The following information was submitted as part of the application.

This application is for a 2 -lot short plat located at 13039 56 Ave S in Tukwila's Foster
Point neighborhood. The current site is approximately .62 acres with an existing house,
garage, driveway, and multiple, old concrete foundations. The site is mostly grass with a
few mature trees along the side yards and along the river. The otherwise level lot has
grass covered, sloping earthen terraces approximately 20 -40' back from the river. The
property will be divided into two lots. Aside from the existing house, all existing
foundations will be removed. The project is anticipating approximately 140 cubic yards
of cut and 150 cubic yards of fill. One significant tree will be removed and four trees will

be planted in its place. The existing house will remain and a new house will be added
closer to the river. Both houses will be serviced by a shared driveway along the
southwest side of the lot.
II. Policies of the Shoreline Management Act /Shoreline Master Program
This area was annexed into the City of Tukwila in 1989. The City of Tukwila is required
to administer annexed areas based on the Shoreline Management Plan which was in place
at the time of annexation, until such time as a new Master Plan is adopted and approved
by the Washington State Department of Ecology. This area is subject to King County's
Shoreline Master Program.
III. Existing Development
The project is located in the Foster Point Neighborhood. This neighborhood has been
improved with sewers enabling infill to occur. This lot, and the surrounding land use
pattern, is single family development. An existing older home will remain on the front
parcel with a new home to be constructed on the new rear, waterfront parcel.
IV. Shoreline Regulations
King County Shoreline Management Program
Applicable regulations of King County Shoreline Master Program:
King County Code Chapter 25.16.030 General Requirements
A. Non -water related development and residential development shall not be permitted
waterward of the ordinary high water mark.
When a building permit is applied for, the developer will need to comply with this
requirement. The building envelope outlined on the submitted plans is twenty -five
feet inland from the ordinary high water mark.
B. Except in those cases when the height requirements of the underlying zones are more
restrictive, no structure shall exceed a height of thirty -five feet above average grade
level. This requirement may be modified if the view of a substantial number of
residences will not be obstructed, if permitted by the applicable provisions of the
underlying zoning, and if the proposed development is agricultural, water related or
water dependent.
The underlying zoning is more restrictive; in LDR zones, the building height cannot
exceed thirty feet.

C. All development shall be required to provide adequate surface water retention and
sedimentation facilities during the construction period.
Prior to construction the applicant is required to obtain the necessary permits from the
City's Public Work's Department. These permits will require the submittal of a
temporary erosion and sedimentation control plan for construction activities. The
plan must be approved prior to construction activities.
D. Development shall maintain the first fifty feet of property abutting a natural
environment as required open space.
This criterion is not applicable, as the King County shoreline environment
designation adjacent to this site as "Urban Environment ".
E. Parking facilities except parking facilities associated with detached single-family and
agricultural development shall conform to the following minimum conditions:
E (1) Parking areas must be located beneath or upland of the development...
E (2) Any outdoor parking area perimeter... must be maintained as a planting area with
a minimum of five feet.
E (3) One live tree ...shall be required for each thirty linear feet ofplanting area.
E (4) One live shrub...for each 60 inches of planting area shall be required.
E (5) Additional perimeter and interior landscaping of parking areas may be required
when large parking areas are proposed
This criterion is not applicable, as the proposed development is detached single - family.
F. Collection facilities to control and separate contaminants shall be required
where storm -water runoff from impervious surfaces would degrade or add to the
pollution of receipt waters or adjacent properties.
Any water discharged into the Duwamish River is required to meet all State and Federal
water quality standards. Following the removal of 3,933 square feet of existing
impervious surface, construction of the new driveway and proposed house will result in
an estimated net gain of 681 square feet of new impervious surface. Three 10' dispersion
trenches with a 25' vegetated flow path are proposed to collect storm water from the new
house. The driveway is designed with sheet flow dispersion along most of its length.
G. The regulations of this chapter have been categorized in a number of sections;
regardless of the categorization of the various regulations, all developments must
comply with all applicable regulations.
The proposed project will comply with all applicable Shoreline regulations.

H. Development proposed on shorelines of the State shall maintain setbacks, provide
easements or otherwise develop the site to permit a trail to be constructed or public
access to continue where;
1. There is a proposed trail in the King County Trail system; or
2. Part of the site is presently being used and has historically been used for public
access.
The site is not part of the King County trail system nor has it been used historically
for public access to the shoreline.
King County Code Chapter 25.16.100 Residential Development — Single- Family:
Single-family residential development may be permitted in the urban environment subject
to the general requirements of K. C. C. 50.16.030, provided:
A. Single-family development, is permitted in the underlying zone classification;
The underlying zone classification is Low - Density Residential which permits single -
family residential development.
B. Single-family development, including floating homes, shall not be permitted
waterward of the ordinary high water mark;
Upon application for a building permit, the new development will have to comply with
this requirement. The proposed building envelope is twenty -five feet from the ordinary
high water line.
C. Setbacks. Single-family residential development shall maintain a minimum setback of
twenty feet from the ordinary high water mark, except that:
1. If the minimum setback from the ordinary high water mark of a river or
stream falls within the floodway, the development shall be required to locate
past the upland edge of the floodway,
Upon application for a building permit, the new development will have to comply with
this requirement. FEMA flood maps indicate small areas of floodway on the parcel. The
proposed building envelope is twenty -five feet from the ordinary high water mark and
outside of this floodway.
2. If development is proposed on shorelines, including one or more sensitive
areas, as defined in K.C.C. 21.04, such development shall be done in
accordance with regulations and procedures set forth in KC. C. 21.54.150
through 21.54.190,
While the riverbank has steep slopes, no development is proposed in these sensitive areas
or their associated buffers.

D. A farmhouse permitted under K C. C. 21.54.060 shall be exempt from the setback
requirements of this section.
This is not applicable because a farmhouse is not proposed.
Chapter 25.16.110 Residential development — Accessory structures.
Accessory structures to the residence may be placed within the required shoreline
setback, provided:
A. No accessory structure, except swimming pools, shall cover more than one hundred
fifty feet;
B. No accessory structure shall obstruct the view of the neighboring properties.
If an accessory structure is proposed at the time of development, it will have to comply
with the requirements of this code.
Public Comments
Comments were received via a telephone call from Christine Taylor of the Muckleshoot
Indian Tribe, in response to the Notice of Application. Ms. Taylor asked how much cut
and fill would occur on the site.
The applicant responded that approximately 140 cubic yards of cut and 150 cubic yards
of fill is anticipated. Ms. Taylor had no further comments.
Comments were also received via email from Karen Walter, also from the Muckleshoot
Tribe, in response to the Notice of Application. Ms. Walter sought clarification to the
landscape plan. She wanted verification on which trees would be removed from the
shoreline area; how the newly planted trees will be protected from future owners cutting
them down, and, if invasive species were growing along the river, would the applicant be
required to remove them.
The applicant was asked in revise the landscaping plan in response to Ms. Walter's
comments. The applicant was asked to change the language and symbology to more
clearly identify the trees to be retained on site. The landscape plan will also be updated
to correctly identify one mislabeled species. Three trees not included on the plan will be
included if they are determined to be significant trees. The City requested that the
applicant not remove a cedar tree identified for removal. The proposed building footprint
will be shifted within the allowed building envelope in order to preserve this tree. With
only one significant tree identified for removal, the applicant will be required to plant
only four native trees to replace this one significant tree. The short plat will include
language that the trees shown on the plat are to be preserved and must meet the
requirements of the Tukwila Municipal Code. Finally, after consulting with Sandra
Whiting, City of Tukwila's Urban Environmentalist, staff recommends not requesting
removal on the blackberries growing on the river banks. The banks are very steep and

removal could destabilize the soil in this area and, due to the slope, could be dangerous
for the home owner to maintain.

VI. SEPA and other City approvals
The City SEPA Responsible Official has previously determined that this application does
not require a SEPA threshold determination because it is categorically exempt.
The applicant will be required to obtain a Public Works permit.
VII. Recommendation
Approval of the shoreline substantial development permit with the following conditions:
1. The landscaping plan shall be revised to correctly reflect and label all significant
trees on site and clearly identify which trees will be preserved, including
preservation of the tree labeled T9.
2. Include a note to be recorded on the plat stating that the trees shown on the plat
are to be preserved according to Tukwila Municipal Code.

The Muckleshoot Indian Tribe Fisheries Division has reviewed the notice
of application materials that we received for the above referenced
project. We have some questions about this proposal as noted below.
1. Are all trees that are 4 inches in diameter or larger that will
be removed from within 200 feet of the Duwamish River shown on the
shoreline site plan and sensitive area plan? If not, how many additional
trees will be removed from within 200 feet of the Duwamish River will be
removed?
2. Is it correct that trees T10, T11, T12, T12, and T14 will be
remaining as part of this project and not be removed?
3. How will the existing trees and the proposed trees (8 shore pine
and 4 western red cedar) be protected to ensure that the new property
owner(s) do not remove them to create a view corridor?
4. Are there any invasive plants growing along the river at this
project site and will they be removed as part of this project?
We appreciate the City's responses to these questions. We also ask that
we become a party of record to this proposal.

Purpose of this letter:
This letter is to inform you that on March 14, 2008, the Department of Ecology received notice that the
City of Tukwila approved your application for a shoreline substantial development permit (SDP) to create
a 2 -lot short plat with two residences at 13039 56 Ave. S, in the Urban Residential shoreline
environment of the Duwamish River, a shoreline of statewide significance.
What happens next?
The law requires you to wait at least twenty -one (21) days from the date we received this decision from
Bremerton before you begin the specific activities authorized by this permit. Therefore, you cannot
lawfully begin those activities until April 3, 2008. This waiting period is to allow anyone disagreeing with
any aspect of your permit to appeal to the state Shorelines Hearings Board.
If anyone does appeal your permit, you must wait until the appeal is over before you start work. The
Shorelines Hearings Board will notify you by letter if they receive an appeal. To be sure the Shorelines
Hearings Board has not received an appeal, we advise you to call them at (360) 459 -6327 before you
begin work. Other federal, state and local permits may be required in addition to this shoreline permit. If

This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project
and permit approval.
Project Description: This application is for a 2 -lot short plat located at 13039 56 Ave S in Tukwila's
Foster Point neighborhood. The current site is approximately .62 acres with an existing house, garage,
driveway, and multiple, old concrete foundations. The site is mostly grass with a few mature trees along
the side yards and along the river. The otherwise level lot has grass covered, sloping earthen terraces
approximately 20-40' back from the river. The property will be divided into two lots. Aside from the
existing house, all existing foundations will be removed. The project is anticipating approximately 140
cubic yards of cut and 150 cubic yards of fill. One significant tree will be removed and four trees will be
planted in its place. The existing house will remain and a new house will be added closer to the river.
Both houses will be serviced by a shared driveway along the southwest side of the lot.

III. YOUR APPEAL RIGHTS
One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person
appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the
Shorelines Hearings Board. Appellants should consult the rules and procedures of the Shorelines Hearings
Board for details.
IV. PROCEDURES AND TIME FOR APPEALING
The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW
90.58 and WAC 461.08.
V. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the Shoreline
Substantial Development Permit are available for inspection at the Tukwila Department of Community
Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday

Property owners affected by this decision may request a change in valuation for their property tax purposes.
Contact the King County Assessor's Office for further information regarding property tax valuation changes.

1. On Sheet L1.0:

1) Correctly identify tree T14: 14" Cedar. This evergreen tree is not a cedar. Photo included.
2) Three probably significant existing trees are located on the site but not shown on the plans.
Add them to the plans. One is located at the top of the slope, midway along the property.
The other two are on the north- easterly fence line. Photos included.
3) The legend shows circled trees. While the circle is intended to illustrate the root protection
zone, the label beside this graphic says "significant tree to remain." A comment was
received asking which trees will remain. Please amend the graphic to eliminate the
confusion.
4) Do not remove tree T9 or provide rational as to why it must be removed. The landscape
plan shows removal of T9 although the civil, shoreline, conceptual drainage and road
improvement plans all show T9 remaining. The proposed location of the house is not
sufficient rational as the house can be shifted north- easterly to save the tree.
5) Locate all replacement trees on the lot from which the existing tree was removed from.
6) Amend Construction notes and tree staking detail to reflect red -lined comments.

written comments on the application or desiring to receive notification of the final decision on the application may do so
within 30 days of the notice of application. If a hearing will be held on the application, the hearing notice must include the
information that written comments may be submitted, or oral presentation made at the hearing.

I. PROJECT OVERVIEW

This project is located at 13039 56 AVE S in Tukwila WA. The property is
approximately 0.62 acres. There is an existing house, garage, driveway and
old concrete foundations. Most of the site is covered in grass, with a few trees
and bushes scattered around the property. The runoff sheet flows off the
property in two principal directions. The quarter of the property near the river
sheet flows to the river. The rest of the site sheet flows to the southeast. No
significant amounts of upstream flow enter the site.
The level one drainage analysis can be found in Appendix A.
Proposed Conditions:
The property will be divided into two residential lots. The existing house will
remain, and a new house will be added closer to the river after all the previous
improvements have been removed. Both lots will gain access from a new
driveway to the southwest of the existing house.
The new home will route roof runoff through downspout dispersion trenches, and
the driveway will make use of sheet flow dispersion.
II. CONDITIONS AND REQUIREMENTS SUMMARY
This project qualifies for Small Project Drainage Review. The following
requirements of the King County Surface Water Design Manual (KCSWDM) will
be provided as follows:
Core Requirement #1, Discharge at the Natural Location:
The site's drainage pattern currently tends to sheet flow in two principal
directions off the site. The quarter nearest the river sheet flows to the
river. The rest of the site sheet flows from the northwest to the southeast
and enters the drainage system in 56 AVE S. Runoff will continue to
head in the two principal directions, with slightly more runoff heading
directly to the river after the improvements are made.
Core Requirement #2, Offsite Analysis:
An offsite analysis is provided in Appendix A.

Core Requirement #3, Flow Control:
This project proposes less than 10,000 sf of net new impervious surface
and therefore qualifies for small site review. There is no formal flow
control required, however, the new home will route roof runoff through
downspout dispersion trenches and the new driveway will make use of
sheet flow dispersion.
Core Requirement #4, Conveyance System:
No new conveyance systems are being added and therefore there is no
new design that is needed.
Core Requirement #5, Erosion and Sediment Control:
An erosion and sediment control plan will be provided at a later time when
this project is farther along.
Core Requirement #6, Maintenance and Operations:
A maintenance and operations manual will be submitted later.
Core Requirement #7, Financial Guarantees and Liability:
The owner will provide this information prior to permit issuance.
Core Requirement #8, Water Quality:
Per Exemption #1 of Section 1.2.8, this project is exempt from a formal
water quality facility because the new PGIS will be less than 5,000 SF.
No water quality facility will be provided. Also, this is not a requirement
for the small site review.

IV. FLOW CONTROL AND WATER QUALITY FACILITY ANALYSIS AND

The below figures represent the impervious surface calculations for this project.

A vicinity map, sensitive areas map, aerial photograph, topo map, and offsite

This project is located at 13039 56 Ave S. in Tukwila WA. The property is

TASK 3 FIELD INSPECTION

TASK 3 FIELD INSPECTION
A field inspection was conducted on June 1, 2007 to inspect the onsite
drainage system of the site. Offsite drainage systems were also inspected
downstream approximately 1/4 mile(s) from the discharge points of the site.
The inspection involved investigation of the ten specific items of a Level 1
Inspection per the King County Surface Water Design Manual, 1998. The
inspection yielded the following findings:
1. No existing or potential problems were observed.
2. The existing drainage system capacity was adequate.
3. There were no existing or potential flooding problems. The 100 year flood
elevation is shown on the drawings.
4. There were no existing or potential sedimentation, scouring or
bank sloughing problems for the bulk of the site. See Geotechnical
Engineering Study by Earth Solutions NW, LLC dated August 31, 2007
for more information.
5. No significant destruction of aquatic habitat or organisms was noticeable.
6. Qualitative data such as land use, impervious surfaces, topography, and
soil types was noted and can be found in Task 4 information.
7. Information was collected on pipes, ditches, and structures. This
information is also included in the Task 4 information.
8. Tributary basins delineated in Task 1 were verified.
9. The neighbor to the northeast was contacted.
10. The weather condition at the time of the inspection was sunny and warm.

After a thorough field inspection and a detailed resource review no existing or
potential problems were found. No mitigation is required. The proposed
improvements will not produce a significant impact to the existing drainage
patterns once the site has been stabilized and the runoff has been controlled
using downspout dispersion for the new house and sheet flow dispersion for
the new driveway.
A temporary erosion and sedimentation control plan will be created at the final
design stage to minimize the transport of sediment -laden runoff to the

Shoreline Project Consistency Review
• The underlying zone for this district is Low Density Residential; the proposed short plat is in conformance
with the regulations of the zone and does not conflict with the goals and policies of the Shoreline Master
program or the provisions of the Shoreline Act and shoreline regulations.
• There are no current or proposed structures or accessory facilities located over the river.
• Within the recommended setback from the river (20' from the ordinary high water mark) there is no
proposed removal of any existing trees or vegetation. Any tree removal outside the setback area is
addressed in the Tree Retention/ Landscape Plan.
• The conceptual drainage plan attempts to ensure that no effluents are discharged into the Green River
which exceeds the water quality classification as established by the State for the adjacent portion of the
river. Additionally, all State and Federal water quality regulations shall be strictly complied with.
• There are no proposed actions that should endanger wildlife habitat in and along the river.
• All vegetation along the river will be maintained, and no change to said vegetation is proposed.
• All necessary permits, such as building, filling and grading, and land use, will be obtained from the
appropriate agency /municipality.
• No mining, land filling, or dredging is proposed for the site.
• All waste will be disposed of in the city sewer system.

KING COUNTY
SEELYE CONNECTION ABANDONMENT AGREEMENT
THIS AGREEMENT, made as of the 6 day of
1981, between King County, a legal subdivision of the State of
Washington (hereinafter referred to as "the County "), and the
Municipality of Metropolitan Seattle, a metropolitan municipal
corporation of the State of Washington (hereinafter referred to
as "Metro ");
W I T N E S S E T H:
WHEREAS, the parties have heretofore entered into a long term
agreement for sewage disposal dated July 17, 1975 (hereinafter
referred to as the "Basic Agreement "); and
WHEREAS, said Basic Agreement superseded the Agreement for
Sewage Disposal dated June 19, 1961 with King County Sewerage and
Drainage District No. 4 (hereinafter referred to as the "Original
Agreement "): and
WHEREAS, pursuant to said Original Agreement, Metro constructed
the Seelye Connection as an interim metropolitan facility to tempor-
arily connect the local sewage facilities of King County Sewerage
and Drainage District No. 4 to the metropolitan sewage system; and
WHEREAS, construction of the Empire Way Interceptor in 1975
permanently connected most of the above described local sewage
facilities to the metropolitan sewage system; and
WHEREAS, in 1979, the County assumed the duty to maintain,
operate, repair, relocate and replace the Seelye Connection, as
identified on Exhibit A attached hereto; and
WHEREAS, complete abandonment of the Seelye Connection in
1981 is now deemed to be in the best interest of King County
an '•!t t ro;

Section 1. Definitions. The defined terms used in this
agreement shall have the meanings set forth in the Basic Agree-
ment, which is hereby incorporated by reference and made fully
a part of this agreement.
Section 2. Design and Construction of Certain Facilities.
It shall be the sole responsibility of the County to disconnect

all sewage facilities now tributary to the Seelye Connection and
CD
N to connect said facilities to the Empire Way Interceptor. Engineer -
ing plans, specifications, and contract documents for the construc-
c0
tion of facilities necessary to accomplish said connection to the
Empire Way Interceptor shall be submitted to Metro for review and
written approval before advertisement for bids. It shall also be
the responsibility of the County to cap or plug the upstream terminus
of the Seelye Connection following the aforementioned disconnec
tion of tributary facilities. The County shall take any and all
reasonable action necessary to complete the work described in
this Section 2 during 1981.
Section 3. Ownership, Use, and Maintenance of New Facilities.
The County shall own, operatr, and maintain all facilities con -
structed under the terms of this agreement. Metro shall have no
responsibility for operation and maintenance of these facilities.
Section 4.• Liability_ The County shall indemnify and hold harm-
less Metro from and against any and all claims, litigation,
demands and suits for any personal in)uries and property damage
