Developer and the City hereby agree as follows: 1. Property. Developer holds the fee simple to that certain real property located in the City of Tukwila, King County, Washington and described as: Parcels 2,3 and 4, City of Tukwila Short Plat number L92- 0061, recorded in King County, Washington on June 28, 1993, under recording number 9306282071 ( "Property "). Developer hereby represents and warrants that Developer has disclosed to the City all persons or entities holding an interest in or to the title of the Property. 2. Development. The Developer has applied to the City to develop the Property in the following manner: Building permits for the construction of three new single family dwellings on the property ( "Development "). 3. Vacation of Street, Limitation on Use of Street, Future Dedication of Street, and Maintenance Responsibility. The property currently includes an unpaved gravel unopened public right of way which runs along and adjoins the western boundary of the property. The unopened right of way is legally described in Attachment A, which is incorporated by reference into this agreement as if fully set forth herein. Developer does not wish to pave the unopened right of way nor provide curb, gutter and drainage for the same at this time. Developer desires that the City vacate the unopened right of way so that Developer or future owners will maintain the same as a gravel street at their expense. The City does not wish to provide maintenance of the unopened right of way which would service only the Developer's property and, therefore, also desires vacation of the unopened right of way. The City may, however, need the unopened right of way in the future in the event the City seeks to connect S. 148th St. to S. 150th St. Based on the above stated desires, the unopened right of way shall be vacated and Developer shall take possession of the same (vacation shall be accomplished according to applicable law). In lieu of monetary compensation to the City, Developer agrees that it will dedicate and reconvey the unopened right of way back to the City in the event the City deems it desirable and feasible to utilize the unopened right of way to connect S. 148th St. to S. 150th St. During all periods of time in which the unopened right of way is owned by Developer, Developer agrees that the unopened right of way shall be used solely for the purpose of access to Parcels 1,2,3, and 4. No structures Page 2 shall be constructed or installed on or within the right of way. Any construction on Developer's property shall comply with the set back requirements set forth in the Tukwila Municipal Code. The unopened right of way shall be treated, for the purpose of determining set back requirements, as a public right of way. As a result, setbacks on each property shall be pursuant to the Tukwila Municipal Code and measured from the eastern boundary of the existing 25 foot unopened right of way as described in Attachment A. During the time that the Developer owns the unopened right of way, the Developer will provide the City with access to the unopened right of way for City purposes to through a recorded easement. Maintenance of the unopened right of way shall be 00 the sole responsibility of the Developer. This O responsibility shall attach immediately upon the O execution of this agreement. O 4. No Protest Agreement. co In the event the City seeks dedication and O reconveyance of the unopened right of way as described in O section 3 above, the Developer is obligated to and agrees CD to participate in the funding of future street CD improvements made as part of opening the street to CQ through traffic for Developer's proportionate share of said improvements fronting Developer's property. If an L.I.D. or U.L.I.D. is formed to carry out such improvements, Developer agrees to not contest the formation and waives the right to protest the formation of the L.I.D. or U.L.I.D.. Developer does retain, however, the right to contest the method of calculating assessments and the amount thereof levied against the property. 5. Binding Effect. This Agreement shall be binding upon and inure to the benefit of the parties and their successors, heirs, assigns, and personal representatives. This Agreement runs with the land. The term Developer includes any future owners of the property or portions thereof. 6. Applicable Law. This Agreement shall be Page 3 governed by and construed in accordance with the laws of the State of Washington. Jurisdiction over and venue of any suit arising out of or related to this Agreement shall be exclusively in the state and federal courts of King County, Washington. 7. Attorneys' Fees. In the event that any suit or other proceeding is instituted by either party to this Agreement arising out of or pertaining to this Agreement, including but not limited to filing suit or requesting an arbitration, mediation, or other alternative dispute resolution process (collectively, "Proceedings "), and appeals and collateral actions relative to such a suit or Proceeding, the substantially prevailing party as determined by the court or in the Proceeding shall be OD entitled to recover its reasonable attorneys' fees and CD all costs and expenses incurred relative to such suit or O Proceeding from the substantially nonprevailing party, in © addition to such other relief as may be awarded. 8. Their role is to talk with neighbors and fellow business owners and bring a community perspective to proposed actions. The group is comprised of 2 Planning Commissioners, and 8 others with a combination of backgrounds, both residential and business within the commercial corridor. Components of the Revitalization Plan that affect the physical environment are being presented to the Task Force in order to incorporate their working knowledge of the area's conditions and operations into the review of alternatives. This group will become versed in the findings and conclusions of the technical studies and provide comments and feedback to the administrative staff and the City Council on a regular basis. 99 Action Committee This is a group of predominately business owners and City government representatives who are currently meeting with the assistance of the Southwest King County Chamber. Their focus is on supporting the Community Oriented Policing Program for their commercial business district. They meet twice a month and consistently have 15 -20 business people in attendance. A major effort currently underway is to begin a "block watch" program within the commercial core of the study area but they also organize clean -up and planting projects.. Their role will be to act as a sounding board and information exchange on aspects of the project that impact group members. The estimate provided for the road improvements is now two years old and does not include the cost of the retaining wall. A new estimate, with the retaining wall must be provided. A new assignment of savings or other method to guarantee improvements shall be provided. With this letter a six month extension is granted, provided the following conditions are met: 1. A new estimate of the cost of the roadway improvements, including the retaining wall, shall be provided to DCD by July 3, 1995. 2. A new assignment of savings, or other approved method of guaranteeing improvements will be installed shall be provided to DCD by July 7, 1995, for the revised estimate. To redeem your Assignment of Account, you will need to complete the following: 1) Construct your access drive, per your short plat approval letter from the City (11/30/92). The drive must be an all- weather surface (gravel or paved), capable of supporting a 50,000 ib. fire truck. It must be a minimum of 20 feet wide, and the grade cannot exceed 15 percent. 2) If a retaining wall is needed to meet the above requirements, you will need to complete that as well. At the time your short plat was approved, the City Engineer waived the requirement for a storm drainage plan for your short plat. Therefore, storm drainage for the road does not need to be completed in order to redeem your Assignment of Account. The following comments are provided for our initial review to assist the applicant in his resubmittal: 1. Both existing and proposed topography to be shown on plan (2 -foot contours) along with proposed lowest floor elevations of future single - family structures. Grades of proposed private access road (max. 15 %), private driveways (max. 15 %) and utilities (gravity sewer [min. 2% for side sewers] and storm) are also to be shown. Show existing public drainage system and water courses. Existing public sanitary sewer and water mains to be shown (including elevation at proposed connection point for future side sewers). Identify methods of sewage and drainage disposal on plan. 2. A letter of availability from both water and sewer districts to be provided (Val Vue Sewer District and Water District No. 125). According Subdivision Code 17.24.020, the minimum width requirement for private access roads is 30 feet. For emergency access purposes, the Fire Department will require an all- weather surface a minimum width of 20 feet. PUBLIC WORKS STAFF ACCESS RECOMMENDATION FOR PUBLIC ROAD: CURRENT CONDITIONS: The Thorndike Plat superblock (see attached King County Q.S. Map NE 22 -23 -4) is bounded by 51st, 42nd, S 144th and S 154th Streets. This super block is approximately 2,600 feet by 3,300 feet. There are 10 internal blocks within this super block and all are over 1,300 feet in length. Within the superblock, four east /west internal roads connect to 42nd Ave. S to the west. 46th Ave. S is the only internal north /south street. Terminating at S 150th, 46th Ave. S provides the only north connector within the super block. The property under consideration for short plat is identified in yellow on the attached King County Q.S. Map, (Block 1, Lot 5, Adams Homes Tracts). The block this lot is located in is bounded by S 148th, S 150th, 42nd Ave. S and 46th Ave. S. Block 1 is about 1,314 feet in length by 663 feet in depth. ANALYSIS OF INTERNAL CIRCULATION CONDITIONS: Chapter 17.24 "MINIMUM STANDARDS FOR RESIDENTIAL SUBDIVISION DESIGN, Section 17.24.040, #6 states, "Blocks should not be less than 300 feet nor more than 1,000 feet in length." This block is 1,314 in length exceeding the sub - division criteria. Under a full buildout senerio, assuming 75 buildable lots /block an ADT for the Thorndike plat super block is projected at 7,500 vehicle trips /day. If equally divided by five accesses (4 to 42nd, 1 to 144th), then about 1,500 vehicle trips /access are projected for each street at future full buildout. That's 500 over the 1,000 used as a guide for access "tap" streets. PUBLIC WORKS RECOMMENDATIONS TO SHORT PLAT COMMITTEE: To improve the internal circulation in the Thorndike superblock, an additional north /south internal street between 42nd and 46th be provided. This street can be called 44th Ave. South. 40 feet is the recommended R/W for this future street. The new 44th Ave. S will extend from S 154th to S 144th. Future 44 Ave S Residential Street L.I.D. To break up the superblocks, improve traffic circulation and provide added north /south access to S 144 St and S 154 St, a new residential street between 42 Ave S and 46 Ave S, from S 144 St to S 154 St is needed. This residential street improvement will be in accordance with the City's, Subdivision Code criteria and include right -of -way acquisition, roadway pavement, sidewalks, curbs /gutters, utilities, street lights and under - grounding. Developer acknowledges that the proposed development will have a cumulative impact on the facility systems described above, in the area of Developer's property, and that Developer's property will be specifically benefitted by improvements to such facilities. Page 2 participate in any Local Improvement District (LID) or Utility Local Improvement District (ULID) which is formed for the purpose of creating or improving such facilities and hereby waives the right to protest the formation of any such LID or ULID. 2. Non - Waiver - Extensions Failure of either party to insist on the strict performance of any of the terms of this Agreement shall not be construed as a waiver or relinquishment of that party's right thereafter to strictly enforce any such term, but the same shall continue in full force and effect. 3. Binding Effect This Agreement shall be binding upon the parties, their respective heirs, • legal representatives, assignees, transferees and successors. This Agreement runs with the land. Developer may assign this Agreement without notice to or consent by the City. 4. Recording This Agreement shall be recorded with the King County Department of Records and Elections, and the cost of said recording shall be paid by Developer. 5. Law and Venue Actions brought to enforce any provision of this Agreement shall be governed by Washington law and .shall be brought in Washington State Superior Court for King County. 6. Attorney Fees In the event that either party shall commence litigation against the other in order to enforce any term or condition of this Agreement, the prevailing party in such litigation shall be entitled to recover its costs, including reasonable attorney fees. 7. Effective Date The responsibilities of Developer under this Agreement are contingent upon the issuance of the requested approvals for the project. No obligation will arise until the issuance of such approvals. No geotechnical report required 2. No undergrounding required 3. Bob Noe is writing a new developer's agreement for the access and putting together a vacation for the 25' right -of -way. the developer's agreement will say that the 25' will go back to the City , if it ever decides to put the road through from 148th to 150th. the developer's agreement will assign responsibility for the improvements to parties other than the City. 4. The access road built as part of the short plat must meet Fire Department standards. (Mike, since the road was constructed without benefit of permit or inspection, I am guessing that at a minimum, the FD will have to request compaction testing and proof that the road does not exceed 15 %. If improvements are required, will the road will have to meet current FD standards? ) 5. The setbacks for the SFRs need to be from the possible future right of way line, not from the new property lines which will be created under the street vacation.
