This is an addendum to page three of the real estate contract **
between Russell Snider, seller, and Robert Rigdon, buyer, dated May
28, 1987 and concerning the property in King County, Washington,
described as follows: •�
The east 100 feet of Lots 11 and 12 in Block 7 of Hilimants
Garden Tracts, as per plat recorded in Volume II of plats,
Page 24, records of King County, Washington.
The addendum is as follows:
It is agreed that the purchaser shall make a balloon payment
over and above the monthly payment, in the amount of three
thousand dollars and no /100 - -- ($3,000.00) on or before
June 15, 1991, which is to be applied to the principal
balance.
The monthly payment shall remain the same ($561.92 or more)
after the balloon payment is made.
This addendum nullifies and replaces that portion of the agreement
which requires a $5,000.00 balloon payment.

APPLICATION SUBMITTAL In order to ensure that your application is accepted for plan review, please make sure to fill out the
application completely and follow the plan submittal checklist on the reverse side of this form. Handouts are available at
the Building counter which provide more detailed information on application and plan submittal requirements.
Application and plans must be complete in order to be accepted for plan review.
VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of
Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting
application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is
subject to possible revision by the Building Division to comply with current fee schedules.
BUILDING OWNER / AUTHORIZED AGENT If the applicant is other than the owner, registered architect/engineer, or contractor
licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this
permit application and obtain the permit will be required as part of this submittal.
EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall
expire by limitations. The building official may extend the time for action by the applicant for a period not exceeding 180
days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition).
No application shall be extended more than once.

Dear Mr. Rigdon:
The Department of Community Development (DCD) is reviewing your
Building Permit Application for the above project. However, we
cannot complete our review due to the fact that the addition does
not meet the following requirements:
1) the requirements of the Tukwila Sensitive Areas
Ordinance; and
2) the Zoning Code setback requirements.
I would like to clarify what these requirements are, and the status
of your application.
1) Sensitive Areas Ordinance:
According to the city's sensitive areas maps, the above
property contains steep slopes (slopes greater than 15 %).
Consequently, the property is affected by the Sensitive
Areas Ordinance (SAO).
A requirement of the SAO is that an Environmental Checklist
be completed by all permit applicants affected by the SAO.
Therefore, in order for us to complete review of your
building permit application, you must complete and submit
an Environmental Checklist. The Checklist should identify
what effect (if any) your project will have on the hillside,
slope stability, existing vegetation, drainage, etc.
An Environmental Checklist is enclosed. Please note that
the required submittal fee is $225.00. This Checklist and
fee is currently required by the SAO for any property which
has steep slopes, regardless of the size of the
construction project.

However, this requirement is being reviewed by the City
Council for possible revision, and may be eliminated for
single - family residential projects. If you would like to
proceed with your Building Permit Application, you may
submit the required Checklist and fee. If you prefer to
postpone your application until the Council decides on a
possible revision to the SAO, please let me know.
The second concern regarding your permit is that the addition does
not meet the required building setbacks.
2) a) Side (north) setback requirement:
Our maps (see attached) indicate that your property
consists of the eastern half of Lot 11 and the eastern half
of Lot 12. Our maps also show that the property line at
the north edge of your house (dividing Lots 12 and 11)
still exists. Your proposed deck would be built over this
property line.
Although the eastern halves of Lots 12 and 11 may be under
the same ownership, code does not allow structures to be
built over property lines. Consequently, the deck cannot
be located where proposed.
One way to resolve this would be to obtain a Lot
Consolidation, which would remove the eastern one -half of
the property line. A Lot Consolidation application is
��. enc osed. Please note that there is an application fee of
and a processing time of approximately 30 days.

I) b) Front (58th Avenue) setback requirement:
Under the Zoning Code, existing non - conforming houses do
not need to be altered to meet setbacks; however, any new
structures or additions must meet the current setback
requirement. The setback requirement for corner lots such
as yours is 30 feet from the front street and 15 feet from
the side street. For your lot, 58th Avenue is considered
the front street. Therefore, the required setback for your
deck along 58th Avenue South is thirty feet.
The plans submitted for your deck show a setback of only 22
feet along 58th Avenue. In order to meet code
requirements, the deck will have to be set back an
additional eight feet.
Therefore, you will need to submit revised plans showing
the new location of the deck.
