The subdivision title allows for only one extension of not more than one year; therefore, your application for a two lot short plat has expired as of July 17, 2010. Please note that construction per the approved Shoreline Permit (file number L08 -010) cannot proceed without an active short plat preliminary approval. Per shoreline substantial development permit time requirements contained in WAC 173 -27 -090 (2) and (3): Construction activities shall be commenced within two years of the effective date of a substantial development permit. Authorization to conduct development activities shall terminate five years after the effective date of a substantial development permit. However, local government may authorize a single extension for a period not to exceed one year based on reasonable factors, if a request for extension has been filed before the expiration date and notice of the proposed extension is given to parties of record and to the department. Looking at your Public Works Permit for this project (permit number PW08 -148), a side sewer was installed and inspected in March 2009 prior to the Public Works Permit expiration on June 30, 2010, showing that construction activities were commenced within the first two years of the effective date of issuance of the Shoreline Permit. If the property owner would like to proceed with the project approved under Shoreline Permit L08 -010, preliminary short plat approval must be obtained through a new short plat application, and a new application for a Public Works construction permit must be submitted for review and issuance. The five -year expiration from the date of Shoreline Substantial Development Permit issuance is June 6, 2013. Please note that the City of Tukwila is currently in the process of updating its Shoreline Master Program. AffsA .+ Jim Haggerton, Mayor Dear Mr. Garvida, The Short Subdivision Committee has completed review of your short plat application (No. L07- 080), and determined that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the short plat approval process: (1) Preliminary Approval; (2) Final Approval; and (3) Recording. Each of these steps, along with the conditions of approval, miscellaneous comments, and information on appeal procedures specific to your short plat are described below. 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. PRELIMINARY APPROVAL CONDITIONS 1. Provide a draft copy of Private Ingress/Egress & Utility Easement and Maintenance Agreement. (1) This document shall be recorded prior to recording of the Final Short Plat Map, and the recording number be shown on the short plat map. (2) The Private Ingress/Egress & Utility Easement should include language stating who will maintain the paved area and utilities, and by what portion. (See sample enclosed.) 2. Storm drainage for roof drains, foundation drains, and paved areas shall be infiltrated and/or dispersed on -site, or detention provided. Drainage design for the site shall be reviewed as part of the PW infrastructure permit and shall meet City of Tukwila Surface Water Ordinance Requirements. Contact the Tukwila Public Works Department for submittal and design requirements. 3. All utilities including power are required to be underground, per City of Tukwila ordinance. T he sewer and water certificates submitted with the Short Plat Application are not signed. Please include signed water and sewer certificates with submittal of materials for the Public Works Permit. 5. The stockpile in its proposed location within the River and Low Impact Environments of the Shoreline buffer is not allowed. The stockpile shall be relocated within the High Impact Environment, a distance of at least 100 feet landward from the mean high water mark. The new location for the stockpile shall be reviewed with application materials submitted for the Public Works permit. 6. Install all required site improvements, including access road and utilities. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433 -0179 for a Public Works (PW) type `C' permit for approval. Provide site development plan with Public Works permit submittal. Plans shall be signed and stamped by a Washington State Licensed Engineer. As -built plans shall be provided to the Public Works Department prior to final approval. An infrastructure design and construction standard manual is available at the Public Works Department and on the City Web Site. 7. Prior to development of Lots 1 or 2, the following will be required: There must be a fire hydrant within 250 feet of all building sites. If the fire hydrant is not capable of a 1000 gallon per minute flow the future houses will be required to provide interior sprinklers, to be approved by the Fire Department. This requirement must be stated on the face of the recorded plat, and must be met prior to issuance of any building permits for Lot 1 or Lot 2. The final grading plan must show a flat area below any second story rescue windows, not steeper than a 70 degree climbing angle, for Fire Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses please contact the Tukwila Fire Marshal's office. 9. The following changes will need to be made to the Short Plat Survey Site Map: (1) New legal descriptions for Lots 1 & 2, should include `subject to' and/or `together with' the Ingress, Egress & Utilities Easement. (2) Provide legal description for `Egress & Utilities Easement', on Sheet 1 of 2 of Short Plat Survey Site Map. (3) The proposed structure on Lot 2 shall be set back from the point of stable slope at least 4.25 feet further towards 50 Place South in order to accommodate a 2.5:1 slope of the riverbank from the mean high water mark. This requirement shall be stated on the face of the recorded short plat. The front setback of the house on Lot 2 shall be from the south property line; side setbacks shall be on the east and west sides, and the rear setback shall be from the north property line. (4) Provide a statement on the face of the short plat according to the Tukwila Fire Department requirement outlined in condition number 7, above. (5) Make changes according to redlines — see enclosed redlined Short Plat Survey Site Map. 10. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: (1) A Short Plat Survey Site Map as described in the application checklist that is consistent with all of the conditions of approval. The surveyor's original signature must be on the face of the plat. (2) Existing and proposed legal descriptions for all lots. (3) Separate easement document with legal descriptions for any common access /utility infrastructure. Miscellaneous Comments - The following conditions of approval apply to the future building permit. 1. The proposed structure on Lot 2 shall be set back from the point of stable slope at least 4.25 feet further towards 50 Place South in order to accommodate a 2.5:1 slope of the riverbank from the mean high water mark, and a 20 foot setback from the point of stable slope. This concept, showing the required setback distance from the mean high water mark to any structures on Lot 2, is illustrated on the redlined Slope Exhibit, enclosed. This requirement shall be stated on the face of the recorded short plat. The front setback of the house on Lot 2 shall be from the south property line; side setbacks shall be on the east and west sides, and the rear setback shall be from the north property line. The entire area between the mean high watermark and 20 feet landward shall be planted with native trees and shrubs, according to a planting plan to be submitted for review with the building permit. In preparation for these new native plantings existing vegetation consisting of invasive species will need to be removed. The removal of invasive species prior to installation of new plantings, as well as the method of removal, will need to be included as a note or within the details and specifications on the planting plan submitted with the building permit. 3. Transportation Impact Fee applies to the future Building Permit(s). See Pavement Mitigation and Transportation Impact Fees Bulletin no. A3 — enclosed. 4. Addresses will be assigned by the Fire Department. An address post shall be installed. APPEALS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (08/07/2008). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $110. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County JR Page 4 of 6 07/16/2008 4:55 PM H:1Short Plats\Sinh\Sinh Short Plat NOD L07- 080.doc • • Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. 2. Final Approval The next step is to install the required site improvements, comply with the conditions of approval and submit the necessary short plat documents (survey, legal descriptions, and other required paper work). All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. Expiration The final approved short plat must be filed with the King County Department of Records by July 17, 2009, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. 3. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. Kent, WA 98031 (206) 261 -2418 Attn: Dan Garvida RECEIVED MAR 0 3 2008 COMMUNITY DEVELOPMENT INTRODUCTION We are pleased to submit this geotechnical engineering analysis regarding the slope stability for the two -lot short plat to be located at Lots 30 and 31 in block 13 of the Allentown Addition on 50 Place South in King County Washington. The location of the site is illustrated on the attached Figure 1, Site Vicinity Map. SITE CONDITIONS GeoResources, LLC 5007 Pacific Hwy. E., Suite. 20 Fife, Washington 98424 February 6, 2008 Geotechnical Analysis Slope Stability Nguyen Short Plat 125XX — 50th Place South King County, Washington PN: 0179002860 Prop: Garvida.Nguyen.EL Surface The parcel is rectangular shaped and is bounded by 50 Place South to the northeast, the Duwamish River to the southeast and residential property to the northwest and southeast. Access to the site is via 50 Place South. The majority of the site is relatively flat with Tess than 4 feet of elevation change, sloping slightly down from south to north. Along the western boundary of the site lies the bank of the Duwamish River. The river bank is approximately 17 feet in height and has a slope of approximately 65 percent. The proposed houses are situated in the central portions of the Tots 1 and 2 of the proposed 2 -lot short plat. The parcel is approximately 223 feet long and 80 feet in width, and encompasses approximately 0.4 acres. The site topography and proposed building envelopes are shown on the site plan provided in Figure 2. The site has largely been cleared and is vegetated with grass with the exception of the river bank which is vegetated with heavy bushes and bamboo shoots. The slope is also "armored" with tires and broken concrete. No areas of significant erosion were apparent on the site slopes. No standing water was observed on the site at the time of our site visits. Geology According to the Geologic map of the Des Moines 7.5' Quadrangle, King County, Washington, compiled by Derek B. Booth and Howard H. Waldron (2004), the site is mapped as being underlain by Alluvium deposited by the Duwamish River. These are relatively young deposits that are less than 10,000 years old. These alluvial deposits consist of a moderately well sorted mixture of gravel, cobbles and silty sand that are Garvida.Nguyen.EL February 6, 2008 Page 2 considered normally consolidated. An excerpt of the geological map is included as Figure 3. Soils The United States Department of Agriculture (USDA) Soil Conservation Service (SCS) for King County, does not map the soils at the site. We observed no active erosion in the site area during our reconnaissance. Based on our observations, the site soils will have a low susceptibility to erosion, particularly where vegetation is established. Subsurface Explorations On January 24, 2007, a representative from our office was on site to explore subsurface conditions at the site by the excavation of a single hand auger to a depth of 10 feet below existing surface grades. The approximate hand auger location is shown on the Site Plan provided as Figure 2. Our representatives continuously monitored the excavation, maintained logs of the subsurface conditions encountered in the hand auger, obtained representative soil samples, and observed pertinent site features. The specific number, location, and depth of the explorations were selected by GeoResources personnel in the field based on the encountered soils. The soils encountered were visually classified in accordance with the Unified Soil Classification System (USCS) described on Figure 4. The explorations performed as part of this evaluation indicate conditions only at the specific locations and that actual condition in other locations could vary. Furthermore, the nature and extent of any such variations would not become evident until additional explorations are performed or until construction activities have begun. The test pit Togs are shown in Figures 5. Representative soil samples obtained from the test pits were placed in sealed containers and taken to a laboratory for possible further examination and testing. Subsurface Conditions The subsurface conditions encountered in the hand auger were fairly uniform consisting of fine sand with variable amounts of silt to the depths explored. We did not encounter groundwater seepage within the hand auger although we did find evidence of iron oxide staining at a depth of approximately 9 feet indicating the potential for groundwater at that depth. CONCLUSIONS Based on our site explorations it is our opinion that the river bank is stable in its current configuration. It is our understanding that a buffer will likely be imposed along the river bank that will preclude any development of the bank itself. It is also our understanding that the City defines the "Point of Stable Slope" (POSS) as being the catch point of a line projected from the toe of the slope at a 2.5 horizontal to 1 Vertical slope. This would locate the POSS approximately 43 feet from the toe of the bank or approximately 18 feet from the top of the bank. In addition to this the City requires a 20 foot building setback from the POSS which would make the closest allowable point of any structure 38 feet from the top of the bank. Currently a building envelope is shown as being approximately 30 feet from the top of bank. Based on a slightly reduced slope of 2.25 horizontal to 1 vertical slope the current proposal is located outside of the POSS. Based on our observations we would assign a friction angle of 33 to 35 degrees for the site soils. This equates to a 1.5 Horizontal to 1 Vertical slope which matches the existing slope condition, indicating that the slope is in an inherently stable condition. It should be noted that this setback far exceeds International Building Code (IBC) Garvida.Nguyen.EL February 6, 2008 Page 3 requirements, which would normally require a building setback based on 1/3 the height of the slope to a maximum of 40 feet. Using IBC requirements the minimum setback without requiring a geotechnical engineer's recommendation would be one third of 17 feet or approximately 6 feet from the top of slope. Based on our observations we would recommend a minimum setback of 10 feet from the top of the slope as being adequate to protect the slope and any future structure. (a) Exemptions shall be construed narrowly. Only those developments that meet the precise terms of one or more of the listed exemptions may be granted exemption from the substantial development permit process. (b) An exemption from the substantial development permit process is not an exemption from compliance with the act or the local master program, nor from any other regulatory requirements. To be authorized, all uses and developments must be consistent with the policies and provisions of the applicable master program and the Shoreline Management Act. A development or use that is listed as a conditional use pursuant to the local master program or is an unlisted use, must obtain a conditional use permit even though the development or use does not require a substantial development permit. When a development or use is proposed that does not comply with the bulk, dimensional and performance standards of the master program, such development or use can only be authorized by approval of a variance. (c) The burden of proof that a development or use is exempt from the permit process is on the applicant. (d) If any part of a proposed development is not eligible for exemption, then a substantial development permit is required for the entire proposed development project. (e) Local government may attach conditions to the approval of exempted developments and /or uses as necessary to assure consistency of the project with the act and the local master program. (2) The following developments shall not require substantial development permits: (a) Any development of which the total cost or fair market value, whichever is higher, does not exceed five thousand dollars, if such development does not materially interfere with the normal public use of the water or shorelines of the state. The dollar threshold established in this subsection must be adjusted for inflation by the office of financial management every five years, beginning July 1, 2007, based upon changes in the consumer price index during that time period. "Consumer price index" means, for any calendar year, that year's annual average consumer price index, Seattle, Washington area, for urban wage earners and clerical workers, all items, compiled by the Bureau of Labor and Statistics, United States Department of Labor. The office of financial management must calculate the new dollar threshold and transmit it to the office of the code reviser for publication in the Washington State Register at least one month before the new dollar threshold is to take effect. For purposes of determining whether or not a permit is required, the total cost or fair market value shall be based on the value of development that is occurring on shorelines of the state as defined in RCW 90.58.030 (2)(c). The total cost or fair market value of the development shall include the fair market value of any donated, contributed or found labor, equipment or materials; (b) Normal maintenance or repair of existing structures or developments, including damage by accident, fire or elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limited to its size, shape, configuration, location and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment; (c) Construction of the normal protective bulkhead common to single - family residences. A "normal protective" bulkhead includes those structural and nonstructural developments installed at or near, and parallel to, the ordinary high water mark for the sole purpose of protecting an existing single - family residence and appurtenant structures from loss or damage by erosion. A normal protective bulkhead is not exempt if constructed for the purpose of creating dry land. When a vertical or near vertical wall is being constructed or reconstructed, not more than one cubic yard of fill per one foot of wall may be used as backfill. When an existing bulkhead is being repaired by construction of a vertical wall fronting the existing wall, it shall be constructed no further waterward of the existing bulkhead than is necessary for construction of new footings. When a bulkhead has deteriorated such that an ordinary high water mark has been established by the presence and action of water landward of the bulkhead then the replacement bulkhead must be located at or near the actual ordinary high water mark. Beach nourishment and bioengineered erosion control projects may be considered a normal protective bulkhead when any structural elements are consistent with the above requirements and when the project has been approved by the department of fish and wildlife. • 'WAC 173 -27 -040: Developments exempt from substantial development permit requireme... Page 2 of 5 (d) Emergency construction necessary to protect property from damage by the elements. An "emergency" is an unanticipated and imminent threat to public health, safety, or the environment which requires immediate action within a time too short to allow full compliance with this chapter. Emergency construction does not include development of new permanent protective structures where none previously existed. Where new protective structures are deemed by the administrator to be the appropriate means to address the emergency situation, upon abatement of the emergency situation the new structure shall be removed or any permit which would have been required, absent an emergency, pursuant to chapter 90.58 RCW, these regulations, or the local master program, obtained. All emergency construction shall be consistent with the policies of chapter 90.58 RCW and the local master program. As a general matter, flooding or other seasonal events that can be anticipated and may occur but that are not imminent are not an emergency; (e) Construction and practices normal or necessary for farming, irrigation, and ranching activities, including agricultural service roads and utilities on shorelands, construction of a barn or similar agricultural structure, and the construction and maintenance of irrigation structures including but not limited to head gates, pumping facilities, and irrigation channels: Provided, That a feedlot of any size, all processing plants, other activities of a commercial nature, alteration of the contour of the shorelands by leveling or filling other than that which results from normal cultivation, shall not be considered normal or necessary farming or ranching activities. A feedlot shall be an enclosure or facility used or capable of being used for feeding livestock hay, grain, silage, or other livestock feed, but shall not include land for growing crops or vegetation for livestock feeding and /or grazing, nor shall it include normal livestock wintering operations; (f) Construction or modification of navigational aids such as channel markers and anchor buoys; (g) Construction on shorelands by an owner, lessee or contract purchaser of a single - family residence for their own use or for the use of their family, which residence does not exceed a height of thirty -five feet above average grade level and which meets all requirements of the state agency or local government having jurisdiction thereof, other than requirements imposed pursuant to chapter 90.58 RCW. "Single- family residence" means a detached dwelling designed for and occupied by one family including those structures and developments within a contiguous ownership which are a normal appurtenance. An "appurtenance" is necessarily connected to the use and enjoyment of a single - family residence and is located landward of the ordinary high water mark and the perimeter of a wetland. On a statewide basis, normal appurtenances include a garage; deck; driveway; utilities; fences; installation of a septic tank and drainfield and grading which does not exceed two hundred fifty cubic yards and which does not involve placement of fill in any wetland or waterward of the ordinary high water mark. Local circumstances may dictate additional interpretations of normal appurtenances which shall be set forth and regulated within the applicable master program. Construction authorized under this exemption shall be located landward of the ordinary high water mark; (h) Construction of a dock, including a community dock, designed for pleasure craft only, for the private noncommercial use of the owner, lessee, or contract purchaser of single - family and multiple - family residences. A dock is a landing and moorage facility for watercraft and does not include recreational decks, storage facilities or other appurtenances. This exception applies if either: (i) In salt waters, the fair market value of the dock does not exceed two thousand five hundred dollars; or (ii) In fresh waters the fair market value of the dock does not exceed ten thousand dollars, but if subsequent construction having a fair market value exceeding two thousand five hundred dollars occurs within five years of completion of the prior construction, the subsequent construction shall be considered a substantial development for the purpose of this chapter. For purposes of this section salt water shall include the tidally influenced marine and estuarine water areas of the state including the Pacific Ocean, Strait of Juan de Fuca, Strait of Georgia and Puget Sound and all bays and inlets associated with any of the above; (i) Operation, maintenance, or construction of canals, waterways, drains, reservoirs, or other facilities that now exist or are hereafter created or developed as a part of an irrigation system for the primary purpose of making use of system waters, including return flow and artificially stored ground water from the irrigation of lands; (j) The marking of property lines or corners on state -owned lands, when such marking does not significantly interfere with normal public use of the surface of the water; (k) Operation and maintenance of any system of dikes, ditches, drains, or other facilities existing on September 8, 1975, which were created, developed or utilized primarily as a part of an agricultural drainage or diking system; (I) Any project with a certification from the governor pursuant to chapter 80.50 RCW; (m) Site exploration and investigation activities that are prerequisite to preparation of an application for development 'WAC 173 -27 -040: Developments exempt from substantial development permit requireme... Page 3 of 5 authorization under this chapter, if: (i) The activity does not interfere with the normal public use of the surface waters; (ii) The activity will have no significant adverse impact on the environment including but not limited to fish, wildlife, fish or wildlife habitat, water quality, and aesthetic values; (iii) The activity does not involve the installation of any structure, and upon completion of the activity the vegetation and land configuration of the site are restored to conditions existing before the activity; (iv) A private entity seeking development authorization under this section first posts a performance bond or provides other evidence of financial responsibility to the local jurisdiction to ensure that the site is restored to preexisting conditions; and (v) The activity is not subject to the permit requirements of RCW 90.58.550; (n) The process of removing or controlling aquatic noxious weeds, as defined in RCW 17.26.020, through the use of an herbicide or other treatment methods applicable to weed control that are recommended by a final environmental impact statement published by the department of agriculture or the department of ecology jointly with other state agencies under chapter 43.21C RCW; (o) Watershed restoration projects as defined herein. Local government shall review the projects for consistency with the shoreline master program in an expeditious manner and shall issue its decision along with any conditions within forty- five days of receiving all materials necessary to review the request for exemption from the applicant. No fee may be charged for accepting and processing requests for exemption for watershed restoration projects as used in this section. (i) "Watershed restoration project" means a public or private project authorized by the sponsor of a watershed restoration plan that implements the plan or a part of the plan and consists of one or more of the following activities: (A) A project that involves less than ten miles of streamreach, in which less than twenty -five cubic yards of sand, gravel, or soil is removed, imported, disturbed or discharged, and in which no existing vegetation is removed except as minimally necessary to facilitate additional plantings; (B) A project for the restoration of an eroded or unstable stream bank that employs the principles of bioengineering, including limited use of rock as a stabilization only at the toe of the bank, and with primary emphasis on using native vegetation to control the erosive forces of flowing water; or (C) A project primarily designed to improve fish and wildlife habitat, remove or reduce impediments to migration of fish, or enhance the fishery resource available for use by all of the citizens of the state, provided that any structure, other than a bridge or culvert or instream habitat enhancement structure associated with the project, is less than two hundred square feet in floor area and is located above the ordinary high water mark of the stream. (ii) "Watershed restoration plan" means a plan, developed or sponsored by the department of fish and wildlife, the department of ecology, the department of natural resources, the department of transportation, a federally recognized Indian tribe acting within and pursuant to its authority, a city, a county, or a conservation district that provides a general program and implementation measures or actions for the preservation, restoration, re- creation, or enhancement of the natural resources, character, and ecology of a stream, stream segment, drainage area, or watershed for which agency and public review has been conducted pursuant to chapter 43.21 C RCW, the State Environmental Policy Act; (p) A public or private project that is designed to improve fish or wildlife habitat or fish passage, when all of the following apply: (i) The project has been approved in writing by the department of fish and wildlife; (ii) The project has received hydraulic project approval by the department of fish and wildlife pursuant to chapter 77.55 RCW; and (iii) The local government has determined that the project is substantially consistent with the local shoreline master program. The local government shall make such determination in a timely manner and provide it by letter to the project proponent. Fish habitat enhancement projects that conform to the provisions of RCW 77.55.181 are determined to be consistent with local shoreline master programs, as follows: (A) In order to receive the permit review and approval process created in this section, a fish habitat enhancement `WAC 173 -27 -040: Developments exempt from substantial development permit requireme... Page 4 of 5 project must meet the criteria under (p)(iii)(A)(I) and (II) of this subsection: (I) A fish habitat enhancement project must be a project to accomplish one or more of the following tasks: • Elimination of human -made fish passage barriers, including culvert repair and replacement; • Restoration of an eroded or unstable streambank employing the principle of bioengineering, including limited use of rock as a stabilization only at the toe of the bank, and with primary emphasis on using native vegetation to control the erosive forces of flowing water; or • Placement of woody debris or other instream structures that benefit naturally reproducing fish stocks. The department of fish and wildlife shall develop size or scale threshold tests to determine if projects accomplishing any of these tasks should be evaluated under the process created in this section or under other project review and approval processes. A project proposal shall not be reviewed under the process created in this section if the department determines that the scale of the project raises concerns regarding public health and safety; and (II) A fish habitat enhancement project must be approved in one of the following ways: • By the department of fish and wildlife pursuant to chapter 77.95 or 77.100 RCW; • By the sponsor of a watershed restoration plan as provided in chapter 89.08 RCW; • By the department as a department of fish and wildlife - sponsored fish habitat enhancement or restoration project; • Through the review and approval process for the jobs for the environment program; • Through the review and approval process for conservation district - sponsored projects, where the project complies with design standards established by the conservation commission through interagency agreement with the United States Fish and Wildlife Service and the natural resource conservation service; • Through a formal grant program established by the legislature or the department of fish and wildlife for fish habitat enhancement or restoration; and • Through other formal review and approval processes established by the legislature. (B) Fish habitat enhancement projects meeting the criteria of (p)(iii)(A) of this subsection are expected to result in beneficial impacts to the environment. Decisions pertaining to fish habitat enhancement projects meeting the criteria of (p)(iii)(A) of this subsection and being reviewed and approved according to the provisions of this section are not subject to the requirements of RCW 43.21C.030 (2)(c). (C)(I) A hydraulic project approval permit is required for projects that meet the criteria of (p)(iii)(A) of this subsection and are being reviewed and approved under this section. An applicant shall use a joint aquatic resource permit application form developed by the office of regulatory assistance to apply for approval under this chapter. On the same day, the applicant shall provide copies of the completed application form to the department of fish and wildlife and to each appropriate local government. Local governments shall accept the application as notice of the proposed project. The department of fish and wildlife shall provide a fifteen -day comment period during which it will receive comments regarding environmental impacts. Within forty -five days, the department shall either issue a permit, with or without conditions, deny approval, or make a determination that the review and approval process created by this section is not appropriate for the proposed project. The department shall base this determination on identification during the comment period of adverse impacts that cannot be mitigated by the conditioning of a permit. If the department determines that the review and approval process created by this section is not appropriate for the proposed project, the department shall notify the applicant and the appropriate local governments of its determination. The applicant may reapply for approval of the project under other review and approval processes. (II) Any person aggrieved by the approval, denial, conditioning, or modification of a permit under this section may formally appeal the decision to the hydraulic appeals board pursuant to the provisions of this chapter. (D) No local government may require permits or charge fees for fish habitat enhancement projects that meet the criteria of (p)(iii)(A) of this subsection and that are reviewed and approved according to the provisions of this section. The warranty may be cash, an assigned savings account or an irrevocable letter of credit. FINAL APPROVAL: After the preliminary approval conditions have been met, an application for final approval shall be submitted to DCD for final review. All requirements for short plats as set forth in the Subdivision Code are met. 2. All terms of the preliminary short plat approval have been met. 3. The requirements of Chapter 58.17 RCW, other applicable state laws, and any other applicable City Ordinances have been met. 4. All required improvements have been installed in accordance with City standards or an improvement agreement with financial guarantee pursuant to TMC 17.24.030 has been entered into by the applicant and accepted by the City. 5. That the plat is technically correct and accurate as certified by the land surveyor responsible for the plat. Preliminary approval is valid for one year from the date of the Notice of Decision. The short plat documents must be recorded within that year period or the application will expire. A single one year extension may be granted by the City if signficant progress has occurred and the extension is requested prior to the expiration of the approval.
