These documents shall be maintained and made available until final inspection approval is granted. 5: Truss shop drawings shall be provided with the shipment of trusses delivered to the job site. Expiration of Plan Review — Applications for which no permit is issued within 180 days following the date of application shall expire by limitation. Building and Mechanical Permit The Building Official may grant one or more extensions of time for additional periods not exceeding 90 days each. The extension shall be requested in writing and justifiable cause demonstrated. Section 105.3.2 International Building Code (current edition). Ms. Dempere currently has a pending permit to move her existing dwelling 30 feet to the north. Her neighbor, Harold Hemenway, has a pending permit for the construction of two single family dwellings following a short plat on a lot adjoining Dempere's property on the east side. - This letter is to notify the City of an ongoing boundary dispute between Dempere and Mr Hemenway. Ms. Dempere asserts that the common boundary between the two parcels on the north side is a stone pillar which marks the east end of a rock wall that runs along the front of her property. Running south, the boundary was a row of large maples whose ownership was disputed by Hemenway. In 1990, the Shefllers, owners of 4033. So. 128 St. before my client, told her of this dispute and that the trees had been poisoned and presented a hazard. She paid an additional $5,000 for a survey of the property (# 90053) and removal of the dead trees to have peace; unfortunately the stumps were left in, which make laying a durable driveway infeasible and she still may have to go to court to protect her rights. In 1995 Hemenway moved his fence several feet to the south to line it with the Bitzig's, his neighbor to the east. When his south neighbor complained, Jeff Hemenway who was on friendly terms with my client, asked for her 1990 survey done by Schroeter Surveying. Schroeter Surveying was also hired by Hemenway to do his survey (# 95067). This survey does not mention finding any of my client's 1990 survey markers and my client suspects that they had been removed. Hemenway moved his south fence to its previous location knowing it was about four feet into his neighbors to the south. In June 17, 1997 my client saw Hemenway building a fence on top of the old stumps using her property since theirs was full of blackberries and in the process they cut down a birch tree she had planted and two large lilac trees. She wrote them a letter denying them access to her property, opposing the fence location and reported the damage to Tukwila police # 97 -5168. Last month your department told my client that she would ultimately have to lay a concrete or asphalt driveway, and when she told you of her property dispute and the stumps, she was told that she will have to solve this issue since she could not get her permit final until the driveway was completed. Now you have stated that you will not issue a permit to my client or Hemenway until the property issue is resolved. In regards to Hemenway who is building a house where _ setbacks are an issue and he may sell, it makes legal sense, but my client has over 10 feet of driveway width so there is no legal reason for delaying her permit. She needs to stop the flooding on her basement with a new foundation (install windows and siding) to avoid worse damage in case of an earthquake. Measuring from the 2x4 wood fence on top of her west rockery and butting against the Hemenway fence, she only has 48 feet 11 inches where the survey shows she has 50 feet, so she is not the one depriving others of property. The encroachment by Hemenway is problematic because his marker (and fence) is 17 inches west of the NE stone pillar to the east which marks the driveway entrance and which Dempere considers her boundary. This pillar is part of a stone wall that is an asset to her property and that she wants to remain hers. The other issue concerns the large stumps which must be removed if her driveway is to last. As a result, she opposes issuance of a building permit to Hemenway for the reasons outlined above. If you should have any questions, do not hesitate to call. The letter is regarding an alleged property line dispute between your client, Jackie Dempere and Harold Hemenway. The property line in dispute is the west property line. In your letter you note that Ms. Dempere objects to the issuance of a building permit for the Hemenway property. In 2006, the City of Tukwila approved a short plat for the Hemenway property (L04- 078). The short plat map was prepared by Schroeter Land Surveying. The short plat notes that the length of the west property line is 168.37 feet. This is same length that is shown on the surveys prepared by Schroeter Land Surveying in January of 1995 ( #95067) and May of 1990 ( #90053). Given that S. 128 St. curves at this location, any discrepancies in the surveys would be indicated by the west property line having a different length. Since all three surveys show the same length each survey must be showing the property line in the same location. Planning staff visited the property and located the property marker along the northwest corner of the property. The marker included a cap from Schroeter Surveying. The City of Tukwila has no evidence that the property marker has been moved. The proposed house on the Hemenway property meets the setback requirements for the Low Density Residential (LDR) zone. If Ms. Dempre asserts that the property line is the stone pillar found in the NW corner of the Hemenway property such a claim can only be resolved through an adverse possession action with King County Superior Court.
