inafter called the Grantors, and the CITY OP SEATTLE, municipal
corporation, hereinafter called the Grants., WITNESSETH:
EASEMENT (Overhead i Underground)
that the Grantors, for and in consideration of the sum of ONE
,J AND NO /100 Dollars ($1.00) and other valuable considerations, re-
csipt of which is hereby acknowledged, hereby conusy and grant to
: , the Grantee, its successors and assigns, the right, privilege and
authority, to install, construct, erect, alter, improve, repair,
energize, operate and maintain electric overhead and underground
transmission and distribution line facilities, including communi-
cation wires, consisting of poles, with brace:. guys and anchors,
crossarms, transformers, ducts, vaults, manholes, cabinets, con-
tainers, conduits, wires and other necessery.or convenient appur-
tenances to make said underground and overhead installations in-
tegrated alectric and communication systems, all such electric
and communication systems to be located upon under, over and
across the following described lands and premises situated in the
County of KING, State of Washington, to -wit:
The east 5 feat of the west 237.5 feat of the
north 35 fee: of Tram 4, Ri,ar.Ide Interurban+
Tracts as recorded in Volume 10 of Plats, page 74,
Records of King County, Washington
Together with the right at all times to the Grantee, its suc-
cessors and assigns, of ingress to and egress from said lands
across adjacent lands of the Grantors for the purpose of con-
structing, reconotruccint, repairing, renewing, altering, cha::sing,
patrolling ..nd operating said electric and communication systems,
and the right at any time to remove all or any part of said elec-
tric and communication systems from said lands.
The Grantors, their heirs, executors, Administrators, succes-
sors and assigns, hereby covenant ann agree that no structure will
be erected or permitted within the above described easement area
without prior written approval from the Grantee, its successors
and assigns; that no digging will be done or permitted within the
easement area which will in any manner disturb the facilities,
their solidity or unearth any portion thereof; and that no blasting
or discharge of any explosives vill be permitted within fifteen
(15) feet of said lines and appurtenances. All conduit or cable
laid under this greet. shall be laid upon a route as row located,
and shall be buried to such depth as not to interfere iith the
ordinary use of said land.
Also the right to the Grantee, its successors and assigns, at
all times to out all brush and timber, and trim all trees standing
or growing upon said lands which, in the opinion of the Grantee,
constitute a menace or danger to said electric and communication
systems.
The City of Seattle is to be responsible, as provided by lsv,
for any damage resulting to the Grantors through its negligence
in the construction, maintenance and operation cf said electric
and communication systems, over, under and across the property
said Grantors.
