Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council to order and led the audience in the Pledge of
Allegiance.

Leslie Campbell, Chairman of the Tukwila Arts Commission,
extended an invitation to the dedication of the Indian Mural
placed at the entrance to the Police Department. The cere-
mony will be August 7 and will include a baked salmon dinner.
She also reported on their latest project, the purchase of a
sculpture by Richard Beyer. The suggestion is to move a
large rock into Hazelnut Park, and Mr. Beyer will put an
aluminum sculpture of a mountain lion sunning himself on the
rock. The project will cost $7,000.
An alternate location was discussed. Councilman Duffie
discussed whether or not the figure of a wild animal was
appropriate for a small neighborhood park used by young
children. Ms. Campbell said that this was the recommendation
of the Commission, but she will take the comments of Council
back to their next meeting for further discussion.
Attorney Haney discussed the court case of First English
Evangelical Lutheran Church versus County of Los Angeles.
This case involved regulatory taking of property by a
municipality. A regulatory taking is where a municipality
enacts a zoning or other land use regulation which deprives
the property owner of certain rights with respect to his pro-
perty. This is an important case. It is the first case
in which the United States Supreme Court has found on a
taking, by regulations, on an interim basis. It is important
for this principal, but is not such that Council should shy
from looking at the type of land use regulations they feel
important. The two things Council should ask themselves in
connection with land use regulations are: (1) Does the land
use regulation substantially further a legitimate interest
that the City has. (2) Even if it does further the policy,
does the land use regulation deny any property owner all
economically viable uses of the land.
Attorney Haney answered questions from Council and from
Dennis Robertson and Richard Goe in the audience.
Dwayne Traynor, audience, commented that he hopes Council
considers the recommendation of the Arts Commission. He
asked to have someone look at the traffic light at 58th and
Interurban. It used to change quickly, but now you have to
sit and wait for it. He commented that the railroad track on
Southcenter Pkwy., in front of the Red Robin Restaurant, is
rough. When is the City going to get this fixed. Further,

he discussed the proposed ordinance providing additional
funds for the Fire District No. 1 annexation EIS. It appears
there is $100,000 allotted for this EIS. If the City has
this kind of money to spend, there are better places to spend
it. This annexation is going to reduce the benefits of the
present tax payers.

c. An ordinance of the City of Tukwila amending Sections
18.40.020(5) and 18.42.020 (2) of the Tukwila Municipal
Code to make ink and paint manufacturing principally per-
mitted uses in the M -1 District.
d. An ordinance of the City of Tukwila amending Section
14.04.060 of the Tukwila Municipal Code to provide addi-
tional standards for water service connections and
amending Section 14.04.070 with respect to connection
installation fees.
e. An ordinance of the City of Tukwila adding a new Section
9.28.035 to the Tukwila Municipal Code prohibiting the
negligent use of skateboards, rollerskates, coasters, toy
vehicles or similar devices.
f. An ordinance of the City of Tukwila amending the 1987
Budget adopted by Ordinance No. 1414 and passed by the
City Council on December 15, 1986, to appropriate unan-
ticipated sales tax revenues, provide additional funding
for Fire District No. 1 proposed annexation EIS and
establishing an effective date.
g. A resolution of the City of Tukwila authorizing the Mayor
to set reasonable fees and charges for the use of City
recreation facilities.

BE APPROVED AS SUBMITTED.*
Council President Morgan asked to have Item g, a resolution
authorizing the Mayor to set fees for the use of City
recreation facilities, pulled from the Consent Agenda.

Councilman McKenna read his resignation letter to Council.
He asked Council to accept his resignation as of the end of
the Regular Meeting of July 20. He has received a job promo-
tion and is moving to Bremerton. He thanked Mayor, Council,
Don Morrison, the Department Heads and Lucy for all the
assistance, guidance and friendship that has been given him.
He has been proud to serve Tukwila and to have helped contri-
bute toward a City everyone will be proud to call home.
Council President Morgan regretfully accepted Mr. McKenna's
letter on behalf of the Council.
Council Member Harris requested that the fountain, donated to
the City by John J. Doce, be activated. Mayor Van Dusen
reported that the Maintenance Department is looking for a new
pump to replace the one that is burned out. It will cost
about $980 to repair it.
Jim Haggerton, audience, commented to Mr. McKenna that he was
both constructive and productive on the City Council and he
expressed appreciation for what he did for the citizens.
Rick Beeler, Planning Director, distributed the results of
the sign code survey. Twenty -six percent of the surveys were
returned to the City. This was the first step in taking a
look at the sign code. The survey showed four key things:
(1) Many people have trouble finding the businesses. This is
a reflection on the address system and street signing in the
Business District.
(2) It was mentioned that we need a clearer code that is
easier to follow.
(3) There are several multi- tenant buildings having a
problem. The leasing agents committed the total amount of
allowed signs to a major tenant so the smaller businesses
could not put their signs up.
(4) Very few businesses knew about the sign code and how it
works and few knew the regulations for temporary signs.
