Town of Tukwila
AN ORDINANCE of the Town of Tukwila amending Ordinance No.
311 by modifying a condition of the street vacation contained therein.
WHEREAS, Ordinance 311 of the Town of Tukwila was passed and
approved October 3, 1960, and
WHEREAS, said Ordinance imposed certain conditions upon the
vacation of certain portions of streets in the Town of Tukwila, and
WHEREAS, conditional assumptions made at the t ime of the
passage of said ordinance have proved to be infeasible and a modifica-
tion in condition N of Section 1, thereof is mutually desirable from
the standpoint of the landowners and the Town of Tukwila,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN
OF TUKWILA:
Section 1: That ordinance No. 311 of the Town of Tukwila
be amended in that Section 1, sub section N shall read:
That in the excavation between stations 2510 and 2540
as described in a letter dated September 27, 1960 from
P. J. McKay, Washington State Highway Commission,
District Engineer, to the Town of Tukwila, and maps
filed thereto, the petitioner shall not extend their
excavation more than five (5) feet below the grade
line as agreed to and as shown on the maps in red
color.
Section2: That this ordinance shall be in effect five (5)
days from and after its passage, approval and publication
as provided by law.
PASSED This 13th day of September, 1961.
