EXCISE TAX NOT REOUIRED Ki Co - ecords Division a , Deputy The Grantors, for and in consideration of one dollar and other valuable consideration, does hereby grant, convey and warrant unto the Grantees a utility easement for the purpose installing and maintaining underground utilities in the North 18 feet of Lot 2 of City of Tukwila Short Plat Number L2000 -016 recorded under recording number 20000622900008. WITNESSETH: The Grantees shall have the right, without prior notice or proceeding at law, at such times as may be necessary, to enter upon said above described property for the purpose of constructing, maintaining, repairing, altering or reconstructing said utilities, or making any connections therewith, without incurring any legal obligation or Liability therefore, provided, that such construction, maintenance, repair, alteration or reconstruction shall be accomplished in such a manner that the private improvements existing within the easement shall not be disturbed or damaged, or in the event they are disturbed or damaged, they shall be restored or replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. 1 The Grantees agrees that they shall be responsible to pay, as to each lot owned, an equal pro -rata share of the costs of maintaining the utilities installed within the above described easement. This covenant to pay shall be binding on the heirs, successors, and assigns of the Grantee to this agreement and shall run with the title to their lot. The Grantors shall retain the right to use and enjoy the afore described premises, including the right to use the surface of said easement if such use does not interfere with installation and maintenance of the utilities. However, the Grantor shall not erect buildings or structures over, under or across the easement during the existence of such utilities. This easement shall be a covenant running with the land and shall be binding on the Grantors and Grantor's successors, heirs and assigns.
