Tax Parcel No. 073300 -0130 Doak Homes, Inc. 11812 — 26th Ave. SW Burien, WA 98146 II 20041208002150 DOAK HOMES INC COV 20.00 PAGE001 OF 002 12/08/2004 15:32 KING COUNTY, WA DECLARATION OF COVENANT ASSOCIATED WITH SINGLE FAMILY STORM WATER RETENTION FACILITY 111 11 The undersigned, Grantor herein: Doak Homes, Inc., a Washington. Corporation, as owner covenants and agrees that: 1. The titleholders of the above described property shall assume all responsibility for the cost of any maintenance and for repairs to the roof gutters, storm water conveyance and infiltration facilities existing on the above - described property. 2. Maintenance shall include, but not be limited to:. a. Annual cleaning of roof gutters. b. Removal of sediment & debris from catch basin sump when when any sediment and debris fills vault more the 4 inches in depth or obstructing flow into the connector pipes. c. Repair /replace damaged facilities or blocked pipes. d. Replacement of infiltration sumps when they will no longer dispose of 90% of the roof & driveway runoff. 3. If the City of Tukwila determines that maintenance or repair work is required to be done to the roof gutters, storm water conveyance and/or infiltration facilities existing on the above - described property, the director of the department of public works shall give the owner of the property within which the drainage facility is located, notice of the specific maintenance and/or repair required. The director of the department of public works shall set a reasonable time in which such work is to be completed by the titleholders who were given notice. Written notice will be sent to the titleholders stating the city's intention to perform such maintenance. Maintenance work will not commence until at least seven days after such notice is mailed. The titleholder shall be responsibe for reimbursement to the city within 30 days of the receipt of the invoice for any such work performed. Overdue payments will require payment of interest at the current legal rate for liquidated judgements. If legal action ensues, any costs or fees incurred by the county will be borne by the parties responsible for said reimbursements. These covenants are intended to protect the value and desirability of the real property described above, and to benefit all the citizens of the City of Tukwila. They shall run with the land and be binding on all parties having or acquiring interest in the real property as well as their heirs, successors and assigns. They shall inure to the benefit of each present or future successor in interest of said property or any part thereof, or interest therein, and to the benefit of all the citizens of the City of Tukwila.
