It Is understood that the movement of railroad locomotives includes some risk of fire, and the Industry assumes all responsibility for and agrees to indemnify the Railroad Company against loss or damage to property of the Industry or to property upon its premises, regardless a railroad negligence, arising from fire caused by locomotives operated by the Railroad Company on said track, or In the vicinity thereof, for the purpose of serving the Industry, except to the premises of the Railroad Company, and to rolling stock belonging to the Railroad Company or to others, and to shipments in the course Of transportation. The Industry also agrees to Indemnify and hold harmless the Railroad Company for loss, damage or injury from any act of omission of the Industry, its employes, or agents, to the person or property of the parties hereto and their cmp!oyes, and to the person or property of any other person or corporation, while on or about said track; and if any claim or 1'iability other than from fire shall arise from the joint or concurring negligence of both parties hereto, it shall be borne by them equally. ii. In addition, the Railroad Company may terminate this agreement in the event that service upon said track cannot be continued because of changes In other tracks or in the Railroad Company's operating requirements, 13. Please address the following comments . , 1. Because the existing Costco building is so large in square footage and city records are inconclusive as to how it was constructed to this square footage, an analysis on allowable area is required. The analysis should depict the 1991 edition of the Uniform Building Code for Occupancy group, Type of construction, Sprinklers, Yards, etc. This analysis will determine if the existing building may or may not be expanded in total square foot area. 2. The existing wholesale warehouse area is not considered conditioned space, nor does it meet current Energy Code requirements. All new habitable rooms that are to be heated or cooled must have construction details to show compliance with the Washington State Energy Code. 3. Demonstrate that all new rooms or spaces are provided with minimum ventilation complying with the State WAC 51 -13 Ventilation and Air Quality Code. 4. Provide additional details for lateral bracing of interior partition per U.B.C. 2309.
