This will confirm your telephone discussion with Mr. Ryan Daugherty of CH2M HILL on
May 7, 1992 regarding the future possibility of relocating alum production and sulfuric acid
distribution facilities from Rhone - Poulenc, Inc. property at the Port of Tacoma to a portion
of Rhone - Poulenc, Inc. property on East Marginal Way in Tukwila.
The Port of Tacoma site is currently in the process of being taken over by WASHDOT for
construction of a new highway, thus a new site for plant operations will have to be found.
The Tukwila plant is presently being demolished in preparation for an apparently lengthy
period for remediation of soils prior to sale of the property. These factors lead Rhone -
Poulenc, Inc. to the possibility that the Tacoma facilities might be relocated to the Tukwila
plant site, and remain in operation during site remediation. Rhone- Poulenc, Inc. wishes to
assure the City of Tukwila that:
1. A final decision on this course of action has not yet been made by Rhone -
Poulenc, Inc.

2. If Rhone- Poulenc, Inc. does decide to pursue this course of action, we will do
so pursuant to the rules, regulations, and permitting requirements of all
appropriate agencies including the City of Tukwila, State of Washington
Department of Ecology, and the Environmental Protection Agency.
Although it was not discussed in your conversation with Mr. Daugherty, we would also
advise you that Rhone- Poulenc, Inc. may also seek to obtain some economic benefit from the
site at Tukwila by leasing all or portions of the land to others for other use during the
course of or after remediation. Please be assured that should this be the case, Rhone -
Poulenc, Inc. will do so through the appropriate agencies as described in 2. above.
At present Rhone - Poulenc, Inc. is underway with demolition of certain above- ground
structures at the Tukwila site in accordance with demolition plans and permits issued by the
City of Tukwila. In order to accommodate the possibility of relocating the Tacoma facilities
to the Tukwila plant site, we are amending our plans for demolition as follows:
1. We are returning the demolition permit for the Compressor Building herewith
for cancellation. This relatively new metal building will remain in place,
although the compressors and associated process equipment and piping will be
removed via the overhead doors. Roof drainage will remain as originally
designed. Rhone - Poulenc does not seek reimbursement of fees for this permit.
2. We will maintain the process drainage system in the area between the existing
Laboratory Building and the former Vanillin Building in operation. This
system was to be taken out of service by plugging the drains. It should be
noted that all drainage from this area, as with the entire plant, is directed to
Metro after testing. This will continue to be the case.
3. We will defer removal of all railroad spurs into the plant. All railroad spurs
into the plant were to be removed according to the demolition plan. It should
be noted that the railroad spurs may also be useful in aiding the remediation of
soils onsite, as well as the possible production from facilities formerly located
at the Port of Tacoma.
It is our understanding, from your discussions with Mr. Daugherty, that the City of Tukwila
takes no issue with these three amendments and we will proceed on this basis.

application completely and follow the plan submittal checklist on the reverse side of this form. Handouts are available at
the Building counter which provide more detailed information on application and plan submittal requirements.
Application and plans must be complete in order to be accepted for plan review.
VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of
Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting
application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is
subject to possible revision by the Building Division to comply with current fee schedules.
BUILDING OWNER / AUTHORIZED AGENT if the applicant is other than the owner, registered architecVengineer, or contractor
licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this
permit application and obtain the permit will be required as part of this submittal.
EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall
expire by limitations. The building official may extend the time for action by the applicant for a period not exceeding 180
days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition).
No application shall be extended more than once.

All site plans shall be provided in one submittal for review by the
Public Works Department. Six (6) sets of plans stamped by a
licensed engineer are required along with this application
completed and signed by the applicant's representative.
The following information is necessary for Public Works
Department evaluation and approval of site plans:

Subject: Demolition Permits for Rhone - Poulenc, Inc. Seattle Plant

Dear Mr. Griffin:
In response to your discussions with Mr, Ryan Daugherty, CH2M HILL, Inc. we are providing
the following confirmations:
1. Rhone- Poulenc, Inc. wishes to withdrawal two applications for demolition permits for
the following structures at its Seattle Plant:
a. Distribution Center (D.C.) Warehouse
b. Change Building
Along with the Administration Building and the Laboratory Building, Rhone- Poulenc,
Inc. plans to leave these facilities intact to support future cleanup operations at the plant.
In keeping with our applications, Rhone- Poulenc, Inc. does wish to pursue demolition
permits for the remainder of the building structures on the plant site.
2. As stated in your discussions with Mr. Daugherty, the storm drainage outfall to the
Duwamish River is no longer in use. Storm drainage from the plant is now collected,
tested, and diverted to Metro. We are attaching a copy of the approval letter from Metro,
dated August 26, 1991. This letter confirms Metro's knowledge and approval of the
collection, testing, discharge procedures being followed by the plant for sanitary and
wastewater discharges from the plant.
3. In regard to your concern about the protection of backfill in pits, Rhone - Poulenc, Inc.
plans to have the contractor protect such areas that are exposed to rainfall during the

period between placement of fill and placement of the final cover material.
4. Rhone- Poulenc has reviewed the letter from the Washington State Department of
Ecology (a copy is attached) and will comply with the three conditions stated therein for
demolition, i.e.,
a. Site drainage will continue to be diverted to Metro unless other provisions are
made by or approved by the Environmental Protection Agency in compliance with
the forthcoming consent decree or a change in policy by Metro.
b. All due care will be taken by the contractor to avoid disruption of site paving,
slabs, ground cover, soils, and groundwater.
c. All appropriate precautions will be taken to monitor and prevent the dispersion
of dust and airborne particulate matter. The plant fire water system will remain
operational and will be used if necessary to prevent the dispersion of dust.
Our schedule for demolition, pending issuance of the final demolition permits, is to commence
demolition work on Monday, March 9, 1992 and to 'complete all work by June 1, 1992.
We appreciate the care and concern shown by the City of Tukwila during the development and
review of the demolition permits for the Seattle Plant and look forward to working with the City
staff during the course of soils and groundwater cleanup at this site.

Dear Mr. Ferguson:
Thank you for your letter requesting changes to wastewater
sampling and reporting procedures. You propose to collect
and analyze samples of wastewater batches since at this
stage of plant closure wastewater is being collected and
released on a batch basis. In additions you propose to
collect daily samples of sanitary waste being discharged
from the plant to ensure this waste stream is not being
contaminated with residual copper.
I approve your request to change wastewater sampling and
reporting procedures. Effective September 1, 1991, Rhone -
Poulenc will conduct their wastewater monitoring in the
following manner:
Batch Release
o Prior to any discharge from an industrial wastewater
collection tank, the contents will be sampled and
analyzed for copper, FOG and pH to ensure they meet
discharge limits.
o During discharge to Metro a grab sample shall be
collected prior to the Metro Sump and analyzed for
copper, FOG and pH.
Sanitary Discharge
o A grab sample shall be taken daily from the Metro Sump
and analyzed for pH.
o Daily samples also shall be used to make a monthly
composite'to be analyzed for copper. A portion of each
daily sample shall be retained for analysis if the
copper content of the composite sample exceeds 3.0 ppm.

Dear Mr. Griffin:
Thank you for your consideration in involving the Department of Ecology
(Ecology) is assessing potential impacts of building demolition at the
Rhone Poulenc site on historic site contamination.
Ms. Martha Turvey (Elliott Bay Action Team) and I have reviewed plans
and available information. We feel the demolition of above -grade
structures at the site can proceed without adversely affecting
contamination at the site under the following conditions.
1. All surface drainage at the site continues to be discharged
to the METRO Sanitary Sewer System;
2. Demolition activities do not disturb the integrity of paving
and /or building floor slabs, and underlying soils (including
soil and groundwater hydraulic/hydro logic conditions); and
3. All airborne emissions, e.g., dust fumes, mists, vapors, be
monitored and controlled as necessary.
Although this may not be the appropriate time to address this issue, we
would seek to encourage or advise that a full remedial investigation to
determine site status under the Model Toxics Control Act (MTCA) (Chapter
70.105D RCW), and MTCA regulations (Chapter 173 -340 WAC) be completed by
Rhone Poulenc within the year. Such an assessment would not be
guaranteed by the Hazardous Waste action being taken by Tom Post of
E.P.A., as different standards apply. A condition of the local permit
requiring substantive compliance with MTCA Remedial Investigation (R.I.)
requirements at the site, to include reporting such R.I, results to the
City and to Ecology has been used successfully in the past to accomplish
that end. A time limit, usually 9 - 12 months, is often appropriate to
such a condition.

Dear Mr. Daugherty:
On September 26, 1991, a special meeting of the Tukwila
Development Review Committee was held to discuss the permit
applications referenced above, and other associated
information and concerns. The following comments are the
results of that meeting:
1. The Fire Marshal commented that he had specifically
stated at the pre- application meeting, attended by yourself
and other representative of Rhone Poulenc, that the Fire
Department would require a plant closure plan as part of the
permit application. So far it has not been received. The
Fire Department will not be able to complete their part of
the plan check process without this issue being resolved.
2. Everyone at the meeting indicated concern about possible
soil contamination and related environmental issues on this
site because of its past use. The Planning Division
representative produced a letter from the Department of
Ecology, dated September 16, 1991, which contains DOE's
comments on the Environmental Checklist submitted on this
project. A copy of the DOE letter is attached. It was
agreed by everyone present that a review of the permit
application package by DOE, and written concurrence by that
agency, shall be required from Rhone - Poulenc before any
further review action is accomplished by the city.
3. To answer the question about leaving concrete
foundations, slabs, drainage systems, and other portions of
infra- structure in the ground, the following information
applies:
a. DOE concurrence with this plan must be obtained by
Rhone- Poulenc and presented to the city as part of the
application package before the plans can go any further in
the plan check process.
b. If DOE concurrence is obtained, it has been
determined that, based on the contents of your above
referenced letter, the intent of Section 16.04.150 of the
Tukwila Municipal Code would be met by the plans you have
submitted; and TMC Sec. 16.04.150 will not apply to this
project. This is not, however, meant to infer that the City
has approved the project. Any other issues that may come up
during the plan check process will have to be resolved with
individual departments of the city.
4. It is suggested that you contact the Tukwila Planning
Division regarding the subject of "Interim Use of the
Facilities ", discussed in paragraph 2 of your above
referenced letter. I briefly discussed this subject with
Darren Wilson of the Planning Division and he stated that
both Zoning and Shorelines regulations could establish
restrictions on the type of "storage" allowed on certain
portions of this property.

Thank you for the opportunity to comment on the determination of
nonsignificance for phase two to demolish a closed industrial plant that
formerly produced vanillin proposed by Rhone - Poulenc Inc. (EPIC- 35 -91). We
reviewed the environmental checklist and have the following comments.
1. As with phase one, the applicant proposes to demolish an existing
facility. Item B.7.a of the checklist asks if there are any
environmental health hazards that could occur as a result of the
proposal. Improper disposal of solid waste, including demolition waste,
can result in environmental health hazards. The applicant should
identify the disposal site for the demolition material. In addition,
the applicant should be encouraged to pursue mitigating activities such
as salvage, reuse, and recycling of the demolition materials.
.. 2. Storm drains should be checked for contamination and /or cleaned prior to
use, following plant demolition (based on information that building
floor drains are connected to the storm drainage system, Water 3.c.1) to
avoid flushing of residual chemicals by rainwater.
3. Further investigations regarding the nature and extent of soil,
groundwater, and surface water associated with the site•may be required
by the Department, under authority of the Model Toxics Control Act.
Further cleanup may also be required at the sites.

In response to your telephone request for more information on the
rationale for demolishing only "superstructure" of the plant and
for leaving the slabs, surface paving, and underground utilities
in place, we offer the following discussion:
1. BUILDINGS TO REMAIN IN SERVICE
The prospective buyers and real estate consultants advise us
that due to their economic value at least two buildings are to
remain in place and operating:
o Laboratory Building
o Administration Building
The final agreement may require that other buildings be left
in place and operating. The Demolition Plan Addendum Number
1 have prioritized the sequence of demolition to provide that
those buildings which would have the greater apparent
usefulness to the prospective buyer would be demolished later
in the demolition process.

The plant utilities, e.g. sanitary sewer, water distribution,
storm drainage, gas, telephone, etc. are interconnected and
complex, the removal of foundations and underground utilities
would eliminate utilities to buildings that are to remain in
place and operational. The utility connections to buildings
that have been demolished or are not designated for future use
will be grouted in place.
2. INTERIM USE OF FACILITIES
The property remains under the ownership and custody of Rhone -
Poulenc until the agreement to sell is completed and the new
owner takes custody. Should the negotiations with the current
prospective buyers fail or be substantially delayed, Rhone -
Poulenc will seek alternative interim uses for the property.
Among the possible uses are storage or operations for
construction contractors, light manufacturing, etc. Rhone -
Poulenc has indicated that they do not intend to return the
property to vanillin processing, the previous use, however they
would seek other uses. Certain of the buildings, particularly
the D.C. Warehouse and the Maintenance Buildings lend
themselves to other uses, as do the Laboratory Building, the
Administration Building, and the Change Room Building. Other
buildings that were used strictly for vanillin production,
would probably have little value and would be demolished. The
slabs of these buildings, however could be a valuable asset
as paved storage areas. The foundations and floor slabs of
these buildings have been designed by licensed structural
engineers or qualified engineers for the original owners.
Quite evidently, the structural integrity of these foundations
is still very much intact since the facility was in operation
until March, 1991. These foundations and slabs would be used
as "hardstand" for storage which is compatible with their
designed use to support industrial facilities.
As noted before, the utilities to buildings that would remain
under such an alternative are an integral part of the plant
utility system. To remove the foundations and underground
infrastructure would eliminate utilities to the remaining
facilities and have a significant impact on the use of the
property.

3. SITE DRAINAGE
The removal of slabs and paving will disrupt the current
surface drainage in an area that is relatively flat and that
has a high water table. The existing storm drainage system is
highly effective and is operated under the plant NPDES permit.
The system includes a series of laterals which collect storm
drainage from surface structures, catch basins, inlets, etc.
and conduct it to a diversion structure, which, in the event
of spills, can divert the drainage to the sanitary sewer.
Normal drainage from the diversion structure discharges to the
outfall on the Duwamish River, through a pH sensor, which, if
the pH is out of allowable range, automatically shuts down the
outfall line and diverts the drainage to the sanitary sewer.
This system will be used to effectively manage storm water
until the property is sold and the new owner develops plans for
the property, obtains permits, and modifies (if necessary) the
existing system. It is anticipated that this existing system
will be used either in part or in it's entirety by the new
owner.
Removal of underground utilities and foundations would
necessitate the removal of the storm drainage system resulting
in adverse environmental impact in the form of overland storm
runoff laden with sediment. Removal would also necessitate the
design, permitting, installation, and operation of an interim
storm water drainage system that is not likely to be as
effective as the existing system. The interim system will
then have to be replaced with a permanent system that is
designed to satisfy the new owner's use of the property.
The potential environmental impacts of the repeated disruption
of the surface drainage system suggest that the current system,
which operates with a high degree of efficiency, be maintained
as is. The costs, both environmental and economic, of removing
the underground utilities are simply too high.

4. FIRE PROTECTION
The fire protection system which serves the plant also serves
the buildings that are to remain in place for the prospective
buyer, as well as the buildings that would remain in place for
interim use should the sale be delayed. Removal of plant
utilities and foundations would require the removal of this
system.
Ordinance 16.04.150 Debris and excavations, requires
interpretation, but works as exhibited by its provisions which
allow certain improvements to remain in place. Rhone - Poulenc has
taken extra measures to provide the City with a clear understanding
of our intentions and plans in the demolition of the plant and the
sale of the property. In applying for demolition permits, Rhone -
Poulenc recognizes that it is asking the city to issue permits for
demolition of the above - ground portions of the designated buildings
only. These permits should be clearly marked to indicate this
fact, so that the intent of Rhone - Poulenc and the permit is clear
to those who follow these proceedings.

All work performed by RPI forces or contractor forces will
be accomplished under RPI SAFETY AND CONDUCT GUIDELINES FOR
CONTRACTORS. Contractors will be responsible for performing
their work in compliance with OSHA /WISHA, and all other
rules, regulations and requirements governing safety,
convenience and the performance of the work. All work shall
be in compliance with the regulations, ordinances and
requirements of the permits issued by the agencies having
jurisdiction of the site and the work.

SAFETY AND HEALTH

Owner agrees that, during the performance of the Work, where employees of
Contractor and /or employees of subcontractors of Contractor are working on the
Construction Site in an area required by Occupational Safety and Health Act
Regulations, to be designated as a "Regulated Area" or other similarly intended
designation where special controls and /or monitoring are required because of the
presence or potential presence of certain chemicals or conditions therein, if
requested by Contractor and agreed to by Owner, it will, as agent for Contractor,
(1) provide said employees with respirators; (2) undertake necessary monitoring
of said employees and area, (3) provide the required training for said employees
in applicable hazards, and (4) supply information and data to Contractor for
maintaining appropriate records; all as required by said Regulations and all at
Owner's expense. However, it is understood that Contractor will provide or cause
to be provided medical surveillance and any other service or equipment as
required by Occupational Safety and Health Act Regulations, for said employees
during the performance of the Work in said area.
The above undertaking by Owner in no way constitutes the transfer to, or
assumption by Owner of, any of Contractor's or its subcontractor's duties and
obligations under Federal, State or local laws or regulations, including by not
limited to the above described regulations; no liability to Contractor, any of
its employees or other person, firm or corporation will thereby be assumed by
Owner; and Contractor agrees to save Owner harmless, to the extent valid and
enforceable under applicable law, from any and all liability, penalties and
claims of whatever kind, including, but not limited to claims of Contractor or
any of its employees, agents, vendors or subcontractors, or of governmental
agencies, based on Owner's failure or alleged failure to comply with any Federal,
State or local law or regulation, or based on any act or omission of Owner, its
employees or agents, in performing any of the above services.
Contractor shall take all necessary precautions to protect employees of
Contractor, employees of its subcontractor and employees and facilities of Owner
from hazards arising in the course of the performance of this Contract or in
connection with Owner's operations or chemicals located at or adjacent to the
Construction Site.
Contractor shall comply with, and shall cause its employees and all
subcontractors to comply with (1) all Rhone - Poulenc Safety and Health Regulations
and Requirements which are furnished to Contractor by Owner and (2) all
applicable laws and governmental rules and regulations relating to health and /or
safety. In the event that Contractor fails to so comply or to cause such
compliance, Rhone - Poulenc may suspend all or any part of the Work on which
Contractor or his subcontractor is engaged, until Contractor proves to Owner's
satisfaction that Contractor has corrected said failure. Contractor shall not
be entitled to any extension of time or compensation or damages by reason of, or
in connection with, such work stoppage.

Contractor shall review all safety and health regulations and requirements which
it is obligated to comply with hereunder and any applicable hazards which it is
obligated to protect against hereunder, prior to the performance of the portion
of the Work which is applicable thereto. Contractor shall notify Owner how said
regulations, requirements and hazards will be communicated to, and enforced with,
its employees and all subcontractors.
Contractor shall include in all of its subcontracts involved in the performance
of the Work at the Construction Site, the provisions of the Appendix, with
subcontractor being obligated to Contractor to the same extent as Contractor is
obligated to Owner. However, such provisions in the subcontracts shall not
relieve the Contractor of its obligation to assure compliance with the provisions
of this Appendix for all aspects of the Work.
Rhone - Poulenc Safety and Health Regulations and Requirements include the
following and may include others which are unique to a particular Rhone - Poulenc
location. Where Contractor believes any Safety or Health Regulation or
Requirement is not applicable, a written variance (per Plant Procedure) to
deviate there from must be received from Owner's management representative at the
location of the Work, prior to initiating the Work.
1. Location Work Permits
Work permits shall be obtained by the Contractor, and signed by an
authorized Rhone- Poulenc supervisor to confirm his acceptance of
precautions specified for the following operations:
a. Use of ignition sources in restricted areas.
b. Entering of vessels or confined spaces.
c. Opening process equipment.
d. Performing electrical hot work.
e. Making excavations and trenches.
f. Moving radioactive sources.
g. Performing pipe . "hot tapping ".
h. Operating heavy equipment around electrical power lines.
2. Master Card Procedure
The Master Card Procedure for tagging and locking critical equipment
isolation points shall be followed by the Contractor prior to commencement
of work on such equipment.

3. Location Safety and Health Rules
All location safety and health rules.' furnished by Owner to Contractor
shall be adhered to by the Contractor.
•1. Personnel Protection Equipment
Personnel protective equipment shall be provided by the Contractor as
follows:
a. Hard hats and industrial grade safety glasses with permanently
attached side shields and safety shoes shall be worn at all times.
b. Chemical splash goggles and hearing protection shall be worn in
posted areas.
c.
Respiratory protection, harnesses and lifelines, and other necessary
protective equipment will be worn based on location regulations and
OSHA requirements and furnished by Contractor as needed.
d. Respirators shall fit snugly against the face. Persons wearing
beards shall be clean shaven where respirator makes a facial seal.
5. Caution Regarding Asbestos - Containing Materials
Should Contractor encounter any type of insulation or other product that
they suspect may contain asbestos during assignments, cease work
immediately. Notify the responsible plant supervisor in order to obtain
accurate identification of the material including sample analysis, if
necessary. Some typical questionable areas (but not limited to) include
cable insulations, pipe coverings, ceiling tiles, wallboard, blown -in
insulation,.boiler/powerhouse block insulations and drilling or cutting
through transite. Unless absolutely sure that a material is asbestos -
free, notify plant representative you're working with and cease work
activity until all questions are resolved.
6. Emergencies
Contractors shall be trained in those emergency procedures which directly
affect their own employees' personal safety and health. In the event of
an emergency (fire, explosion, vapor cloud, spillage, or related hazards)
arising in the immediate vicinity, Contractor agrees that it shall cause
its employees to leave the area immediately and remain at a safe distance
until the emergency is over.
7. Safe Tools
Scaffolds, stages, rigging equipment, electrical tools, ladders, hoists,
and other tools, machinery or equipment used in the Work shall meet
specifications of .'ANSI and the Occupational Safety and Health
Administration for such items employed in the Construction industry.

8. Accidents

The Contractor will be responsible.. for investigating all accidents
involving its employees and reporting all details to Owner's safety
representative at the location of the Work. When such accident
investigation is complete, the contractor will provide such Rhone - Poulenc
representative with a copy of the completed injury report. The Contractor
is also responsible for compliance with the Occupational Safety and Health
Administration requirements for reporting or communicating injuries.
9. Safety and Health Program
Contractor shall maintain its own safety and health programs. However, it
may be necessary at times for the Rhone - Poulenc representative to make
recommendations to assure protection of Rhone- Poulenc employees.
10. Contractor shall review with all of its employees assigned to the Work,
prior to their commencing any of the Work, all safety and health
regulations, requirements and programs applicable to the Work, and.
Contractor shall cause its subcontractors to make such a review with their
