Li The Grantee's rights shall be only upon a ten (10.00) foot easement, five (5.00) feet of either side of the following described centerlines: Beginning at a point 563.63 feet N 87 ° 57'00" ;9 from the intersection. of the easterly boundary and the southerly boundary of the above described property; thence N 25 ° 01'42" E a distance of 467.00 feet; thence N 35 ° 00'00" W.a distance of 50.00 feet. Also beginning at a point 728.38 feet N 87 °57'00" W from the intersection of the easterly boundary and the southerly boundary of the above described prcperty; thence N 01 ° 57'00" W a distance of 105 feet. The grant aforesaid is made solely upon the conditions and l.indtations herein- after contained, and the Grantee, by its acceptance of the said grant, accepts such conditions and limitations and agrees to the full, strict and prompt observance and performance thereof. 1. PURPOSE: Grantee shall have the right to construct, operate and maintain two weter mains and fixtures. 2. DAMAGES: In the event that any damage of any kind is caused by Grantee nn the course of performing any act authorized by this easement; Grantee shall immediately reimburse the damaged party to the full extent necessary to restore said party to the position he would have held absent said damage. 3. RESTORATION AFTER INSTALLATION: Following any construction, Grantee shall return the Grantor's property to its origins: condition by fixing any damage Grantee's construction caused to Grantor's property including but not limited to property damage to slopes, shrubbery, landscaping, fencing, roadway or structures. 4. HOLD HARMLESS: The Grantee agrees to protect and save King County, its elected and appointed officials and employees while acting within the scope of their duties as such, harmless from and against all claims, demands, and causes of action of any kind or character, including the cost of defense thereof, arising in favor of the Grantee's employees or third parties on account of personal inj'rries, death or damage to property arising out of the premises herein or in any way rssultiag from the acts or omissions of the Grantee and /or its agents, employees or representatives. HIRING AND EMPLOYMENT: In all hiring or employment made possible or re- sulting from this agreement, there shall be no discrimination against any employee or applicant for employment because of sex, age, race, color, creed:, national origin, marital status or the presence of any sensory, mental, or physical handicap, unless based upon a bona fide occupational qualification, and this requirement shall apply to but net be limited to the following: employment, advertising, let► -off or termination, rates of pay or other forms of compensation, and selection for training, including apprentico..`iip. No person shall be denied, or subjected to di::criminYtion in receipt of the benefit of any services or activities made possible by or resulting from the agreement on the ground of se-:, race, color, creed, national origin, age except minimum age and retirement provisions, marital status, or the pres- ence of any sensory, mental or physical handicap. Any violation of this provision shall be considered a violation of a material provision of this agreement and shall be grounds for cancellation, termination or suspension in whole or in part, of the agreement by the Grantor and may result in inelig- ibility fo: further County agreements. 6. URGENCY SITUATIONS: In the event of an emergency, Granter shall take immediate steps to perform any necessary repairs, and in the event Grantee fails so to do, Grantor may perform said necessary repairs at the sole cost and expense of Grantee. 7. OTT -TER APPLICABLE LAWS: Grantee shall ccmply with all federal, state and local laws, and assume ill and expense and responsibility in connection there- with, without any liability whatsoever on the part of Grantor. 8. TERMINATION AND ABANDOMEJT: If the use of the easement on the premises described in this instrument for the purposes expressed herein shall be-aban- doned or discontinued, or if the Grantee violates any provision of this in- strument, the said easement shall thereipon cease and terminate, and Grantee shall surrender or cause to be surrendered to Grantor, to its successors or assigns, the peaceable possession of the said described premises, and title to the said premises shall remain in Grantor, or its successors or assigns, free and clear of all rights and claims of Grantee.
