WHEREAS, THIS AGREEMENT, made this 2D day of July , 20 04 , between
OWNERS NAME Gurdip Singh and Sukhbir Kaur Grewal
Owners of the following described real property situated in King County, Washington, to - wit:
42xx S 145 St Lot 1 Tukwila SP #L04 -015
AND
Owners of the following described real property situated in King County, Washington, to -wit:
.42xx S 148 St Lot 2 Tukwila SP #L04 -015
AND
Owners of the following described real property situated in King county, Washington, to -wit:
42xx S 148 St Lot 3 Tukwila SP #L04 -015
AND
Owners of the following described real property situated in King County, Washington, to -wit:
4228 S 148 St Lot 4 Tukwila SP #L04 -015
are desirous of establishing a side sewer easement for the benefit of each of said properties.
WITNESSETH: That for and in consideration of the mut covenants herein expressed, it
is hereby agreed between the above parties as follows: (1 06,10000 8 oS
1 at — A side sewer shall be constructed as follows: (brief legal description of location of
easement) Centerline Description; 10 FT wide Easement (5 FT on each side) Starting at a point
along S 148 St 27 FT E of SW prop corner of Lot 4 thence NE to a point 30 FT S of N prop line
and 18 FT W of E prop line of Lot 4 thence N to a point 5 FT N of S prop line and 11 FT E of W
prop line of Lot 1 thence NW to a point along W prop line 19 FT N of SW prop corner.
2 - There shall be, and each party does grant unto the other, an easement for sewer
along the line as constructed for the use of said properties and for the purpose of constructing,
installing, reconstructing, replacing, repairing, maintaining and operating a sewer pipeline and lines
and all necessary connections and appurtenances thereto, together with the right of ingress and
egress therefrom for the purpose of enjoying the easement, and also granting to Grantees and to
those acting under or for Grantees the use of such additional area immediately adjacent to the
above easement as shall be required for the construction of the sewer pipeline or lines in the
easement, such additional area to be held to a minimum necessary for the purpose, and
immediately after the completion of the construction and installation, or any subsequent entry upon
the easement, Grantees shall restore the premises as near as may be to its condition immediately
before such construction or entry.
3rd The cost of construction of said sewer shall be borne by the owners of the said
properties as follows: Mutually agreed
4 - The cost of maintenance, repair or reconstruction of that portion of the sewer used in
common shall be borne in equal shares, except that the owners of any lower parcel shall not be
responsible for the part of the sewer above their connection; and when necessary to repair, clean
or reconstruct the sewer, the parties to this agreement shall have a right of entry for that purpose.
5 - This agreement shall be a covenant running with the land and shall be binding upon
all parties, their heirs and assigns forever.
