WW 2 I— r. 0 L i - O LU O • ~' Z Lift t Vt DRAINAGE And PRIVATE ROAD MAINTENANCE COVENANT This covenant is executed to provide for the repair and maintenance of the private road and drainage system within the property described below for the continued use and benefit by the owners thereof, as described below. This covenant shall run with the land for as long as the private road and drainage system is used to serve the lots described below. Owners: The owners of Lots 2, 3, 4 and 5 of the City of Tukwila Short Plat No. L02 -037 for the private road and drainage system within said City of Tukwila Short Plat; AND. The owners of Lots 6 and 7 of the City of Tukwila Short Plat No, L02 -037 for the private drainage system only within the said City of Tukwila Short Plat. Private Road Description: The west 20 ft. of Lots 4.5 and 6 and the south 20 ft. of Lot 2, together with 25' radii on Lots 1 and 2, as shown on Exhibit A. The private drainage system is within the private rood easement plus the south 15' of Lot 3. The private drainage system shall be maintained in an operable and efficient condition consistent with the 1998 King County Surface Water Design Manual or its successor document. The private road shall be maintained as an operable asphalt surfaced road. Where any question exists as to the standards to be applied, the owners may obtain a recommendation from the City of Tukwila or its successor agency and /or a licensed engineer. A minimum 60% majority of the owners may initiate an improvement or repair action. All owners shall share all associated costs on an equal basis, with no fees allowed for administration by one or more of the owners. All funds shall be due at the time that the work is billed by the respective contractor or professional. Independent payment schedules may be used if agreed upon by the majority of owners. In the event that funds are not paid when due, the aggrieved owner(s) may initiate an action to collect the funds and shall be entitled to costs and a reasonable attorney's fee upon recovery.
