HomeMy WebLinkAbout2005 - Drainage and Private Road Maintenance and Water Line and It's Maitnenance Convenant - Cosic Zehrudin - 2005101400113220051014001132 AND PRIVATE ROAD MAINTENANCE & WATER LINE & IT'S MAINTENANCE COVENANT The private drainage system shall be maintained in an operable and efficient condition consistent with the 1998 King County Surface Water Design Manual or its successor document. The private road shall be maintained as an operable asphalt surfaced road. Where any question exists as to the standards to be applied. The owners may obtain a recommendation from the City of Tukwila or its successor agency and/or a licensed engineer. A minimum 60% majority of the owner(s) may initiate an improvement or repair action. All owners shall share all associated costs on equal basis, with no fees allowed for administration by one or more of the owners. All funds shall be due at the time that the work is billed by the respective contractor or professional. Independent payment schedules may be used if agreed upon by the majority of the owners. In the event that funds are not paid when due, the aggrieved owner(s) may initiate an action to collect the funds and shall be entitled to costs and a reasonable attorney's fee RECE OCT 21 2005 ME INNWEVI This covenant is executed to provide for the repair and maintenance of the private road , drainage system & water line within the property described below for the continued use and benefit by the owners thereof, as described below. This covenant shall run with the land for as long as the private road , drainage system and water line is used to serve the lots described below. Owners: The owners of Lots 1 and 2 of the City of Tukwila Short Plat No. L -04 -076 for the private road , drainage system and water line within Said City of Tukwila Short Plat. This covenant shall be binding upon all owners, their heirs, successors, or assigns. In the event that the property changes hands, the new owner shall be responsible for all past due charges outstanding against the lot at the time of transfer. Water line Utility And It's Maintenance Easement Description : See Exhibit C Water line easement is hereby dedicated for the use and benefits for lot # 2 of short plat # L 04 -076 of city of Tukwila .The sole purpose of this easement is for construction, repair , or / and maintenance of water line for lot # 2 . All maintenance , repair , and / Re- installation of water line shall be the sole responsibility of the owner (s) of the lot Serviced by the water line .When said maintenance is performed within the easement, the disturbed land areas shall be substantially returned to their condition prior to such maintenance. We hereby declare , convey and dedicate easement (s) over , under , across and through Said premises for private road , private drainge system ,water line and their maintenance. The above said easement shall be deemed a convenant running with the land.
