In the absence of Mayor Van Dusen, Joe Duffie, Council
President, called the Regular Meeting of the Tukwila City
Council to order. He led the audience in the Pledge of
Allegiance.

Don Morrison, City Administrator, invited everyone to take
time to see the latest purchase by the Arts Commission. It
is a Native American Mural installed on the wall at the
entrance to the Police Department. There will be an official
"unveiling" ceremony at a later date.
He reported that last Wednesday the Department Heads spon-
sored a Pancake Breakfast for the employees. The Mayor, City
Administrator, and Department Heads fund the event. There
was a good turn out and everyone seemed to enjoy it.
It was decided the Council Retreat would be held on a Tuesday
or Wednesday in January.
Mr. Al Reslock, owner, of the east half of Lot 27, Block 15
Hillman Seattle Garden Tracts, asked if there are any provi-
sions to extend the retaining wall on the bottom end of 58th
Ave. So. (along the north side of the street prior to the
street meeting Interurban Ave.) In 1984, he asked the City
to review his problem and has never gotten an answer. There
are three problems: (1) Continual sliding; (2) Drainage; (3)
Safety. When the City upgraded the street, they put in a
retaining wall of stone, but stopped prior to his property.
they left a 20 foot, straight up and down drop -off at the
edge of his property. Before they finished the project, they
removed the vegetation and trimmed his bank without a permit.
Now, something needs to be done about this; it is unsightly.
The City cleans up the rocks that fall on the sidewalk. They
send a backhoe down once in awhile to work the bottom of the
bank and this doesn't help the slides. When we have a slide,
the City just hauls the dirt away; they don't replace
anything. There is only about 10 feet between the house and
the top of the drop -off. If the topsoil goes, the City will
have a bigger problem. We used to be able to walk to the
mail box; we don't anymore; it is too steep. I have to use a
safety belt and a rope when I maintain the bank. This is the
City's responsibility if someone falls here. You owe it to
yourself and to me to do something about this. Since you are
the City Council, you can delegate this to the right people.
Apparently the project was too big for the people that
handled it before; they didn't have the expertise. I'm
willing to cooperate. It shouldn't be left like it is.
There is no barricade at the top of the bank.
Bryon Sneva, Public Works Director, reported that several
years ago, there was a problem with a slide at this location.
The City cleaned it up. At that time, it was brought up that

it had been sliding and required maintenance frequently.
What Mr. Reslock is saying is that someone on his property
could fall over the steep bank. I don't know why a fence
wasn't installed. The City's concern was that the drainage
be corrected, but I don't know if this was done. We did not,
at that time, institute a project to reconstruct the slope or
install a protective fence. This was discussed by a Council
Committee.
Council President Duffie recommended to Mr. Reslock that he
meet with Mr. Sneva and see what can be done.
Mr. Reslock said that his property line starts 6" from the
edge of the sidewalk. When the City sloped the bank, it
looked nice, but apparently there was no money to extend the
retaining wall. The whole bank is going to go one of these
days and, I think, it is the City's responsibility to put a
retaining wall there. The whole problem was created by the
City.

c. Acceptance of the Upper Foster Park Project for a total
project cost of $125,425.
d. An ordinance of the City of Tukwila levying the general
taxes for the City of Tukwila in King County for the
fiscal year commencing January 1, 1987, on all property,
both real and personal, in said City which is subject to
taxation for the purpose of paying sufficient revenue to
carry on the several departments of said City for the
ensuing year as required by law.
e. An ordinance of the City of Tukwila to appropriate
Water /Sewer Revenue Bond proceeds and redeem outstanding
Bond Anticipation Note, and pay debt issuance costs in
the Water /Sewer Construction Fund, and establishing an
effective date.
f. A resolution of the City Council of the City of Tukwila
rejecting any and all bids received by the City to
construct a new 18th green, practice tee and 18th fairway
improvements.

fixing the time for a public hearing upon the vacation of

Council President Duffie declared the Public Hearing open to
Proposed Budget for
1987 consider the proposed Budget for 1987.
Ms. Barbara Cook, King County Rape Relief, thanked the City
for its continued support of the agency. She reviewed how
the $2,000 contributed by the City for 1986 was used. In
total, the agency over last year reached 450 individuals
regarding rape, sexual assault and its prevention. She
requested that Council consider increasing the City's funding
to them to $3,000 for 1987. The number of victims in the
Tukwila area has not increased, but the cost to provide ser-
vice to victims has dramatically increased. They are going
to all Councils to ask for additional help. If Council can't
see it's way to increase the contribution, they would like it
maintained. 60% of their budget is provided by King County
and the cities, and the other 40% comes from private dona-
tions.
Pam Thorsen, Chamber of Commerce, said they are not prepared
to make their presentation tonight, but will be back later
after their committee meets.
There being no further comments, the Public Hearing was
closed.
Council Member Morgan expressed concern that there will not
be enough time to review the concerns that each Committee has
in the Budget. She suggested that Council extend the next
Committee of the Whole. Council President Duffie said the
meeting could be continued to Tuesday night if it is
necessary.
Councilman Bauch asked to have Item d removed from the
Consent Agenda so that his vote would be recorded.

ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED.
City Attorney Haney read an ordinance of the City of Tukwila,
Wash., levying the general taxes for the City of Tukwila in
King County for the fiscal year commencing January 1,1987, on
all property, both real and personal, in said City which is
subject to taxation for the purpose of paying sufficient
revenue to carry on the several departments of said City for
the ensuing year as required by law.
MOVED BY SIMPSON, SECONDED BY STOKNES, THAT THE PROPOSED
ORDINANCE BE ADOPTED AS READ.*
Councilman Bauch said the budget provides for raising the
property taxes by 6 This is without justification. The
only reason it is being raised is because this is what the
state allows. We are just building in an a cc;-lation of the
revenues available which are not needed. I do not support
this.

Council Member Morgan said the City has accelerated the
street program both commercially and residentially. The
budget, as proposed, suggests that the revenue for internal
streets within the Central 3 usiness District would be paid
for by City revenues with some L.I.D.'s and with some pro-
perty owner contributions of right -of -way. This budget is
based on a transportation section where the City bears most
of the costs. Alan Doerschel, Finance Director, agreed.
Council Member Morgan continued, the Transportation Committee
is establishing some policies which may drastically effect
this budget. They want to delay some proposed construction
for this coming year, and they may suggest changing the
method of financing for a few of the projects. If Council
were to make these changes, this increase would not be
necessary.
Alan Doerschel, Finance Director, explained that if the City
doesn't levy the 6% they can never go back am:lecover; we will
always be behind by the number of years you didn't raise it.
If we have a surplus of revenue, look at other places to
reduce the burden. Several years from now, there may not be
as much money available. The property tax is the most secure
base.

Mr. Doerschel explained that if you reduce the property taxes
by $130,000 or $140,000 the Planning Model will show a
reduction of about $800,000 over the next six years, plus
with a lower sales tax projection, there is going to be more
pressure to form an LID. By doing this it has not helped the
business community. The City has one of the lowest tax rates
in the County.
Don Morrison reminded Council that they need to levy a tax
rate. They cannot just vote down the ordinance, and it needs
to be done tonight.

Councilman McKenna suggested that the amount of the increase
be set aside until such time as Council makes a policy
decision on: (a) How to spend the money; (b) Has decided that
we do not like the 6% increase and would like to roll back
the property taxes.
He said he does not like the fact of arbitrarily increasing
6% just because cities are allowed to do that. This way we
get the 106% and, at the same time, have made the decision to
look at the policy.
Councilman Bauch said he wasn't in favor of this unless the
money is put into the Contingency Fund so it forces Council
to look at it again.
MOVED BY MCKENNA, SECONDED BY BAUCH, THAT COUNCIL ADOPT
ORDINANCE NO. 1410 AS PRESENTED AND THAT $109,758 OF THE TAX
REVENUE BE PLACED IN THE CONTINGENCY FUND. MOTION CARRIED.
Councilman Bauch explained that he had this item removed from
the Consent Agenda so that he could express his concern about
the money being spent on computers and the need for an expan-
sion plan. He suggested that all money proposed in the 1987
Budget for computer expenditures be frozen until Council
approves a long range plan.

MOTION NO. 86 -06 FOR ADDITIONAL EQUIPMENT FOR FIRE DEPARTMENT
COMPUTER BE APPROVED. MOTION CARRIED.
MOVED BY BAUCH, SECONDED BY SIMPSON, THAT COUNCIL GO INTO
EXECUTIVE SESSION AFTER A FIVE MINUTE BREAK. (Session called
to discuss Labor Negotiations; approximate time 20 minutes)
MOTION CARRIED.
EXECUTIVE SESSION WAS CLOSED AND THE REGULAR MEETING OF THE
TUKWILA CITY COUNCIL WAS ADJOURNED.
