The Museum of Flight, located at 9904 East Marginal Way South has requested to install a pedestrian bridge over East Marginal Way S. This decision is based on the Findings and Conclusions listed below. BACKGROUND Jim Haggerton, Mayor File Number: L07 -088 Applicant: Craig Parsons of the Seneca Group on behalf of the Museum of Flight Request: Approval to construct a pedestrian bridge over East Marginal Way South Location: Generally, at 9904 East Marginal Way S Comprehensive Plan Designation: MIC/H Zoning District: MIC/H SEPA: Exempt Staff: Brandon J. Miles, Senior Planner The Museum of Flight (MOF) is proposing to construct a 175 -foot pedestrian walkway extending over East Marginal Way South which will connect the Airpark to the main building. The walkway will also be utilized by Metro riders. The walkway will provide some weather protection for people crossing East Marginal Way. Additionally, the walkway will reduce conflicts between pedestrians and motorists along East Marginal Way. Access to the bridge span from the east will be provided by an accessible ramp or stairway. From the west, access is provided by an elevator and stairway. The applicant is currently negotiating an air lease with the City's Public Works Department for the space over East Marginal Way South. The Museum of Flight is one of the largest aviation museums in the country. According to the MOF website, they attract up to 400,000 visitors annually. MOF occupies four parcels along East Marginal Way South with two parcels being on both the east and west side of the street. Most of the Museum's operations are located on the east side of East Marginal Way South. This includes the main exhibit building, the "Red Barn", and most of the patron parking. On the west side of East Marginal Way is the "Airpark" which includes historic planes that can be toured by visitors of the Museum. The Museum also operates a library and historical archives on the west side of East Marginal Way South. Crossing East Marginal Way South is currently done by utilizing a City crosswalk at a traffic signal. At this location, East Marginal Way has four lanes and a turn lane. The posted speed limit at this location is 40 mph. However, actual speeds are much higher given the low traffic volume and straight street section. The crosswalk will remain after construction of the pedestrian bridge. The crosswalk provides no weather protection. The surrounding properties are primarily utilized by Boeing and King County International Airport. The City notified The Boeing Company of the proposed project in order to ensure that the project would not hinder Boeing's operations. Boeing noted to the City that they were aware of the project and had no concerns. Decisional Criteria • • Tukwila Municipal Code (TMC) 18.50.130 allows a developer who controls parcels on both sides of a public right of way to request approval to bridge the street subject to a Type II decision. Only the width of the building that extends across the street is exempt from the City's setback requirements. The developer must also obtain air rights and comply with all other relevant codes, including the Washington State Building Code. As noted the applicant is currently negotiating an air lease with the City's Public Works Department. Additionally, the applicant has a building permit pending with the Department of Community Development. The proposed elevators and stairway will be located within the required 20 foot setback. CONCLUSION The applicant complies with the decision criteria laid out in TMC 18.50.130. The pedestrian walkway will provide an easy method of crossing East Marginal Way South. Approval should be granted subject to the following conditions: 1. The applicant must obtain an air rights lease for the space over East Marginal Way where the pedestrian bridge will be located. 2. While portions of the walkway will be located within the setback area, the applicant does not have a right to add any other buildings or expand any building within the required setback area. No signage, which would be discernible from the public right of way may be installed, fastened, or hung from the pedestrian walkway without the approval of the City's Public Department and Department of Community Development. 4. In the event that this land use approval conflicts with any provision of any other required City approval or agreement the more stringent standard and/or provision shall apply. APPEAL PROCESS This decision may be appealed within 14 days from the issuance of this Notice of Decision. All appeal material must be submitted to the Department of Community Development. Project Description The Museum of Flight Pedestrian Bridge project consists of a 175 -ft pedestrian bridge spanning over East Marginal Way South, connecting the two sides of the arterial and the Museum properties on each side. The bridge is intended to serve King County Metro riders wishing to cross at the intersection of South 94 Place, and to provide a safe means of crossing for Museum visitors who wish to visit the commercial aircraft exhibit on the west side of East Marginal. Funding for this project is comprised of Federal, State, and County Grants (approximately 70 %) and private and/or Museum funds (approximately 30 %). To serve KC Metro riders, two new covered bus shelters will be constructed near the intersection of South 94 Place as part of the bridge project. Within the next 5 -10 years, the Museum aspires to fully develop the property on the west side of East Marginal - including the design and construction of an air and space gallery (possibly to include one of two Space Shuttles being decommissioned by NASA), a covered commercial and defense aircraft exhibit, and a permanent home for the Aviation High School. The significant financial investment represented by the bridge project is a critical first step to this campus development plan, and a means to provide for the safety of Museum visitors around this busy arterial. During operating hours, the bridge will be illuminated internally at a low level, to accommodate the safety of the users. No internal or external signage is anticipated. The Museum intends to provide small informational displays along the handrails on bridge span, but has no immediate plans for other exhibits on the bridge. Access to the bridge span from the east is provided by an accessible ramp or stairway. From the west, access is provided by an elevator and stairway. The Museum of Flight is open seven days a week from 10:00 a.m. to 5:00 p.m. The Museum is closed Thanksgiving Day and Christmas Day. On the first Thursday of each month, the Museum remains open until 9:00 p.m. At other times, the bridge can be physically closed with the gates provided at the three entry points. The Museum plans to install IP security cameras at several points along the bridge for monitoring by the Museum staff. The traffic signals at the intersection of South 94 Place will be modified to accommodate the bridge structure, and such plans are under review by Tukwila Public Works. The at -grade street crossings will be limited to one east -west cross walk at this intersection, rather than the two that currently exist. You could just submit a letter to the Director, permit fee and plans. This could come in before the building permit but once the design has been finalized. - The associated elevator and stair tower could be included in the exemption request. We met internally and identified the following questions to be resolved as you move toward a more detailed design: - It sounds like you have moved away from the "fuselage" design for an enclosed bridge. What would the new design look like? - Where are the proposed columns? Would you need any in R -O -W? - Where would storm drainage go? - Would the existing traffic signal or crosswalk be affected by the bridge? - Have you already coordinated with Metro for bus station location and design? - Closure of EMWS for bridge construction will only be allowed by Public Works at night between 7:00 PM and 5:00 AM. Therefore you will likely need a noise variance due to the noise limitations on nightwork. - The proposed 17 ft clearance is adequate for truck traffic, however Boeing sometimes moves their planes or fuselages so PW will need a letter from Boeing stating that this clearance is adequate for them. - Is any lighting proposed for the bridge? - Would the elevator operate around the clock or only during business hours for the Museum? - Relief from setback requirements would require an administrative special permission application, see TMC 18.50.130. - Construction would occur under a "D" development permit with associated PW activities. - Air rights or an easement would need to be negotiated with the City Council through a legislative process. That would likely involve meeting with the Transportation Committee and then presenting a proposal to the full Council. We would be happy to meet with your team on site to discuss this further. We would be available the afternoon of Wednesday December 20, or any time the 21st or 22nd. If those dates don't work we could look at the beginning of January. This helps you to team about and discuss our regulations and plan submittal requirements, to provide early discussion of any major issues, and to facilitate the plan review process. NOTE: If you have specific questions or issues regarding your proposal that you would like addressed at your pre- application meeting, we encourage you to submit them with your application. This will allow staff to do the necessary research to answer your questions /concerns. The Development Review Committee (DRC) meets every Thursday afternoon. Two time slots are available for pre- application meetings on a first -come first -serve basis, 2:30 p.m. and 3:30 p.m. The meeting takes approximately one hour. Your pre- application and submittal requirements must be presented to the Permit Center ten (10) days prior to the meeting (Monday, 5:00 p.m. deadline) along with the $230.00 application fee. Submittals will not be accepted through the mail, over the fax or by a messenger service. Our meetings are informal. We usually begin with our questions and/or major issues we see. Your design team is encouraged to participate (i.e., architects, engineers, project coordinators, etc.). Staff from Building, Fire, Planning and Public Works will be present at the meeting. The Parks and Recreation Department and Police Department will provide written comments pertaining to your pre - application submittal, if necessary. We take notes during the meeting. Within one week following the meeting, a summary of all comments prepared in checklist format will be forwarded to the contact person identified on the sign -in sheet presented at the meeting. Along with the comments will be permit applications, plan submittal requirements, selected ordinances and general information as it pertains to your project. If you have any questions or want to participate in this process, please feel free to contact the Permit Center at (206) 431 -3670. Your pre- application plan submittal checklist is a guide. However, the more information submitted, the more complete our assessment can be.
