This easement is for the sole purpose of the construction, use, and maintenance of utilities, together with the right of ingress, egress for such purposes. 3. Said easement is subject to a utilities easement in favor of any electric, telephone, television cable, gas, water, or sewer company, public or private, or their permittees or assigns to install, construct, operate, maintain, alter, and repair their respective utilities for servicing grantees property, together with the right of ingress and egress for said purposes. 4. Routine maintenance and repair costs of the utilities constructed within said Utility Easement shall be the sole responsibility of the owner of the lot serviced by the utility, unless the utility is jointly owned and/or used by both Lot 4 and Lot 5. The maintenance /repair costs for any utility jointly owned and/or used by both Lot 4 and Lot 5 will be divided equally between the owners of Lot 4 and Lot 5. 5. The amount and type of maintenance to be performed on the any utility shall be determined by majority vote of the lot owners using the utility. Each lot shall have one vote regardless of the number of owners owning any lot. The utilities shall at all times be maintained adequately to provide the necessary utility service. 6. The herein easement and agreements may be amended only with the written agreement of the Grantee herein. This easement agreement shall run with the land and shall be binding on all parties having or acquiring any right, title, or interest in the land described herein or any part thereof.
