HomeMy WebLinkAbout2006 - Declaration of Easement for Side Sewer - Hemenway Harold - 2006032800070020060328000700 7340600768 Seattle, WA 98168 ONE PARTY DECLARATION OF EASEMENT FOR SIDE SEWER WHEREAS, THIS AGREEMENT, made this 27 day of March , 2006, between OWNERS NAME Harold Hemenway Owner of the following described real property situated in King County, Washington, to - wit: 40xx S 128 St, Lot 1 SP #L04 - 078 And 40�oc S 128 St Lot 2 SP #L04 - 078 is desirous of establishing a side sewer easement for the benefit of each of said properties. WITNESSETH: That for and in consideration of the mutual covenants herein expressed, it is hereby agreed by the above party as follows: 1st - A side sewer shall be constructed as follows: Brief Legal: North 10 FT of Lot 1 SP #L04 - 078 7?)4 -OGa0 —07GS 2nd - There shall be, and each party does grant unto the other, an easement for sewer for the use of said properties and for the purpose of constructing, installing, reconstructing, replacing, repairing, maintaining and operating a sewer pipeline and lines and all necessary connections and appurtenances thereto, together with the right of ingress and egress therefrom for the purpose of enjoying the easement, and also granting to each party and to those acting under or for each party the use of such additional area immediately adjacent to the above easement as shall be required for the construction of the sewer pipeline or lines in the easement, such additional area to be held to a minimum necessary for the purpose, and immediately after the completion of the construction and installation, or any subsequent entry upon the easement, the responsible party(s) shall restore the premises as near as may be to its condition immediately before such construction or entry. 3rd - The cost of construction of said sewer shall be borne by the owners of the said properties as follows: As mutually agreed 4th - The cost of maintenance, repair or reconstruction of that portion of the sewer used in common sballbe't,oine in equal shares, except that the owners of any lower parcel shall not be responsible for the part of the sewer above their connection; and when necessary to repair, clean or reconstruct the sewer, the parties to this agreement shall have a right of entry for that purpose. 5th - This agreement shall be a covenant running with the land and shall be binding upon all parties, their -heirs and assigns forever.
