THIS EASEMENT AGREEMENT is made and entered into by and between the undersigned
owner(s)(grantor) in fee simple of the land described herein.
And is for the benefit of the Grantee's property.
For and in consideration of the mutual covenants, an agreement hereinafter expressed and other good and
valuable consideration, in hand paid, receipt of which is hereby acknowledged, the parties hereto agree as
follows:
1. The owners of the above described land do hereby define, grant and convey to the present and future
owners (grantee) of the land described as follows:

portion of said grantor's land described as follows:
INGRESS, EGRESS AND UTILITY EASEMENT OVER PORTION OF LOT 1 OF
SHORT PLAT L06 -032
LEGAL DESCRIPTION OF INGRESS, EGRESS AND UTILITY EASEMENT AREA:
AN EASEMENT 15 FEET IN WIDTH, LYING 7.5 FEET ON EACH SIDE OF THE FOLLOWING
DESCRIBED EASEMENT CENTERLINE:
COMMENCING AT THE NORTHWEST CORNER OF SAID DESCRIBED LOT 1;
THENCE S 00 °53'51 "W, ALONG THE WEST LINE OF SAID LOT 1, A DISTANCE OF 7.50 FEET TO
THE TRUE POINT OF BEGINNING OF SAID EASEMENT CENTERLINE;
THENCE S 89 °17'51 "E, PARALLEL WITH THE NORTH LINE OF SAID LOT 1, A DISTANCE OF
47.24 FEET TO THE EAST LINE OF SAID DESCRIBED LOT 1, AND THE TERMINUS OF SAID
EASEMENT CENTERLINE.
2. This easement is for the sole purpose of the construction, use and maintenance of a Ingress, Egress &
Utility Easement, together with the right of ingress and egress for said construction, use and maintenance.
3. Grantee shall install any improvements in said Ingress, Egress & Utility Easement at its sole cost and
expense and shall continue to maintain and shall continue to bear all cost of repair and maintenance of said
Ingress, Egress & Utility Easement.
4. Grantee shall hold Grantor harmless from and against any and all claims which may be made against
grantor arising out of the installation, operation, maintenance or repair of said Ingress, Egress & Utility
Easement.
5. The herein easement and agreement may be amended only with the written agreement of the Grantee
herein, his heirs and/or assigns.
This easement agreement shall run with the land and shall be binding on all parties having or acquiring any
right, title or interest in the land described herein or any part thereof.
