Partnership TUKWILA CITY COUNCIL Regular Meeting M I N U T E S Tukwila City Hall Council Chambers Mayor Van Dusen called the Regular Meeting of the Tukwila City Council to order and led the audience in the Pledge of Allegiance. EDGAR D. BAUCH; JOE H. DUFFIE, Council President; WENDY A. MORGAN; CHARLES E. SIMPSON; MARILYN STOKNES; JAMES J. MCKENNA. MOVED BY BAUCH, SECONDED BY DUFFIE, THAT THE AGENDA BE AMENDED TO INCLUDE A PUBLIC UTILITIES BUDGET TRANSFER UNDER MISCELLANEOUS. MOTION CARRIED. Council President Duffie announced that Council would tour the Valley Com. facility at the close of the meeting. Councilman McKenna commented he and his family attended the Parks and Recreation Halloween Party. He has received input from citizens that it is one of the best things the City does for the children, along with the Easter Egg Hunt. Mayor Van Dusen announced that he has been asked to serve a second term on the Economic Development Committee. a. Approval of Minutes: October 20, 1986 b. An ordinance of the City of Tukwila adding a new Chapter 2.33 to the TMC to create a Library Advisory Board, prescribing the terms of office, and setting forth the duties and powers of said board. MOVED BY DUFFIE, SECONDED BY BAUCH, THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED. Resolution #1021- MOVED BY SIMPSON, SECONDED BY DUFFIE, THAT THE PROPOSED Accepting the donation RESOLUTION BE READ BY TITLE ONLY.* of certain real Attorney Haney said that the Resolution accepts the property with the idea that it may remain as open space or the City may use it for some other purpose. Council President Duffie asked if there has ever been a slide in this area. Mr. Sandler, property owner, said there has never been a slide and there has been no change in the topography since 1978. NEW BUSINESS Resolution #1022 Approving an agree- ment with other law enforcement agencies regulating the admini- stration and use of the King Co. Drug Enforcement Fund MISCELLANEOUS Budget Transfer #86 -05 State Highway 405 HOV project Attorney Haney said that if the City actually builds on the property and thereby causes a problem, the owner is released from their obligation to indemnify. Once the City starts improving it, then the City has to take the responsibility. Council Member Morgan asked if the City undertakes drainage improvements, does that alter the agreement. Attorney Haney said yes, because that would alter the natural course of the drainage on the property and that could make a difference in the property's stability. *MOTION CARRIED. City Attorney Haney read a resolution of the City of Tukwila, Washington, accepting the donation of certain real property to the City by D.T. C. Partnership and authorizing the Mayor to execute an agreement and covenant with respect to said donation. MOVED BY SIMPSON, SECONDED BY DUFFIE, THAT RESOLUTION NO. 1021 BE ADOPTED AS READ. MOTION CARRIED WITH MORGAN VOTING NO. MOTION CARRIED. ments in the Current Fund City Attorney Haney read an ordinance of the City of Tukwila, Washington, amending the 1986 Budget adopted by Ordinance No. 1375 of the City, passed by the Tukwila City Council on December 16, 1985, re- adopted per Ordinance No. 1377 on January 13, 1986, and amended by Ordinance No. 1391 on May 19, 1986, to appropriate unanticipated sales tax and grant revenues; and to provide lighting improvements in the Current Fund, and establishing an effective date. MOVED BY SIMPSON, SECONDED BY MCKENNA, THAT ORDINANCE NO. 1406 BE ADOPTED AS READ. (Including the amendment offered by the City Attorney.) MOTION CARRIED. MOVED BY MORGAN, SECONDED BY SIMPSON, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Haney read a resolution of the City Council of the City of Tukwila, Washington, approving an agreement be- tween the City of Tukwila and other law enforcement agencies located within King County regulating the administration and use of the King County Drug Enforcement Fund and authorizing the Mayor to execute such agreement on behalf of the City. MOVED BY MORGAN, SECONDED BY SIMPSON, THAT RESOLUTION NO. 1022 BE ADOPTED AS READ. MOTION CARRIED. Council Member Bauch introduced a Budget transfer in the amount of $8,000 to pay the City's share of the West Valley Highway Water Main project being completed by the State Department of Transportation in 1986. MOVED BY BAUCH, SECONDED BY DUFFIE, THAT COUNCIL AUTHORIZE THE TRANSFER OF FUNDS BY BUDGET TRANSFER NO. 86-05 IN THE AMOUNT OF $8,000. MOTION CARRIED. MOTION CARRIED. 8:00 p.m. MOVED BY SIMPSON, SECONDED BY DUFFIE, THAT THE EXECUTIVE SESSION BE CLOSED. MOTION CARRIED. ADJOURNMENT 8:30 p.m. Executive Session called to discuss Labor Negotiations and the Valley View Estates Appeal. Councilman McKenna will be excused from the discussion on the Valley View Estates Appeal as he was a member of the BAR when the Valley View Estates was approved. It is the BAR decision that is being appealed to the City Council, so it is not fair to have him sit in on an appeal in which he participated in the decision.
