Rick Still, Parks and Recreation Director BY: Dave Johnson, Recreation Superintendent DATE: February 4, 2015 SUBJECT: Golf Cart Purchase ISSUE Purchase Golf Carts at Foster Golf Links BACKGROUND Foster Golf Links (FGL) averages over 14,000 power cart rentals per year with average annual revenue over $169,000 over the past 5 years. Cart rentals are the 2nd largest revenue producer at FGL behind Greens Fees. FGL currently has 58 power carts in our fleet inventory divided between 2 manufacturers. We have 24 Club Car carts that were purchased in 2005, and 34 EZ- GO carts that were purchased in 2011. FGL has built a cart replacement plan into its operating budget by allocating $63,557 per year in 2015 and 2016. Beginning in 2017, that amount is $42,000. DISCUSSION The purchase of these 13 carts will expand our fleet from 58 carts. By expanding the fleet, we will be able to improve efficiency and customer service by being able to better serve our large tournaments, host more large tournaments, and have better cart availability on busy days. Between May 15 and September 15, 2014, we were short on carts for 86 of the 124 days. With the implementation of the aeration program at FGL as described at earlier meetings, the amount of playable days at FGL will increase during the shoulder season and off season. The new carts will be outfitted with weather protection for both golfer and equipment. Under our plan, we will purchase 13 new EZ -GO TXT carts. Beginning in 2016, we will purchase 10 -14 carts annually and begin to trade in our older fleet, beginning with the Club Car carts. This will allow us to rotate the inventory every 6 years and balance the expenditures over time as opposed to a large lump sum purchase. Purchasing EZ -GO carts will provide consistency within our fleet for ease of maintenance and transferability of parts. The new carts will be outfitted with hour - clocks, bag covers, canopy top, 3 -sided weather enclosure, message holder, custom logo as well as the specs attached. 1 2 INFORMATIONAL MEMO 1 -26 -13 Foster Golf Links — Golf Cart Purchase Page 2 The carts will be purchased under the National Intergovernmental Purchasing Alliance (NIPA). EZ -GO and the City are members of NIPA which similar to a state bid purchasing process. Additionally, since the carts will be rented back to the public, our resale certificate waives the sales tax charge on the purchase. RECOMMENDATION It is the recommendation of the Parks & Recreation Department that the Community Affairs and Parks Committee forwards this item to the Consent Agenda at the February 17, 2015 Regular Meeting. ( "Company') provides that any new Model Year 2015 E -Z -GO RXV Fleet and TXT Fleet gasoline or electric vehicle (the "Vehicles ") and /or battery charger purchased from E -Z -GO, an E -Z -GO affiliate, or an authorized E -Z -GO dealer or distributor, or leased from a leasing company approved by E -Z -GO, shall be free from defects in material or workmanship under normal use and service (the "Limited Warranty "). Added electrical components not part of original Vehicle drive system equipment that consume less than .4 amps shall reduce the amp hour battery warranty by ten percent (10 %). See reverse for other battery warranty limitations, conditions and exceptions. The Warranty Period for all parts and components of the Vehicle other than Deep Cycle Batteries shall commence on the date of delivery to the Purchaser's location or the date on which the Vehicle is placed in Purchaser- requested storage. The Warranty Period for Deep Cycle Batteries shall commence on the earliest of the date: (a) of Vehicle delivery to the Purchaser's location, (b) on which the Vehicle is placed in Purchaser - requested storage or (c) that is one (1) year from the date of sale or lease of the Vehicle by E -Z -GO to an authorized E -Z -GO dealer or distributor. Parts repaired or replaced under this Limited Warranty are warranted for the remainder of the length of the Warranty Period. This Limited Warranty applies only to the Purchaser and not to any subsequent purchaser or lessee without the prior written approval of the Customer Care / Warranty Department. EXCLUSIONS: Specifically EXCLUDED from this Limited Warranty are: • routine maintenance items, normal wear and tear, cosmetic deterioration or electrical components damaged as a result of fluctuations in electric current; • damage to or deterioration of a Vehicle, part or battery charger resulting from inadequate maintenance, neglect, abuse, accident or collision; • damage resulting from installation or use of parts or accessories not approved by Company, including but not limited to subsequent failures of the Vehicle, other parts or the battery charger due to the installation and /or use of parts and accessories not approved by Company; • warranty repairs made by other than a Company branch or an authorized and qualified Dealer designee. Warranty repairs by other than a Company branch or an authorized and qualified Dealer or designee shall void the Limited Warranty; • damage or loss resulting from acts of nature, vandalism, theft, war or other events over which Company has no control; • any and all expenses incurred in transporting the Vehicle to and from the Company or an authorized and qualified Dealer, distributor or designee for warranty service or in performing field warranty service; and • any and all expenses, fees or duties incurred relative to inbound freight, importation, or customs. THIS LIMITED WARRANTY MAY BE VOIDED OR LIMITED AT THE SOLE DISCRETION OF E -Z -GO IF THE VEHICLE AND /OR BATTERY CHARGER: • shows indications that routine maintenance was not performed per the Owner's Manual, including but not limited to rotation of fleet, proper tire inflation, lack of charging, inadequate battery watering, use of contaminated water, loose battery hold downs, corroded battery cables and loose battery terminals; • lacks an adequate number of operating battery chargers, uses unapproved battery chargers or uses extension cords with battery chargers; • is fueled with unleaded gasoline containing more than 10% ethanol, E85 ethanol fuel or other non - recommended fuels, contaminated gasoline or other non - recommended lubricants; • shows indications that the speed governor was adjusted or modified to permit the Vehicle to operate beyond E -Z -GO specifications; • shows indications it has been altered or modified in any way from E -Z -GO specifications, including but not limited to alterations to the speed braking system, electrical system, passenger capacity or seating; • has non - Company approved electrical accessories or electrical energy consuming devices installed on a gasoline powered Vehicle without installation of a heavy duty 12V battery; or • is equipped with non - standard tires not approved by Company. Failure to do so will void the battery warranty. A Purchaser who is unable to log onto the web site should call or write the E -Z -GO Customer Care /Warranty Department using the contact information below or Purchaser's local dealer or distributor within forty -five (45) days of delivery of the Vehicle. • Claims for battery warranty replacement require specific testing, as specified by the E -Z -GO Customer Care / Warranty Department. E -Z -GO, or an authorized E -Z -GO dealer or distributor, should be contacted to obtain a copy of the required tests, which must be performed and corrected for temperature, based upon BC] (Battery Council International) recommendations. • NON - FACTORY INSTALLED PARTS OR ACCESSORIES INSTALLED DIRECTLY TO LESS THAN THE COMPLETE VEHICLE BATTERY PACK WILL VOID THE WARRANTY FOR THE ENTIRE BATTERY PACK. • ALL NON - FACTORY INSTALLED ACCESSORIES REQUIRE THE INSTALLATION AND USE OF AN E -Z -GO APPROVED DC TO DC CONVERTER THAT USES ENERGY FROM ALL BATTERIES. • Electric Vehicle storage facilities must provide the following: • ample electrical power to charge all Vehicles and allow the charger to shut off automatically; • battery chargers must each have an independent dedicated 15 amp circuit; each battery charger must be connected to its circuit with at minimum a NEMA 15 -5R three -pin receptacle; five (5) air exchanges per hour in the charging facility; if the facility utilizes an electrical energy management system, the timer must be set to have available fourteen (14) hours of electricity; and one (1) functional charger for each Vehicle in the fleet with a proper electrical supply as specified above. OTHER E -Z -GO RIGHTS: • E -Z -GO may perform semi - annual vehicle inspections (directly or through assigned E -Z -GO representatives) through the term of any fleet lease. • E -Z -GO may improve, modify or change the design of any E -Z -GO vehicle, part or battery charger without being responsible to modify previously manufactured vehicles, parts or battery chargers. • E -Z -GO may audit and inspect the Purchaser's facility, maintenance records and its Vehicles by E -Z -GO representatives prior to approving a warranty claim and may contract with a third party to evaluate the Purchaser's storage facilities, fuel storage tanks and /or batteries. • THE WARRANTY FOR ALL VEHICLES IN A FLEET SHALL BE VOIDED IF DATA SUBMITTED FOR AN INDIVIDUAL VEHICLE WARRANTY CLAIM CONTAINS FALSE OR MISLEADING INFORMATION. AUTHORITY: No E -Z -GO employee, dealer, distributor or representative, or any other person, has any authority to bind E -Z -GO beyond the terms of this Limited Warranty without the express written approval of the E -Z -GO Customer Care / Warranty Department. BACKGROUND Many cities use street banners to advertise and promote city events. The banners can be divided into two categories. The first are light pole and utility pole banners, the type that the City used as part of its centennial. Figure 1 below is a representation of a typical light pole street banners. Figure 1: Light Pole Banners. 11 12 INFORMATIONAL MEMO Page 2 A second type of banner are street width banners that extend above and across a roadway and advertise specific events. As part of the City's centennial the City installed light pole banners throughout the Southcenter area, West Valley Highway and Tukwila International Blvd. The City's sign code at the time had a very broad exemption that permitted the Public Works Director to approve such signs. In 2010 the City adopted a new sign code and the exemptions for signs permitted in the right of way is narrow. In order to accommodate these banners the City needs to make a minor amendment to the Sign Code, Title 19. Many cities use banners in their downtown areas to promote events and activities, both private and public events. These events are either tied to community building or promoting tourism within the City. Last year the Sounders announced that its 2nd team will begin playing its inaugural season this spring, with all of the home games being played at Starfire. The Sounders have already sold 1,500 season tickets it's likely that the games at Starfire will be sold out. Economic Development has been working with the Sounders to create "fan hotspots" at restaurants and hotels where fans can hang out before and after the games. The City's retail sales tax and lodging tax will likely see a positive impact from the Sounder's games. Economic Development would like to install the first round of light pole banners to promote the Sounders games at Starfire. These light pole banners would be similar to the light pole banners installed by the City of Renton to promote the Seahawks. Cost of the banners, which is about $100 each, including installation, would be paid by the City's Lodging Tax funds and the City would also look for private contributions to install the banners. The first round of banners will be installed in key access routes to and from Starfire. In the future, banners, both the light pole banners and the street width banners could be used to promote a wide variety of events and activities. These could include Parks and Recreation events (Touch a Truck, Family Fourth at the Fort, etc), holiday shopping activities, and other events that draw tourist from outside the City. Staff proposes that the following language be added: "Banners within the City's right of way, located on light poles, street light signal poles, and hanging above the right of way when approved by the Director of Public Works or designee". FINANCIAL IMPACT None. Adopting the language that creates an exception in the TMC does not create a financial impact nor does it create an obligation for the City to install the banners. In the future, staff intends to request that the City Council authorize the use of lodging tax funds to allow the installation of street pole banners. RECOMMENDATION Forward to the February 23, 2015 Committee of the Whole meeting for discussion. Adoption of the Ordinance could occur at the March 2, 2015 regular council meeting. WHEREAS, the City Council of the City of Tukwila recognizes that signs are an important component of the built environment and assist in way- finding, advertising and personal expression for Tukwila businesses, property owners and residents; and WHEREAS, regulation of signage is needed in order to preserve and protect the public welfare, preserve and enhance the appearance of the built environment, control visual clutter, protect private and public property, and ensure the orderly movement of motorized and non - motorized forms of transportation; and WHEREAS, on August 16, 2010, the Tukwila City Council adopted a new, comprehensive Sign Code for the City of Tukwila, which is codified in Title 19 of the Tukwila Municipal Code; and WHEREAS, the City Council desires to use street banners to promote events and activities in the City that will draw tourists from outside of the City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. TMC Section 19.12.030 Amended. Ordinance Nos. 2375 §5 and 2303 §3 (part), as codified at Tukwila Municipal Code (TMC) Chapter 19.12.030, "Exceptions — Sign Permits Not Required," are hereby amended to read as follows: 19.12.030 Exceptions — Sign Permits Not Required The following shall not require issuance of permits by the City. The exception is only from the need to obtain a permit and shall not be construed as relief from compliance with other requirements of this title. Repainting of an existing sign when there is no other alteration. This exception shall not be interpreted to allow the changing of copy or face changes on an existing sign. 2. Refacing, panel change or copy change on existing conforming, monument signs that have valid Tukwila sign permits as permitted by TMC Sections 19.20.030 (B)(7), 19.20.040 (6), or 19.32.075. 3. Temporary signs and decorations customary for holidays, such as Independence Day and Thanksgiving, erected on private property. Signs may only contain non - commercial speech. 4. Temporary window signs, subject to the limitations of TMC Section 19.24.080. 5. Traffic signs and /or markings installed by the City of Tukwila, King County or Washington State Department of Transportation for the purpose of regulating, warning or directing traffic. Signs may be installed within the right -of -way or on private property, with the permission of the property owner. All signs installed under this exception shall meet the requirements of the Manual on Uniform Traffic Control Devices for Streets and Highways, current edition, published by the U.S. Department of Transportation. 6. Signs typically installed on utilities and wireless communication facilities denoting danger or other safety information, including emergency contact information. 7. Political campaign signs, subject to the limitations of TMC Section 19.24.090. 8. Temporary signs installed at City parks. All signs shall be approved by the Tukwila Director of Parks and Recreation and shall meet the requirements of this code. 9. Land use notice boards per TMC Section 18.104.110. 10. Text or graphics on umbrellas located in outdoor seating or plaza areas. 11. Up to four directional signs per premises where there is a need to direct vehicular traffic. Freestanding signs may be up to three feet in height and two square feet per face or a total of four square feet for all faces. Flush- mounted building signs may be up to three square feet in size. 12. The following exceptions are specific to properties developed with residential uses in residential zones: a. Each residential property shall be permitted one 6- square -foot banner or rigid sign that is temporary in nature; and c. No individual sign may exceed six square feet in size. It is intended that this subsection shall apply to garage sale and real estate "open house" signs, however content of the sign is not restricted. 13. Display of up to three flags, each on individual flag poles, per premise. Content of the flags is not regulated. 14. Banners within the City's right -of -way, located on City -owned light poles, City -owned street light signal poles, or hanging above the right -of -way when approved by the Director of Public Works or designee. Section 2. Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state or federal laws, codes, rules, or regulations; or ordinance numbering and section /subsection numbering. Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five days after passage and publication as provided by law.
