In consideration of this Easement being granted, Grantee hereby waives any claim for ownership by adverse possession of Parcel "A". In the event any owner, future owner, successor, or assignee of any interest created hereby brings suit to enforce any right, interest, term or terms of this Agreement, then the prevailing party in any such suit shall be entitled to all costs, fees, and expenses, including, but not limited to, reasonable attorney's fees. Maintenance. The Retaining Wall shall be maintained in at least the same condition as it now exists. The owner /s, future owners, successors, and assigns of Parcels "A" and "B ", shall jointly be responsible for the replacement construction, maintenance, repair, and costs thereof to maintain the Retaining Wall described herein, so that it can continue to be used in at least the same capacity as it is currently used; provided, that if one owner or their agents, invitees or licensees is /are the sole cause of substantial damage to the Retaining Wall, then said owner shall be solely responsible for restoring or repairing the wall and affected property to its condition before the damage was done. It is the intent of the Grantor undersigned that this Easement shall take effect immediately upon its execution. Said Easement shall run with the land in perpetuity and bind all owners, future owners, and their successors and assigns. Signing of this Declaration of Easement may be in counterparts.
