REPEALED BY ORD 571
AN ORDINANCE amending section 4 of Ordinance 4249, relating
to the care and control of dogs within the corporate limits of the
Town of Tukwila:
BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF TUKWILA, AS
FOLLOWS:
Section 4, of Ordinance 4249, is hereby amended to read
as follows:
MAYOR
Trespass and Nuisance. It shall be unlawful to suffer or
permit any animal, reptile or fowl totrespass on private or
public property so as to damage or destroy any property or
thing of 'value and same is hereby declared to be a nuisance
4410 any such animal, reptile or fowl may be impounded by the
poundmaster. Whenever it shall be affirmed in writing by 3
or more persons having separate residences, or regularly
employed in the neighborhood that any animal, reptile or
fowl is an habitual nuisance by reason of trespassing,
howling, barking or other noise, or damage to property,
being vicious or by its actions potentially vicious or in
any other manner causing undue annoyance, the poundmaster
if he finds such nuisance to exist in fact, shall serve
notice upon the owner or custodian that such nuisance must
be abated within 48 hours, after which the poundmaster shall
decide whether such nuisance has been abated and if not, any
such animal shall be impounded. Refusal to release to the
poundmaster any such animal, reptile or fowl, shall consti-
tutea violation of this ordinance.
Any owner or keeper aggreived at the classification of his
animal, reptile or fowl, as a nuisance may request a hearing
before the Municipal Judge to determine the justification of
such classification or the merit of the complaints. A filing
fee of $15.00 shall accompany the aggreived party's request
for a hearing.
