Tax Parcel No. 334740 -1120 Lot 3 & 4 Side Sewer Easement Agreement Page 1 of 6 EXCISE TAX NOT REQUIRED Kin. - ..., Division BY DePutY 20071219001135.001 • • SIDE SEWER EASEMENT AGREEMENT THIS EASEMENT AGREEMENT is made and entered into by and between the undersigned, Palwinder Multani and Balwinder Kaur, owners ("Grantor" herein) in fee simple of the land described in the attached Exhibit A and commonly known as Lot 4 of Tukwila Short Plat Number L06 -004, and Palwinder Multani and Balwinder Kaur, owners ( "Grantee" herein) in fee simple of the land described in the attached Exhibit B and commonly known as Lot 3 of Tukwila Short Plat Number L06 -004. For and in consideration of the mutual covenants and agreements hereinafter expressed and other good and valuable consideration, in hand paid, receipt of which is hereby acknowledged, the parties hereto agree as follows: Grantor hereby defines, declares, grants and conveys to Grantee, their heirs, successors and assigns, a non - exclusive perpetual Side Sewer Easement over, across, along, in, upon and under that portion of said Grantors land described as follows: The south 5.00 feet of the east 114.00 feet of the west .132.00 feet of Lot 25, Block 5, C.D. Hillman's Meadow Gardens Addition to the City of Seattle, Division No.1, according to the plat thereof, recorded in Volume 12 of Plats, Page 64, in King County, Washington; TOGETHER WITH the south 18.00 feet of the west 18.00 feet of said Lot 25. 1. This easement is for the sole purpose of the construction, use, and maintenance of a sanitary side sewer pipeline, together with the right of ingress and egress for such purposes. 2. Maintenance costs of the side sewer constructed within said easement shall be the sole responsibility of Grantee, except the maintenance costs of any portion of the side sewer that is jointly used by both Grantor and Grantee will be shared equally by such parties. 3. During the initial construction and in the event of repair or maintenance, all affected landscaping and other improvements shall be substantially returned to their condition existing prior to any construction, repair or maintenance of said sanitary sewer facilities. If no landscaping or improvements exist at the time of installation or repair, all disturbs soils shall be seeded with native grasses to prevent erosion. 4. Any condition of said side sewer which may permit water or odors to escape therefrom to the surface shall be immediately repaired. 5. Grantor also grants a temporary 10' wide easement along and adjoining said side sewer easement for the initial construction of the side sewer line. Said temporary easement shall be null and void after installation of the side sewer line. 6. At the time of construction of Grantee's side sewer stub within the herein easement, Grantee shall also install a side sewer stub for use by Grantor at a mutual agreed location. 7. The herein easement and covenants may be amended only upon the written agreement of the Grantor and Grantee herein and shall be binding on all parties having or acquiring any right, title, or interest in the land described herein or any part thereof.
