Dear Mr. Whang:
The Short Subdivision Committee has approved your short plat (short
subdivision) application #L92 -0083. The next step is to record the
short plat with King County.
You will need to file the attached original forms with the King
County Department of Records (Room 311, King County Administration
Building, 500 4th Avenue, Seattle, WA, 98104, 296 - 1570). A copy of
the recorded short plat is to be returned to the City of Tukwila
Dept. of Community Development (DCD) . The County will mail to us the
recorded document in approximately 4 -6 weeks, or, you can hand -carry
the recorded plat to us. After we receive the recorded documents,
your short plat is considered complete. Prior to issuance of any
building permits for the lots, a copy of the recorded plat must be
filed with DCD.
Please note that you must file your short plat (with King County and
with Tukwila DCD) by September 12, 1994. If not filed by this
deadline, the short plat will be considered null and void. To renew
the application would require a submittal of a new short plat
application and fees.

continuing development will be the need to provide sewer system improvements
that provide adequate service.
The proposed development property is obligated to participate in funding future
system improvements and the owner waives the right to protest sewer L.I.D. or
U.L.I.D. formation. This agreement runs with the property.
This agreement shall be binding upon the parties, their respective heirs, legal

with the land.
This agreement shall be recorded by the City Clerk with the King County Auditor

The Short Subdivision Committee has reviewed your request for an
exception to the road standards in the Subdivision Code. The Code
requires a 30 -foot wide access easement to serve your proposed lots
(TMC 17.24.030). However, you have proposed a 20 -foot wide access
easement. Based on your proposal, and the exception criteria given
in the Subdivision Code (TMC 17.32.010) , the Committee has approved
your roadway exception request.
The Short Subdivision Committee has also given preliminary approval
to your short plat (subdivision) application,\ with the following
conditions:
1. The 6" sewer main noted in your sewer
availability letter does not meet current City
of Tukwila standards. The cumulative effect
of subdivisions in your area will result in
future supply deficiencies for your property

Attached is a request from Mr. Ik Whang for an exception to the
Subdivision Code's road standards. This is scheduled for a
Subdivision Committee decision at the February 25, 1993 DRC meeting.
Mr. Whang has applied for a short plat at 13509 Military Road South.
For access, he proposes a 20 -foot wide easement, rather than the
30 -foot easement required by the Subdivision Code. The proposed access
easement would serve two lots, and is 111.64 feet long.
Under the Subdivision Code, a "private access road" has a minimum
easement width of 30 feet, is no more than 200 feet long, and serves no
more than four lots (TMC 17.24.030, attached). An exception to these
requirements may be granted by the Short Subdivision Committee in
"hardship" cases (TMC 17.32.010, attached).
Included in this packet for your review is Whang's exception request
and short plat application. He requests an immediate decision on the
road issue so that he can begin any required revisions to his short
plat.

I am hereby requesting the Subdivision Committee to grant
me an exception to the 30 foot easement width for the
following reasons:
#1. A 20 ft easement roadway would be more than
adequate since on Parcel "B” would be using
the easement for access.
#2. The adjoining property to the south has a
15 foot easement adjoining this proposed
20 foot easement making a total of 35 feet
in width.
#3. Records show that the fire hydrant is less
than 250 feet from the proposed new home
on Parcel "B"

easements on the survey; and revise legal descriptions to
include a description of the easement.
4. A maintenance agreement is needed for the commonly used
utilities and access. .Revise easement descriptions, or
include a separate maintenance agreement, to identify how
(or if) the properties will share responsibility for
maintaining common storm drainage, water and sewer
facilities, and common access road. A sample maintenance
agreement is attached.
5. Show on your survey the location and sizes of the water
and sewer mains.

Fire protection /service:
6. Your survey must show the location of the nearest fire
hydrant. To ensure adequate fire protection of future
structures, you will need to do the following:

The items listed above must be completed within six months from the
date of this letter. If not completed, the current application
will expire and a new application would be required.
In order to forward your application to the Short Subdivision
.Committee. for final approval, you must complete the following
conditions:
1) complete the items listed in this letter; and
2) install any required site improvements which
have yet to be constructed (e.g. .roads,
utilities). Alternatively, you may provide
assurances for future construction of these
improvements by signing the attached
Agreement(s) with the City, or through posting
of a bond for 150% of the construction cost.
When these conditions have been met, your application will be
forwarded to the Short Subdivision Committee. Review by the
Committee requires approximately one week. After the Committee
decision, you will need to submit the approved application to the
King County Department of Records for recording. The County will
notify us within approximately 4 -6 weeks of the recording number,
at which time the short subdivision is considered complete. You
can shorten this processing time, by hand - carrying your recording
number to DCD.

COMMITMENT CONDITIONS AND STIPULATIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting
the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and
shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any loss or
damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such know-
ledge. If the proposed insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule
