot 2: 4256 South 148 Street 2. Install "Turfstone" as detailed on plans; reference number PG2, stamped by Han Phan on 2 -02 -2008. Include 2 parking spaces for lot 1. Removal of the garage is required prior to final plat approval. 4. Ensure that the travel distance to the fire hydrant does not exceed 250' by path of travel or request a variance to have sprinklers installed in future house on Lot 2 in lieu of a hydrant. If a sprinkler system is to be installed: a. a licensed fire sprinkler contractor shall submit flow calculations so the correct water meter size can be determined, and b. a double check valve assembly (DCVA) shall be installed to protect the water system. 5. Provide a letter to the Fire Marshall requesting relief from the fire department hammerhead turn- around detail. 6. The future house on Lot 2 cannot be located further than 150' from the turnaround. 7. Signage identifying fire turnaround and disallowing parking in the turn around is required per fire code. 8. The final grading plan must show a flat area below any second story rescue window for Fire Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses please contact the Tukwila Fire Marshal's office. 9. Storm drainage for roof drains, foundation drains, and paved areas shall be infiltrated and/or dispersed on -site, or detention provided. Drainage design for the site shall be reviewed as part of the PW infrastructure permit and shall meet City of Tukwila Surface Water Ordinance Requirements. Revise the storm drainage plan; see red -lined markups on attached drainage plan, sheets DR1 and DR2 stamped 10/3/2007. 10. Pursuant to the Tukwila "underground ordinance ", all utilities shall be placed underground. NEXT STEPS 11. Install all required site improvements, including those proposed in the application and those identified in this letter as conditions of approval. Apply for Public Works permits to install the required infrastructure. A construction cost estimate for site work on private property and in the right of way is required to establish Public Works permits and fees. Civil site plans shall be designed per City of Tukwila standards, details, and specifications. Provide site development plan with Public Works permit submittal. Plans shall be signed and stamped by a Washington State Licensed Engineer. Extension of the sewer and water lines to the lots shall be approved by the appropriate utility. As -built plans shall be provided to the Public Works Department prior to final approval. Include water and sewer availability letters with the Public Works permit application. b. Access roads built to Public Works and Fire Department standards must be provided on all lots. This requirement must be met prior to issuance of any building permits. An infrastructure design and construction standard manual, is available at the Public Works Department and on the City Web Site. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433 -0179 for a Public Works (PW) type `C' permit for approval. A Street Use will be part of this permit and require bonding, insurance, and a Hold Harmless Agreement for work within the Public Right - of -Way. 12. Transportation Impact Fee applies to the future Building Permit(s). See Pavement Mitigation and Transportation Impact Fees Bulletin no. A3 — enclosed. Traffic Concurrency Certificate Application and test fee ($300) is required as part of any Building Permit and/or Public Works Permit. See application and Resolution No. 1627 — enclosed. 13. Provide the following easement documents: a. A draft copy of Private Ingress/Egress & Utility Easement and Maintenance Agreement. 1. Verify that legal owner(s) name(s). This document shall be recorded prior to recording of the Final Short Plat Map, and the recording number be shown on the short plat map. 2. The Private Ingress/Egress & Utility Easement should include language stating who will maintain the paved area and utilities, and by what portion. (See sample enclosed.) i. statement that no parking is allowed within easement shall be included. b. Owner shall sign, with Notary, a Private Sanitary Sewer Easement Agreement (within the Southern portion of proposed Lot 1, for the benefit of proposed Lot 2.) This document shall be recorded prior to recording of the Final Short Plat Map, and the recording number be shown on the short plat map. (See sample enclosed.) 14. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: a. A survey map as described in the application checklist that is consistent with all of the conditions of approval and revised to reflect the red -lined site plans dated 9/13/07 by the SM Page 3 of 6 02/22/2008 H:\Stacy's Current Planning\Short Plats \L07 079 Whitehouse Short Plat\Notice of Decision.doc Whitehouse Short Plat L07 -079 Concept Group. The surveyor's original signature must be on the face of the plat. See attached. b. Existing and proposed legal descriptions for all lots. c. Separate easement document with legal descriptions for any common access /utility infrastructure. This short plat approval decision is appealable to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS may raise such issues as part of the appeal. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (3/25/2008). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $110. • • APPEALS Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. Final Approval Expiration 3. Recording • • Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. After complying with the conditions of approval, including installing the required site improvements, submit the necessary short plat documents (survey, legal descriptions, and other required paper work). You may apply to delay installation of the site improvements up to six months beyond final approval subject to the approval of the Public Works Director. A financial guarantee must be provided to ensure installation. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. The final approved short plat must be filed with the King County Department of Records by March 4, 2009, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. On December 11, we spoke regarding the front yard of Lot 1 which is dominated by a required parking area and a required fire truck hammerhead. There are a number of scenarios that could improve the front yard and allow for more livable development. Some scenarios that could improve this area are: 1. Install grasscrete or similar pervious surface on all or part of the fire turn around; or 2. Locate the parking area on the north side of the fire turnaround provided the hemlock tree shown on the plans does not need to be removed; or 3. Locate the parking area for lot 1 on the south side of the fire turnaround maximizing the usable front yard of lot 1. This list of alternatives is by no means exhaustive. Please submit an acceptable improvement for the parking area and fire turn around. Once we have a satisfactory solution, I will add it as a condition of final approval. There is currently one (1) single family residence on the property. The project proposes to short plat the existing parcel into two (2) single family residential lots. Proposed improvements include the demolition of the existing garage and the construction of a new single - family structure, a shared access driveway, associated utilities and stormwater management facilities. Site Information Refer to Appendix A for the Vicinity Map and site photos of this project. Location: 4260 South 148th Street Section/Township /Range: SE 'A of NW A Sec. 22, T.23N, R.4E of W.M. Size: 21,479 sq ft (approximately 0.49 acre) City, County, State: Tukwila, King County, Washington Governing Agency: City of Tukwila Design Criteria: 1998 King County Surface Water Manual Zone: UL — 7,200 Water District: Highline Water District Sewer District: Val -Vue Sewer Drainage Basin The property drains to two separate sub - basins with a contributing area of 0.49 acres. The front portion drains towards the southwest corner of the property. The back portion of property drains to the northwest corner of the property. The general topography of the site slopes from east to west. Elevations on the site vary from a high point of 208 feet at the eastern property line to 202 feet at the western property line. The site is relatively flat with grades from 5.5% to 4.0 %. Soils Information Based on the percolation tests performed for this project, the soils at this location are suitable for infiltration purposes. Detailed soils information will be provide in the FINAL TIR. During heavy rainfall events, stormwater sheet flows in a western direction and discharges into the conveyance system of catch basins and storm pipes located along South 148` Street. Developed Site Hydrology The project proposes to short plat the existing parcel into two (2) single family residential lots. On -site stormwater runoff will be collected through an underground system consisting of pipes, yard drains and catch basins. A stormwater trench is proposed to collect and infiltrate the stormwater from the new roof and discharged to native soils. A separate infiltration trench is proposed to collect the stormwater from the new access driveway with an overflow pipe connecting into the storm drain located on South 148` Street. No stormwater facility is proposed for the existing house on the property. Refer to the Drainage Plan in Appendix C for the proposed storm drainage design. Table 2 summaries the developed conditions of the project. Note 1: PGIS, pollution generating surface Design Requirements The City of Tukwila utilizes the 1998 King County Surface Water Manual for its drainage requirements. Stormwater will infiltrate to native soils. Water quality is not required for this project because the project does not create more than 5,000 sq ft of new pollution generating impervious surfaces as defined in the KCSWM section 1.2.8. The drainage requirements are summarized in Table 3. The weather was sunny with temperatures in the high 70's degrees Fahrenheit. This analysis was based on topographical survey and field reconnaissance. Upstream drainage contributing to the project is minimal due to the infiltration characteristics of the soils. Downstream Analysis Infiltration trenches are proposed for this site. A downstream analysis is not required for infiltration sites. Discharge at Natural (Existing) Location Stormwater presently infiltrations to native soils. During heavy rainfall events, stormwater may sheet flow to the public storm system located on South 148` Street. SECTION 4: FLOW CONTROL / WATER QUALITY ANALYSIS & DESIGN Flow Control This project will create approximately 10,050 square feet of new impervious surface. The runoff from the new roof and the majority of the driveway areas on the proposed lot will be infiltrated; therefore, for flow control sizing calculation purposes, this project will create approximately 600 square feet of new impervious surface that will not be collected in the proposed infiltration trenches. Flow control facilities are not required because the project creates less than 0.1 cfs increase in discharge from the existing condition for the 100 -year storm event per the KCRTS data below. Refer to Appendix D for flow control calculations. The project is located in the Basic Flow Control Area. Tables 4 -5 summarize the KCRTS inputs. Table 6 - KCRTS Inputs Rainfall Region Scale Factor SeaTac 1.0 Tables 7 summarizes the KCRTS output. With the proposed infiltration trenches the 100 -year peak flow rate of the developed site is Tess than the existing condition. Infiltration Facility Design An infiltration test was conducted for the subject property to ensure that existing soils conditions are adequate for an infiltration trench design. The test pit locations contained sandy soils with moderate infiltration rates. Per the results of the infiltration test as noted in Appendix D, it is feasible to infiltrate the stormwater runoff. The roof and roadway stormwater will infiltrate to native soils via a 10 linear -feet perforated pipe trench that connects to the public storm system on South 148t Street. The perforated pipe trench was designed per the requirements of the KCSWM section C.2.3.2. See Appendix D for infiltration results, calculations and details. Although the project will create 6,440 square feet of new impervious surface, only 4,540 square feet is pollution - generating impervious surface (PGIS). PGIS is defined as "an impervious surface considered to be a significant source of pollutants in surface and storm water runoff. Such surfaces include those subject to vehicular use or storage of erodible or leachable materials, wastes, or chemicals, and which receive direct rainfall or the run -on or blow -in of rainfall." Non -metal rooftops are not considered PGIS; therefore, are not included in the PGIS area calculations. Water quality is not required for this project because the project does not create more than 5,000 sq ft of pollution generating impervious surfaces as defined in the 1998 KCSWM. Even though the project is exempt from water quality requirements, a down -turn elbow oil /water separator is proposed for the catch basin immediately upstream from the infiltration trench. Refer to Appendix D for water quality exemption documents. SECTION 5: CONVEYANCE SYSTEM Although the development codes only require the conveyance system to be designed for the 25 -year storm event, this project proposes a conveyance system designed for this project was sized for the overflow 100 -year storm event using the rational method to calculate flow rates. Table 8 summarizes the conveyance analysis. Refer to Appendix E for conveyance calculations. 100 -Year Flood /Overflow Condition Overflow of the stormwater infiltration facility will convey into the public stormwater system along South 148` Street. SECTION 6: SPECIAL REPORTS AND STUDIES There are no special reports or studies are expected to be prepared for this project. An Erosion and Sedimentation Control plan has been prepared to assist the contractor in complying with these requirements and designed to prevent sediment -laden run -off from leaving the site during construction. Refer to Appendix F for Erosion Control plans and details. The erosion potential of the site is influenced by four major factors: soil characteristics, vegetative cover, topography, and climate. Erosion/ sedimentation control is achieved by a combination of structural measures, cover measures, and construction practices that are tailored to fit the specific site. Construction Sequence and Procedure Prior to the start of any grading activity upon the site, all erosion control measures, including installation of a stabilized construction entrance, shall be installed in accordance with the construction documents. The best construction practice will be employed to properly clear and grade the site and to schedule construction activities. The planned construction sequence for the construction of the site is as follows: 1. Flag and stake clearing limits. 2. Install erosion control features (silt fence, etc.) 3. Field locate all utilities. 4. Install construction entrance. 5. Clear and grub site. 6. Grade the site. . 7. Install infiltration trenches, sanitary sewers, storm, water, and other site utilities; provide catch basin inlet protection at the new inlet locations. 8. Construct building structures. 9. Remove temporary erosion control facility upon stabilization of entire project site, as approved by the City of Tukwila. Trapping Sediment Structural control measures will be used to reduce erosion and retain sediment on the construction site. The control measures will be selected to fit specific site and seasonal conditions. The following structural items will be used to control erosion and sedimentation processes: • Temporary gravel construction entrance • Filter fabric fences (Silt fences) • Ground cover measures such as straw cover and /or hydroseeding The Concept Group Page 6 Whitehouse Short Plat - DRAFT Technical Information Report October 2007 • Inlet protection Vehicle tracking of mud off -site shall be avoided. Installation of a gravel construction entrance will be installed at a location to enter the site. The entrances are a minimum requirement and may be supplemented if tracking of mud onto public streets becomes excessive. SECTION 9: BOND QUANTITIES AND DECLARATIONS OF COVENANTS None known at the time this report was prepared. SECTION 10: OPERATIONS AND MAINTENANCE The owner or operator of the project shall be responsible for maintaining the stormwater facilities in accordance with the requirements as attached in Appendix G. Proper maintenance is important for adequate functioning of the stormwater facilities. If it is unclear whether a problem exists, contact a Professional Engineer. They are required for any pipe connection of roof downspouts to the local drainage system regardless of the extent to which flow control BMPs are required or being used onsite. Perforated pipe connections are intended to provide for some infiltration during drier periods (late spring through early fall), which may help dampen the flashiness of stream flows in developed areas and provide some groundwater recharge. During the wet winter months, however, this BMP likely provides little or no flow control benefits. Therefore, it is not credited with mitigating target impervious surface. Applicable Surfaces Subject to the minimum design requirements below, the perforated pipe connection may be applied to concentrated runoff from any impervious surface or non - native pervious surface. C.2.11.1 MINIMUM DESIGN REQUIREMENTS Figure C.2.11.A (p. C -78) illustrates a perforated pipe connection for a typical single family residence. Impervious areas larger than 10,000 square feet and non - native pervious areas larger than 35,000 square feet may require larger pipe to adequately convey flows and should be designed by a civil engineer. Perforated pipe connections must be installed according to the following requirements: 1. Where possible, the perforated pipe connection must be placed in native soil to maximize infiltration of water, and must not be located under impervious surfaces, except as a last resort. 2. The gravel filled trench must be at least 10 -feet in length for every 10,000 square feet of impervious surface or 35,000 square feet of non- native pervious surface from which runoff is conveyed. 3. The perforated portion of the system may not be placed in a critical area buffer or on slopes steeper than 25 %. Any proposed placement of the perforated portion on slopes steeper than 15% or within 50 feet of a steep slope hazard area or landslide hazard area must be approved by a geotechnical engineer or engineering geologist unless otherwise approved by the DDES staff geologist. 4. For sites with septic systems, the perforated portion of the system must be down slope of the drainfield primary and reserve areas. DDES permit review staff can waive this requirement if site topography clearly prohibits subsurface flows from intersecting the drainfield. 5. The perforated pipe connection must not create flooding or erosion impacts as determined by DDES. If the system discharges toward or is near a landslide hazard area, erosion hazard area, steep slope hazard area, or a slope steeper than 15 %, DDES may require evaluation and approval of the proposal by a geotechnical engineer or engineering geologist. C.2.11.2 MAINTENANCE INSTRUCTIONS If the perforated pipe connection flow control BMP is required for a project, the following maintenance and operation instructions must be recorded as an attachment to the required declaration of covenant and grant of easement per Requirement 3 of Section C.1.3.3 (p. C -18). The intent of these instructions is to explain to future property owners, the purpose of the BMP and how it must be maintained and operated. These instructions are intended to be a minimum; DDES may require additional instructions based on site - specific conditions. Also, as the County gains more experience with the maintenance and operation of these BMPs, future updates to the instructions will be posted on King County's Surface Water Design Manual website. C -77 1/24/2005 SECTION C.2 FLOW CONTROL BMPs ❑ TEXT OF INSTRUCTIONS Your property contains a stormwater management flow control BMP (best management practice) called a "perforated pipe connection," which was installed to reduce the stormwater runoff impacts of some or all of the impervious surface on your property. A perforated pipe connection is a length of drainage conveyance pipe with holes in the bottom, designed to "leak" runoff, conveyed by the pipe, into a gravel filled trench where it can be soaked into the surrounding soil. The connection is intended to provide opportunity for infiltration of any runoff that is being conveyed from an impervious surface (usually a roof) to a local drainage system such as a ditch or roadway pipe system. The size and composition of the perforated pipe connection as depicted by the flow control BMP site plan and design details must be maintained and may not be changed without written approval either from the King County Water and Land Resources Division or through a future development permit from King County. The soil overtop of the perforated portion of the system must not be compacted or covered with impervious materials. For projects in Small Project Drainage Review, these measures may be used if no more than 3 acres of soil will be disturbed by the project. Other ESC measures may be allowed or required by DDES if these are inappropriate for the project or fail to contain sediment on the project site. A description of other measures and a more detailed description of those included here can be found in the ESC Standards. Projects that disturb 3 acres or more of soil will require an ESC plan developed by a civil engineer under a Targeted Drainage Review. Intent of ESC Measures The intent of ESC measures is to prevent, to the maximum extent practicable, the transport of sediment and other construction- related pollutants to streams, wetlands, lakes, drainage systems, and adjacent properties during and after construction. Erosion of disturbed areas on construction sites can result in excessive sediment transport to adjacent properties and to surface waters. This sediment can result in major adverse impacts, such as flooding due to obstructed drainage ways, smothering of salmonid spawning beds, creation of algal blooms in lakes, and violation of State water quality standards for turbidity. In addition to sediment, other construction- related pollutants can be generated by uncovered waste materials, stockpiles, and demolition debris; de- watering; maintenance and operation of heavy equipment; chemical spills; oil spills; placement of concrete; and application of fertilizers and pesticides. Such pollutants can be toxic to both fish and humans and may violate State water quality standards and the prohibited discharges section of KCC 9.12. Stabilization of the site after construction and prior to the wet season is also important to preventing these impacts. Organization of Section C.3 The ESC measures in this section are divided into two categories, those used during construction and those used after. Those measures used during construction are referred to as temporary ESC measures while those used after construction are referred to as permanent or final stabilization measures. Thus, the section is organized as follows: • Section C.3.1, "Temporary ESC" (p. C -79) • Section C.3.2, "Final Stabilization" (p. C -90) C.3.1 TEMPORARY ESC Temporary ESC measures are used during construction to minimize the amount of sediment mobilized and trap any mobilized sediment before it leaves the project site. This section presents the requirements and specifications for those temporary ESC measures typically applied to projects in Small Project Drainage Review. Whenever possible, the entrance shall be constructed on a firm, compacted subgrade. This can ' substantially increase the effectiveness of the pad and reduce the need for maintenance. Maintenance 1. Quarry spalls (or hog fuel) shall be added if the pad is no longer in accordance with the specifications. 2. If the entrance is not preventing sediment from being tracked onto pavement, then alternative measures to keep the streets free of sediment shall be used. This may include street sweeping, an increase in the dimensions of the entrance, or the installation of a wheel wash. Any sediment that is tracked onto pavement shall be removed immediately by sweeping. The sediment collected by sweeping shall be removed or stabilized onsite. The pavement shall not be cleaned by washing down the street, except when sweeping is ineffective and there is a threat to public safety. If it is necessary to wash the streets, a small sump must be constructed. The sediment would then be washed into the sump where it can be controlled and discharged appropriately. 4. Hydraulic Matrices (Bonded Fiber Matrix) This mulch category includes hydraulic slurries composed of wood fiber, paper fiber or a combination of the two held together by a binding system. The BFM shall be a mixture of long wood fibers and various bonding agents. Apply at rates from 3,000 Ibs per acre to 4,000 Ibs per acre and based on manufacturers recommendations The BFM shall not be applied immediately before, during or immediately after rainfall so that the matrix will have an opportunity to dry for 24 hours after installation. Application rates beyond 2,500 pounds may interfere with germination and are not usually recommended for turf establishment. BFM is generally a matrix where all fiber and binders are in one bag, rather than having to mix components from various manufacturers to create a matrix. BFMs can be installed via helicopter in remote areas. They are approximately $1,000 per acre cheaper to install. Chipped Site Vegetation Average size shall be several inches. 2" minimum thickness This is a cost - effective way to dispose of debris from clearing and grubbing, and it eliminates the problems associated with burning. Generally, it should not be used on slopes above approx. 10% because of its tendency to be transported by runoff. It is not recommended within 200 feet of surface waters. If seeding is expected shortly after mulch, the decomposition of the chipped vegetation may tie up nutrients important to grass establishment. SECTION C.3 EROSION AND SEDIMENT CONTROL (ESC) MEASURES 1/24/2005 Design and Installation Specifications For mulch materials, application rates, and specifications, see Table C.3.1.A. Note: Thicknesses may be increased for disturbed areas in or near critical areas or other areas highly susceptible to erosion. Maintenance Standards 1. The thickness of the mulch cover must be maintained. 2. Any areas that experience erosion shall be re- mulched and /or protected with a net or blanket. If the erosion problem is drainage related, then the drainage problem shall be assessed and alternate drainage such as interceptor swales may be needed to fix the problem and the eroded area re- mulched. C -82 2005 Surface Water Design Manual — Appendix C C.3.1.3 NETS AND BLANKETS C.3.1 TEMPORARY ESC Purpose Erosion control nets and blankets are intended to prevent erosion and hold seed and mulch in place on steep slopes and in channels so that vegetation can become well established. In addition, some nets and blankets can be used to permanently reinforce turf to protect drainage ways during high flows. Nets are strands of material woven into an open, but high - tensile strength net (for example, jute matting). Blankets are strands of material that are not tightly woven, but instead form a layer of interlocking fibers, typically held together by a biodegradable or photodegradable netting (for example, excelsior or straw blankets). They generally have lower tensile strength than nets, but cover the ground more completely. Coir (coconut fiber) fabric comes as both nets and blankets. Conditions of Use Erosion control nets and blankets should be used: 1. For permanent stabilization of slopes 2H:1 V or greater and with more than 10 feet of vertical relief. 2. In conjunction with seed for final stabilization of a slope, not for temporary cover. However, they may be used for temporary applications as long as the product is not damaged by repeated handling. In fact, this method bf slope protection is superior to plastic sheeting, which generates high- velocity runoff. 3. For drainage ditches and swales (highly recommended). The application of appropriate netting or blanket to drainage ditches and swales can protect bare soil from channelized runoff while vegetation is established. Nets and blankets also can capture a great deal of sediment due to their open, porous structure. Synthetic nets and blankets may be used to permanently stabilize channels and may provide a cost - effective, environmentally preferable alternative to riprap. Design and Installation Specifications 1. See Figure C.3.1.B and Figure C.3.1.0 for typical orientation and installation of nettings and blankets. Note: Installation is critical to the effectiveness of these products. If good ground contact is not achieved, runoff can concentrate under the product, resulting in significant erosion. 2. Jute matting must be used in conjunction with mulch. Excelsior, woven straw blankets, and coir (coconut fiber) blankets may be installed without mulch. There are many other types of erosion control nets and blankets on the market that may be appropriate in certain circumstances. Other types of products will have to be evaluated individually. In general, most nets (e.g., jute matting) require mulch in order to prevent erosion because they have a fairly open structure. Blankets typically do not require mulch because they usually provide complete protection of the surface. 3. Purely synthetic blankets are allowed but shall only be used for long -term stabilization of waterways. The organic blankets authorized above are better for slope protection and short-term waterway protection because they retain moisture and provide organic matter to the soil, substantially improving the speed and success of re- vegetation. Maintenance Standards 1. Good contact with the ground must be maintained, and there must not be erosion beneath the net or blanket. 2. Any areas of the net or blanket that are damaged or not in close contact with the ground shall be repaired and stapled. 3. Plastic covering may be used on disturbed areas that require cover measures for Less than 30 days. 2. Plastic is particularly useful for protecting cut and fill slopes and stockpiles. Note: The relatively rapid breakdown of most polyethylene sheeting makes it unsuitable for long -term applications. 3. Clear plastic sheeting may be used over newly - seeded areas to create a greenhouse effect and encourage grass growth. Clear plastic should not be used for this purpose during the summer months because the resulting high temperatures can kill the grass. 4. Due to rapid runoff caused by plastic sheeting, this method shall not be used upslope of areas that might be adversely impacted by concentrated runoff. Such areas include steep and/or unstable slopes. Note: There have been many problems with plastic, usually attributable to poor installation and maintenance. However, the material itself can cause problems, even when correctly installed and maintained, because it generates high- velocity runoff and breaks down quickly due to ultraviolet radiation. In addition, if the plastic is not completely removed, it can clog drainage system inlets and outlets. It is highly recommended that alternatives to plastic sheeting be used whenever possible and that its use be limited. Design and Installation Specifications 1. See Figure C.3.1.D for details. 2. Plastic sheeting shall have a minimum thickness of 0.06 millimeters. 3. If erosion at the toe of a slope is likely, a gravel berm, riprap, or other suitable protection shall be installed at the toe of the slope in order to reduce the velocity of runoff. C.3.1.5 MARK CLEARING LIMITS/MINIMIZE CLEARING Purpose Minimizing clearing is the most effective method of erosion control. Undisturbed vegetation intercepts and slows rainwater. Plant roots hold soil in place, and dead vegetation on the ground acts as a mulch. Applications Clearing limits shall be marked and clearing minimized on any site where significant areas of undisturbed vegetation will be retained. Design Specifications Minimizing clearing should be incorporated into the site design. Clearing limits must be marked on the small site ESC plan. On the ground, clearing limits must be clearly marked with brightly colored tape or plastic or metal safety fencing. If tape is used, it should be supported by vegetation or stakes, and should be about 3 to 6 feet high and highly visible. Equipment operators should be informed of areas of vegetation that are to be left undisturbed. Maintenance Fencing shall be inspected regularly and repaired or replaced as needed. Design and Installation Specifications 1. See Figure C.3.1.E and Figure C.3.1.F for details. 2. The geotextile used must meet the standards listed below. If a typical silt fence (per Figure C.3.1.E) is used, the standard 4 x 4 trench may not be reduced as long as the bottom 8 inches of the silt fence is well buried and secured in a trench that stabilizes the fence and does not allow water to bypass or undermine the silt fence. Maintenance Standards 1. Any damage shall be repaired immediately. 2. If concentrated flows are evident uphill of the fence, they must be intercepted and conveyed to a sediment trap or pond. 3. Silt dikes, if attached to impervious surfaces with tack or other adhesive agent may also be used as temporary wheel wash areas, or concrete washout collection areas. Conditions of Use 1. May be used for temporary check dams in ditches. 2. May be used on soil or pavement with adhesive or staples. 3. TSDs have been used to build temporary sediment ponds, diversion ditches, concrete washout facilities, curbing, water bars, level spreaders, and berms. Design and Installation Specifications 1. TSDs must be made of urethane foam sewn into a woven geosynthetic fabric. 2. TSDs are triangular, 10 inches to 14 inches high in the center, with a 20 -inch to 28 -inch base. A 2- foot apron extends beyond both sides of the triangle along its standard section of 7 feet. A sleeve at one end allows attachment of additional sections as needed 3. Install TSDs with ends curved up to prevent water from flowing around the ends 4. Attach the TSDs and their fabric flaps to the ground with wire staples. Wire staples must be No. 11 gauge wire or stronger and shall be 200 mm to 300 mm in length. 5. Triangular silt dikes shall be monitored for performance and sediment accumulation during and after each runoff producing rainfall event. Proof of Your Loss (1) We may require You to give Us a written statement signed by You describing Your loss which includes: (a) the basis of Your ctnin; (b) the Covered Risks which resulted in Your loss; (c) the dollar amount of Your loss; and (d) the method You used to compute the amount of Your loss. (2) We may require You. to make available to Us records, checks, letters, contracts, Insurance policies and other papers which relate to Your claim. We may make copies of these papers. (3) We may require You to answer questions about Your claim under oath. (4) Ifyou fail or refine to give Us a statement of loss, answer Our questions under oath, or snake available to Us the papers We request, Your coverage will be reduced or ended, but only to the extent Your failure or refusal affects Our ability to resolve the claim or defend You. 4. Our Choices When We Learn Of A Claim a. After We receive Your notice, or otherwise team, of a claim that is covered by this Policy, Our choices include one or more of the following: (1) Pay the clam. (2) Negotiate a settlement. (3) Bring or defend a legal action related to the claim. (4) Pay You the amount required by this Policy. (5) End the coverage of this Policy for the claim by paying You Your actual loss resulting from the Covered Risk, and those costs, attorneys' fees and expenses intuured up to that time which We are obligated to pay. (6) End the coverage described in Covered Risk 14, 15,16 or 18 by paying You the amount of Your insurance then in force for the particular Covered Risk, and those costs, attorneys' fees and expenses incurred up to that time which We are obligated to pay. (7) End all coverage of this Policy by paying You the Policy Amount then in force, and those costs, attorneys' fees and expenses incurred up to that time which We are obligated to Pay. (8) Take other appropriate action. b. When We choose the options in paragraphs 4.a. (5), (6) or (7), all Our obligations for the claim end, including Our obligation to defend, or continue to defend, any legal action. c. Even if We do not think that the Policy coven: the claim, We may choose one or more of the options above. By doing so, We do not give up any rights. 5. Handling a Claim Or Legal Action a. You roust cooperate with Us in handling any claim or legal action and give Us all relevant information. b. If You fail or refuse to cooperate with Us, Your coverage will be reduced or ended, but only to the extent Your failure or refLsal affects Our ability to resolve the claim or defend You c. We are required to repay You only for those settlement costs, attorneys' fees and expenses that We approve in advance. d. We have the right to choose the attomey when We bring or defend a legal action on Your behalf. We can appeal any decision to the highest level. We do not have to pay Your claim until the legal action is finally decided. e. Whether or not We agree there is coverage, We can bring or defend a legal action, or take other appropriate action under this Policy. By doing so, We do not give up any rights. 6. Limitation of Our Liability a. After subtracting Your Deductible Amount if it applies, We will pay no more than the least of! (1) Your actual loss; (2) Our Maximum Dollar Limit ofLiability then in force for the particular Covered Risk, for claims covered only under Covered Risk 14, 15,16 or 18; or (3) The Policy Amount then in force; and any costs, attorneys' fees and expenses which We are obligated to pay under this Policy. b. (1) If We remove the cause of the claim with reasonable diligence after receiving notice of it all Our obligations for the claim end, including any obligation for loss You had while We were removing the cause of the claim - (2) Regardless of 6.b. (1) above, if You cannot use the Land because of a claim covered by this Policy: (a) You may rent a reasonably equivalent substitute residence and We will repay You fbr the actual rent You pay, until the earlier of (1) the cause of the claim Is removed; or (2) We pay You the amount required by this Policy. If Your claim is covered only under Covered Risk 14,15, 16 or 18, that payment is the amount of Your insurance then in force for the particular Covered Risk. (b) We will pay reasonable costs You pay to relocate any personal property. You have the right to remove from the Land, including transportation of that personal property for up to twenty -five (25) miles from the Land, and repair of any damage to that personal property because of the relocation. The amount We will pay You under this paragraph is limited to the value oldie personal, property before You relocate c. All payments We make under this Policy reduce the Policy Amount, except for costs, attorneys' fees and expenses. All payments We make for claims which are covered only under Covered Risk 14, 15, 16 or 18 also reduce Our Maximum. Dollar Limit of Liability for the particular Covered Risk, except for costs, attorneys' fees and expenses. d. If We issue, or have issued, a Policy to the owner of a Mortgage that is on Your Title and We have not given You any coverage against the Mortgage, them (1) We have the right to pay any amount due You under this Policy to the owner of the Mortgage to reduce the amount of the Mortgage, and any amount paid shall be treated as a payment to You under this Policy, including under paragraph 4.a. of these Conditions; (2) Any amount paid to the owner of the Mortgage shall be subtracted from the Policy Amount of this Policy; and (3) If Your claim is covered only under Covered Risk 14, 15, 16 or 18, any amount paid to the owner of the Mortgage shall also be subtracted from Our Maximum Dollar Limit of Liability for the particular Covered Risk. e. IfYou do anything to affect any right of recovery You may have against someone else, We can subtract from Our liability the amount by which You reduced the value of that right. 7. Transfer Of Your Rights to Us e. When We settle Your claim, We have all the rights You have against any person or property related to the claim. You must transfer these rights to Us when We ask, and You must not do anything to affect these rights. You must let Us use Your name in enforcing these rights. b. We will not be liable to You if We do not pursue these rights or if We do not recover any amount that might be recoverable. c. We will pay any money We collect from enforcing these rights in the following order. (1) to Us for the costs, attorneys' fees and expenses We paid to entree these rights; (2) to You for Your loss that You have not already collected; (3) to Us for any money We paid out under this Policy on account of Your claim; and (4) to You whatever is left d. If You have rights under contracts (such as indemnities, guaranties, bonds or other policies of insurance) to recover all or part of Your loss, then We have all of those rights, even if those contracts provide that those obligated have all of Your rights under this Policy. 8. Entire Contract This Policy, with any endorsements, is the entire contract between You and Us. To determine the meaning of any part of this Policy, You must read the entire Policy. Any changes to this Policy must be agreed to in writing by Us. Any claim You make against Us must be made under this Policy and is subject to its teens. 9.
