DECISION Based on the attached staff report, it is determined that there is no change of use between Western Cascade and Sexton Steel and a Business License can be issued to Sexton Steel to locate at 12065 44"' Place South with the following conditions: a) Sexton Steel must operate with both the east and north doors closed. b) Hours of operation are limited to 7 am to 10 p.m. on weekdays and 9am to 10 p.m. on • weekends or holidays. c) The applicant must enclose the sanding /grinding operations with a wood framed sheetrock- covered partition. d) All work must be performed inside the building and the business is bound by TMC 18.70, Nonconforming Lots, Uses and Structures. e) Sexton Steel must comply with the established truck route. Public Works Department has established a truck route to be used for both ingress and egress to the subject site. The streets to be used are 44`'' Place South and 49th Avenue South to /from South 124th Street. Please note that Sexton Steel must continue to operate in a manner so that it complies with the city's noise ordinance. May 4, 2001 to assess the noise produced by Sexton Steel across 44th PL. Sound Pruf, a blow -on sound insulation product has been applied to the wall of.the steel factory near the plasma cutter. Due to the constantly varying ambient noise level, caused by aircraft and freeway noise, we were not able to identify the exact noise level produced by the plasma cutter across 44th PL. However, we can show that the sound produced by the plasma cutter is less than 53.2 dB(A). DEFINITION OF TERMS • j (A.Scale Level): Overall Sound Pressure Level (in dB re: 20 microPascal — also dB(A)) measured by a system having A -Scale frequency response. L (Energ,y Equivalent Sound Level): The level of a constant sound over a specific time period that has the same sound energy as a measured unsteady sound over the same period. jj : The minimum A- weighted sound level measured during.a time interval. kiwi: The maximum A- weighted sound level measured during a time interval MEASUREMENT RESULTS Reference 1 documented the measurement taken on December 16, 2000 at the properties surrounding Sexton Steel. The results of the measurements were that. the 55 dB(A) noise limit during the day was being complied with except at the location directly across 44th PL, which is the closest location to the plasma cutter. The measured LEQ (corrected for ambient noise) at this position was 59.1 dR(A). To mitigate sound levels across 44th PL, the exterior wall near the plasma cutter has been sprayed with 2" of Sound Pruf, a blow on type insulation. February 12, 2001. , Minnie Dhaliwal City of Tukwila Dept. of Community Development 9 2001 COli/ituf UNITY Q VEL OPl~ EI T Subject: Review of JR Engineering's Noise Study and Mitigation Plan Dear Ms: Dhaliwah, I have reviewed the noise study and abatement plan provided to Sexton Steel by JR Engineering . and offer the following comments: 1. Measured Noise Levels- in general, Environalysis measured higher overall noise levels than JR Engineering but the plant impacts are very similar for both analyses. JR Engineering attempted to measure only the noise from Sexton Steel by taking measurements only when 'Sexton's noise - levels were clearly audible over the background noises. Environalysis determined the :plant's noise impacts by simultaneously measuring all noises at two locations- one right at the open doors of the plant, and the other on residential properties on 46th Avenue and 4011lace. Environalysis assumed that difference between the two measurements,could only be due to the plant's operations. JR's measurements cover a very short period of time and are vulnerable to the subjective decisions of the person taking the measurement. The noise levels that JR Engineering terms "ambient corrected" represent their assessment of the plant's impacts. The results are compared in the following table: :Monitoring Site : Description . Noise Mitigation Measures. The JR Engineering report suggests several sound mitigation measures: 1. Keep exterior door closed. We fully agree with this measure. 2. Install a lined duct for the ventilation fan located on the east side of the building. This fan is barely audible at the residential property on the east side of 44th Place during periods of high background noise. However muffling its noise will help lower the overall impact of the plant. This measure is recommended. a) Add sheetrock to the east wall to create a sheet rock noise barrier on the inside of the plant between the plasma cutter and homes along 44`x' Place. This measure would provide the noise reduction capability required to eliminate noise impacts to 44th Place but might create such a reflective interior surface that impacts could be worsened for homes to the ,north on 46`x' Avenue. This measure is not recommended unless the north wall and door of the place are also lined with sheetrock. 3 b) Build a crossways wall south of the plasma cutter. This measure prevents the normal working of the overhead crane and ventilation fan and is thus not recommended. Cover holes in the sheet metal siding. This measure will have minor benefits but is so easily done it; it should be included in the mitigation package. An alternate type of sound barrier is proposed at the end of JR Engineering's report featuring the use of a spray -on fibrous barrier. I examined the acoustic data on this material and offer the following suggestions: • Two inches of Sound -pruf will be needed to obtain the same mass as the GWB treatment suggested above and should eliminate all noise impacts at 44th Place and may reduce noise reflection (reverberation) to residences on 46`x' Avenue. Mitigation can proceed in a phased - fashion, i.e. first insulate the areas described in JR Engineer's report (50 feet each side of the plasma cutter) floor to ceiling, and then take noise measurements to confirm that that level of mitigation is adequate before moving to additional mitigation measures, such as insulating the entire east wall and /or north wall. J H 0 LL This letter outlines some additional sound mitigation measures that will reduce Sexton Steel noise w 0 levels below the levels required by Tukwila's noise ordinance. The measures described herein are 2 alternatives to those described in Reference 1. g w 0. The recommendations in Reference 1 were to build a 5/8" thick gypsum wall along a portion of the I W east wall and to build an acoustically lined exhaust duct for the ventilation fan. Other holes in the z = wall were to be sealed with acoustic caulk. — i- 0 z l— w Further analysis shows that a spray on acoustic treatment could be an alternative solution to building 2 �� the gypsum wall. The spray on material should have a surface density of 1.7 lb. /ft? or greater. A 0 �. material. with a lower density will require a thicker coating than a high density material. ' 0 �` w wr The product specifications that you faxed to us for GOLDSEAL 50 Icynene Insulation included a v' layer of 5/8" gypsum on each side of the foam insulation. Thus, the Transinission Loss of the foam u- p. alone will be much less than was published in the report. Each of these products has a density of 101b. /ft?. To get the required 1.7 IbJft 2 surface density a coating of 2 inches will be required. Calculations show that with the 2 -inch thick coating of either of these materials, the continuous noise levels at the properties across 44th PL. South will be 54.7 dB(A). A thicker coating will result in even lower noise levels. Other equivalent products should produce the same noise reduction if the same amount of mass is applied to the wall.. Since these products are sound absorbing, they will help to reduce the noise. levels within the building and provide a more comfortable environment for workers. Furthermore, the insulation will help seal existing holes in the•wall and may eliminate the need for sealing the holes with caulk. Another alternative would be to put a 4" layer of fiberglass insulation over the existing wall and cover it with 16 gauge steel. This added wall needs to extend 50' past each end of the plasma cutter and extend to the edge of the roof, which are the same dimensions required for the gypsum wall recommended in Reference 1. The review and decisions regarding Code Interpretations are made by the Director of Community Development as Type 2 decisions, as reflected in TMC 18.104. The evaluation if the proposed nonconforming use is allowed to be located in the LDR zone is based on review of TMC 18.70.040 (5). This section reads: "If a change of use is proposed to a use determined to be nonconforming by application of provision in this title, the proposed new use must be a permitted use in its zone or a use approved under a Conditional Use or Unclassified Use Permit process, subject to review and approval by the Planning Commission and/or City Council. For the purposes of implementing this section, a change of use constitutes a change from one Permitted, Conditional or Unclassified Use to another such use category as listed within the Zoning Code" FINDINGS 1. Use Category: A. Sexton Steel: According to the documentation submitted by applicant (Attachment A), Sexton Steel manufactures metal parts, mainly steel but also aluminum and stainless steel. Metal parts are manufactured from steel plates, pipes, angle irons and tubes. The process includes burning, sawing, cutting, drilling and welding or assembly. They fabricate tank heads and other supports for a tank manufacturing company; produce parts for Genie Industries, which sells man- lifting equipment; produce parts for trucks, cranes and boats; and manufacture products for other steel suppliers. Based on review of the documentation submitted by applicant, Sexton Steel is classified under the following zoning code use category: "Manufacturing, processing and/or assembling of previously manufactured metals, such as iron and steel fabrication; steel production by electric arc melting, oxygen refining, and consumable electrode melting; and similar heavy industrial uses." B. Western Cascade: Per addendum to Notice of Decision issued to Western Cascade on October 12, 2000, Western Cascade is classified under the following zoning code use category: "Manufacturing, processing and/or assembling of previously manufactured metals, such as iron and steel fabrication; steel production by electric arc melting, oxygen refining, and consumable electrode melting; and similar heavy industrial uses." Analysis of Sexton Steel relative to various code requirements: a) Noise: Applicant was required to submit documentation regarding how it would meet the City's adopted noise standards. Applicant submitted a noise study prepared by JR Engineering that recommended some measures in order to reduce noise impacts. The City's consultant (Environalysis) reviewed the applicant's report and concurred with its recommendations and proposed some changes to the suggested methods to reduce noise impacts. Applicant completed the remedies suggested by the noise consultants. They insulated 50 feet each side of the plasma cutter with two inches of spray on fibrous sound barrier material. Environalysis did follow -up monitoring to confirm that the noise reduction measures undertaken by Sexton Steel did reduce the noise levels to meet the city's noise ordinance. They concluded that addition of insulation to the east wall does bring the facility into compliance with the city's noise ordinance at this time. They also recommended that in order for Sexton Steel to continue to meet the city's noise ordinance, it must operate with both the east and north doors closed. Also, the hours of operation must be limited to lam to 10pm on weekdays and 9 am to 10pm on weekends and holidays. The applicant has also offered to enclose the sanding /grinding operations with a wood framed sheetrock- covered partition. Environalysis believes this suggestion is valuable and must be incorporated. It is important to note that Sexton Steel must continue to operate in a manner so that it complies with the city's noise ordinance. If at any subsequent time it is determined that Sexton Steel violates the city's noise ordinance it shall be subject to the city's code enforcement procedures. b) All work will be done inside the building. Pursuant to TMC 18.70.040, no nonconforming use shall be enlarged, intensified, increased or extended to occupy a greater use of the land, structure or combination of the two, than was occupied at the effective date of adoption of the zoning code. Hence applicant is not permitted to construct any new outdoor concrete pads for installation of new tanks. c) Sexton Steel must comply with the established truck route. The surrounding properties (with the possible exception of the car repair shop) are zoned as residential. Therefore, the maximum continuous noise level that Sexton Steel can produce at a property line will be 55 dB(A). For sounds of short duration, the sound limit is increased as follows. • 55 dB(A) for continuously produced noise • 60 dB(A) for sounds lasting less than 15 minutes per hour • 65 dB(A) for sounds lasting less than 5 minutes per hour • 70 dB(A) for sounds lasting less than 90 seconds per hour • Maximum sound levels are not allowed to exceed 70 dB(A) These limits are decreased by 5 dB(A) if the noise produced by the site is found to have a pure tone. 3.0 SITE DESCRIPTION The site is located at 12065 44th Place South Building 1A. The steel industry is located in a 370'x50' building. The subject site and all surround properties are relatively flat. The roof and walls of the building are made of corrugated metal and plastic and are attached over the building frame with no finishing surface or insulation. There are many holes in the sheet metal; some allow pipes and wire through the wall, other holes are just there. Regardless of their purpose, they allow sound to pass through the wall unimpeded. A large sliding track door is located on the north end of the building. Noise levels along the north side are significantly higher when the doors are open. Sounds from the steel operation are also audible along the east side of the building. At the time of our site visit, an overhead sliding door was partially open on this side of the building. A ventilation fan is also located on that side of the building. It is approximately 25' off the ground. The primary sources of continuous noise are the plasma cutter and the operation of a grinder /sander. Occasional banging and hammering noises are also present. The plasma cutter and the grinder /sander station are located approximately 200' from the north end of the building. The plasma cutter was on the east side, approximately 10' from the east wall. The grinder /sander was on the west side. Local traffic was occasionally present. 4.0 MEASURED NOISE LEVELS Measurements were taken next to the plasma cutter, outside the north door, on the sidewalk across 46th St. to the north and along 44`x' PL to the west. These positions are shown in Figure 1. Measurements were taken subject to the following conditions. • Minimal train and aircraft noise. • No local traffic. • Freeway traffic noise was constant and could not be avoided. The intermittent aircraft noise limited most measurements to about 15 seconds in length. The measured noise levels were conservatively corrected for a "quiet" ambient noise level. The ambient noise level used for the corrections was taken when no aircraft, train or local traffic was present. Across 46th St, however, ambient noise levels were about equal to the Sexton Steel noise when the north doors were closed. In fact, we found it difficult to discern if the plasma cutter was operating or not. Thus, it was not possible to accurately determine how much noise Sexton Steel made at these properties. However, the cumulative (ambient noise + Sexton Steel noise) was only 1.8 dB(A) above the 55 dB(A) limit, which indicates that the Sexton Steel noise is below 55 dB(A). Table 2 shows the measured continuous noise levels and the corrected noise levels. Keep exterior doors of the building closed when the plasma cutter, grinder /sander, or other equivalent noise sources are being operated. 2. Install a lined sheet metal duct that covers hole for the ventilation fan as shown in Figure 2. The duct should include an elbow and incorporate 2" thick fiberglass lining. 3a. Add a layer of 5/8" gypsum drywall along the cast wall of the building as shown in Figure 3. The drywall should extend 50 feet past each end of the plasma cutter and extend from the floor to the edge of the roof. The drywall can be applied to either the interior or exterior side of the existing wall. It may be easier to put the drywall on the exterior side of the wall but this solution may require adding some sort of sheathing over the drywall to protect it from the weather or, 3b. Build a 5/8" gypsum wall crossways in the steel plant located just south of the plasma cutter and add a layer of 5/8 gypsum along the east wall of the building that extends 50 past north edge of plasma cutter. The crossways wall needs to extend to the roof/ceiling and the joint should be sealed. This alleviates the need to implement step 2 although the fan will no longer provide ventilation to the steel operation. The overhead crane would not be able to continue past the plasma cutter position as well. 4. Cover holes in the sheet metal siding with additional sheet metal or seal with caulk, putty or other similar material. Additionally, the length of the gypsum wall will also help to attenuate sound of the other cutting machines and noise from the sanding/grinding station. The loudest steel sounds that we measured, which were caused by occasional banging or hammering, were about 74 dB(A) on the exterior of the building. The recommended sound mitigation measures will yield about 5 dB(A) in noise reduction and will attenuate these noises below the 70 dB(A) limit for impulsive sounds. 6.0 CONCLUSIONS Analysis shows that the mitigation measures described herein, will allow the site to comply with the Tukwila noise code even though the existing noise produced by the steel cutting operation is often masked by other sounds present in the surrounding environment. While at the site, we observed low level aircraft passes that produced noise levels over 80 dB(A). During a 5- minute ambient noise measurement, the minimum noise level measured was only 52.2 dB(A). The LE? measured during the same measurement was over 65 dB(A), which is considerably higher than the limits imposed on the steel manufacturing facility. Best regards, J R Engineering, . 'R E. s Testing for the Compliance of Sexton Steel with the City of Tukwila's Noise Ordinance Performed for the City of Tukwila Performed By: Environalysis- Seattle WA. Summary Environalysis was asked by the City of Tukwila to confirm that the noise reduction measures undertaken by Sexton Steel did reduce their noise levels and would allow them to meet the city's noise ordinance. After taking noise measurements we concluded that the addition of insulation to Sexton's Steel's east wall does bring the facility into compliance with the City of Tukwila's noise ordinance. Methodology In order to answer whether or not the Sexton Steel facility was in compliance with the City's noise ordinance, we set up two noise meters and operated them simultaneously for two separate noise tests. For the first test, performed on March 30, 2001, we measured indoor noise close to the plasma cutter while concurrently measuring noise on the adjacent outdoor surface of the east wall. The results of this measurement are shown in the graph entitled "Noise Reduction due to Insulated Wall ". The second test, performed March 31St, featured two simultaneous noise measurements, one close to the outside of the east wall and one on the closest residential property to the east (about 70 feet away) on the other side of 44th Place. The results of these tests are shown in two graphs, entitled "Measured Noise Levels" and "Calculated Noise Impacts ". Our conclusion is that the addition of 100 feet of 2" thick insulation to the east wall of the Sexton Steel facility does reduce noise levels and bring the facility into compliance with the city's noise ordinance. Conclusion The addition of 2 inches of sprayed -on insulation to 100 feet of the east wall of the Sexton Steel's portion of the Western Cascade Building does assist in bringing their operation into compliance with the City's Noise Ordinance. The operation's owner, Joel Sexton, offered to enclose the sanding/grinding operations with a wood - framed, sheetrock covered partition. Because the grinding/sanding noises are audible at the residential property lines to the east of the facility, we believe this suggestion is valuable and should be incorporated into this facility's operating requirements. PARKING DEVIATION ❑ Covenant Parking: where required parking is provided off -site (TMC 18.56.070(B)); ❑ Complementary Parking: where up to 10% of a development's useable floor area is determined to be linked to remaining area, such that it need not provide the normally required parking (TMC 18.56.070(D)); ❑ Reduction of the minimum requiredparking of up to 10 %, through an administrative variance (TMC 18.56.140). Landscape perimeter averaging may be allowed as a Type 2 special permission decision if all of the following criteria are met: 1. Plant material can be clustered to more effectively screen parking areas and blank building walls. 2. Perimeter averaging enables significant trees or existing built features to be retained. 3. Perimeter averaging is used to reduce the number of driveways and curb cuts and allow joint use of parking facilities between neighboring businesses. 4. Width of the perimeter landscaping is not reduced to the point that activities on the site become a nuisance to neighbors. 5. Averaging does not diminish the quality of the site landscape as a whole. ❑ In the MDR and HDR zones up to 20% of the minimum required front yard landscaped area may be developed for pedestrian and transit facilities. ❑ In the RCC and TUC zones required landscaping may include a mix of plant materials, pedestrian amenities and features, outdoor cafe -type seating and similar features. Required plant materials will be reduced in proportion to the amount of perimeter area devoted to pedestrian oriented space. TREE REGULATION DEVIATIONS ❑ The Director may grant exceptions from the requirements of chapter 18.54 when undue hardship may be created by strict compliance with the provisions of this chapter. Any authorization for exception may prescribe conditions deemed necessary or desirable for the public interest, or necessary to meet the intent of this chapter. An exception to this chapter shall not be granted unless all of the following criteria are met: 1. Strict compliance with the provisions of this code may jeopardize project feasibility or reasonable use of property. Proposed vegetation removal, replacement, and any mitigative measures proposed, are consistent with the purpose and intent given in this chapter. 3. The granting of the exception or standard reduction will not be detrimental to the public welfare or injurious to other property in the vicinity. All commercial and industrial developments shall be set back 15 feet and all residential development shall be set back ten feet, measured from the foundation to the buffer's edge. The Director may waive setback requirements when a site plan demonstrates there will be no impacts to the buffer zone. ❑ Buffers The Director may reduce the standard wetland/watercourse buffers on a case -by -case basis, provided the buffer does not contain slopes 20% or greater. The approved buffer width shall not result in greater than a 50% reduction in width, and the reduced buffer shall not be less than 15 feet for wetlands and ten feet for watercourses. The buffer is vegetated and includes an enhancement plan as may be required to improve the buffer function and value; or 2. If there is no significant vegetation in the buffer, a buffer may be reduced only if an enhancement plan is provided. The plan must include using a variety of native vegetation that improves the functional attributes of the buffer and provides additional protection for the wetland or watercourse functions and values. Location of property: 12065 44th P1 S. Bldg.# 1 -A Tukwila, WA 98178 -3414 Sexton Steel was located previously at the old Stack Steel property at 6th and Lander in Seattle. We were forced to vacate the building by the Sound Transit Authority. The reason is for the upcoming light rail commuting train in the Seattle market area. Seattle is currently purchasing the right of way's. We were given 1 -1/2 years to relocate or vacate, so we had to act quickly do to the lack of industrial buildings available with overhead crane usage. With all the current buildings in Seattle, these kind of structures are few. Sexton Steel manufactures products from steel plates, pipe, angle iron, and tubing. The process includes but not limited to, burning, sawing, cutting, drilling and welding or assembly for customer drawings and specifications. Our business comes from a large tank mfg. company in Tacoma. We fabricate their tank heads, supports and other items. We also produce parts for Genie Industries, which sells man lifting equipment world wide. They are located in Redmond, WA. In addition to, we also produce assemblies for " We are Sexton Steel and We Love to Burn." Freightliner Trucks in Oregon. The remainder of our business comes from marine industry and from other steel suppliers requiring assemblies we have bid on. Sexton Steel employ's 5 people most of the time. One office and four people working in the shop. We work daily from lam - 4 pm and occationally untill 6 pm, very little week -end work. Parking: We have six places on the west side of the building Traffic: We average one semi truck per day, steel supplier. Ship: We deliver most of our products with a one ton truck and 20' gooseneck trailer. Some semi shipments (one per week) Sign Requirements: None We do not do any manufacturing outside of the building and we do not paint any of our products. We do not use any harmful chemicals. We do use liquid oxygen, nitrogen, and propane for our manufacture and fabrication of products. These are only in approved vessels or containers and stored in compliance with cylnder requirments. We are aware of the residual noise of the area and the limits the zoning law has, and feel we can comply to these with a few changes, (doors closed, baffle screens). Enclosed are some pictures of some of the equipment we fabricate. Also a floor layout of our shop. Copy of change of use from Divison 5 to Western Cascade, and a letter from the City of Tukwila to Western Cascade. PROCESS The City of Tukwila considers this request to determine if there has been no change from one nonconforming use to another nonconforming use to be a Code Interpretation. The Review and Decision process for Code Interpretations are made by the Director of Community Development as Type 2 decisions, as reflected in TMC 18.104. The determination by the Director is to conclude if the use is a permitted use in this zone. The evaluation if there is no change of use is based on review of TMC 18.70 (5). This section reads: "If a change of use is proposed to a use determined to be nonconforming by application of provision in this title, the proposed new use must be a permitted use in its zone or a use approved under a Conditional Use or Unclassified Use Permit process, subject to review and approval by the Planning Commission and /or City Council. For the purposes of implementing this section, a change of use constitutes a change from one Permitted, Conditional or Unclassified Use to another such use category as listed within the Zoning Code" FINDINGS Attachment A is a description of Division Five activities from June, 1995 to the present. Attachment B is a copy of Division Five's 1999 City Business License. When Division Five obtained it's first business license on May 15, 1995, it was located in the M -2 Zone.
