BACKGROUND The Notice to Proceed for Contract No. 14-089 with Miles Construction Inc., of Tacoma, Washington was issued on July 11, 2014 for the 2014 Overlay and Repair Project. This overlay project provided hot mix asphalt (HMA) paving at eight locations throughout the City and overlay of a portion of the parking lot at Fort Dent Park. The street improvements included; paving; removing and replacing concrete curbs, gutters, sidewalks and ADA ramps; installing traffic loops and junction boxes; adjusting surface utilities to grade; and installing roadway channelization. ANALYSIS Construction was physically completed on November 7, 2014. Two change orders were executed to include additional work for electrical junction boxes and a time extension. Asphalt quantities and pavement repairs were less than expected and the major factors in a cost savings of $104,773.25. No retainage was withheld by the City for this project as there was a contractor retainage bond. The total budget for the 2014 Overlay & Repair Project was $1,123,283.70 and included a 5% contingency, which was not expended on this project. The City was unsuccessful in receiving any grant funding for 53rd Ave S for the 2015/2016 grant cycle. The 2014 Transportation Chair suggested and received Council approval to propose moving forward with design of 53rd Ave S with 100% City funds. Once 53rd Ave S is designed and "shovel ready ", it will be better situated for the possibility of receiving future construction grant funding. DISCUSSION The current 2015 CIP shows $174,000 in grant revenue and $116,000 in City funds for 53rd Ave S Residential Street Improvements and $120,000 in grant revenue for 53rd Ave S Surface Water Improvements. Since the grant funding is unavailable, it is proposed that a budget amendment (scheduled for June 2015) include the increase in City funding for the 53rd Ave S Residential Street Improvements. The 53rd Ave S Sewer Rehabilitation Project has $830,000 in expenditures for 2015/2016 for slip lining the sewer main and $7 million scheduled in beyond for full replacement. After recent investigations of the sewer main, only slip lining is needed and the $7 million in the out years will be removed. FINANCIAL IMPACT RECOMMENDATION Information only. This TMC section also authorizes the Public Works Director to allow the developer to pay the City for the iOOpPDVeOOHDtS in lieu Of CODSt[U[tiOg the improvements themselves. In that situation, the TMC specifies that the payment must be made before the City issues a building permit to the developer. The Ordinance attached includes the proposed revisions to TMC 11.12.030. FISCAL IMPACT This item has no budget impact to the City. RECOMMENDATION The Council is being asked to amend Ordinance No. 1995 setting required improvements for new buildings and developments and consider this item @t the February 23'2O15 Committee Of the Whole meeting and subsequent March 2'2O15 Regular Meeting. WHEREAS, public street frontage improvements such as water, sewer, surface water drainage, curbs, gutters, sidewalks, driveways, streets and other infrastructure are necessary to support development; and WHEREAS, the City requires developers to construct street frontage improvements or to provide a payment-in-lieu, and WHEREAS, in some instances it may be in the City's best interest to allow the property owner to proceed with construction prior to constructing the improvements or paying the payment-in-lieu; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. TMC Section 11.12.030 Amended. Ordinance No. 1995 §1 (part), as delineated in Attachment A to Ordinance No. 1995 and codified at Tukwila Municipal Code Section 11.12.030, "Street Frontage Improvements," is hereby amended to read as follows: 11.12.030 Street Frontage Improvements (See TMC Title 17 for further detail) A. The installation of street frontage improvements is required prior to issuance of a certificate of occupancy for new construction, other than single-family homes, or prior to final approval for subdivisions and 5-9 lot short plats and Planned Residential Developments. Complete street frontage improvements shall be installed along the entire frontage of the property at the sole cost of the permittee as directed by the Director. Street frontage improvements may include curb, gutter, sidewalk, storm drainage, street lighting, traffic signal equipment, utility installation or relocation, landscaping strip, street trees and landscaping, irrigation, street widening, and channelization. Beyond the property frontage, the permittee shall provide ramps from the new sidewalk or walkway to the existing shoulder, and pavement and channelization tapering back to the existing pavement and channelization as needed for safety. C. When (due to site topography, city plans for improvement projects, or other similar reasons) the Director determines that street frontage improvements cannot or should not be constructed at the time of building construction, the property owner shall, prior to issuance of the building permit, at the direction and discretion of the Director: 1. Enter into an agreement to P-pay to the City an amount equal to the property owner's cost of installing the required improvements. At the direction and discretion of the Director, the property owner shall be required to provide a bond or other financial security for its payment obliqation, The property owner shall provide documentation satisfactory to the Director that establishes the cost of the materials, labor, and quantities; or 2. Record an agreement which provides for these improvements to be installed by the property owner by a date acceptable to the Director; or 3. Record an agreement to not protest a local improvement district to improve the street frontage. D. If, at a time subsequent to the issuance of a building permit, a local improvement district is established that includes the property for which the building permit was issued, the property may be considered in the compilation of the local improvement district assessment with the appropriate amount of costs of construction expended by the developer. E. The Director under either of the following conditions may waive the requirement for installation of frontage improvements: 1. If adjacent street frontage improvements are unlikely to be installed in the foreseeable future; or 2. If the installation of the required improvement would cause significant adverse environmental impacts. Section 2. Corrections by City Clerk or Code Reviser. Upon approval of the City Attorney, the City Clerk and the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state or federal laws, codes, rules, or regulations; or ordinance numbering and section/subsection numbering. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five days after passage and publication as provided by law. Reports, Communications and Citizens Requests to Comment The Board voted to update the SCATBd legislative message brochure and recommended that it be revised so that it would be relevant for a number of years. Councilmember Jenkins volunteered to lead the SCATBd brochure revision effort. Vice Chair Ralph reported that the PSRC Transportations Policy Board recommended the Executive Board adopt the PSRC's legislative message to the State Legislature at their next meeting. Councilmember Jenkins reported on her testimony before the Energy, Environment and Telecommunications Committee on Senate Bill 5057 regarding Oil Train. III. SR 167 Discussion — Tom Pierson, CEO, Tacoma /Pierce County Chamber of Commerce /Tim Thompson Consulting Group Mr. Pierson and Mr. Thompson briefed the Board on the SR 167 Completion Coalition effort to get the SR 167 and SR 509 project funded by passing a statewide transportation package. They said that there needs to be a candid conversation with our elected and the public about our willingness to compete in the world economy and improve our transportation infrastructure such as SR 167 and SR 509. They urged the Board to contact their Senators and Representatives about the importance of completing the two corridors, and said they were optimistic about the chances of having a statewide transportation package passed this legislative session. IV. Sound Transit Future Planning — Joe McDermott, King County Councilmember /ST Board Member Councilmember McDermott briefed the Board on Sound Transit's long range plans for the South County area. He briefed the Board Sound Transit's current Link light rail projects and ridership `Ai Attachment A projections for the system. Mr. McDermott also reviewed survey results that showed a favorable rating for Sound Transit and for Link expansion plans, and discussed Sound Transit's effort at the State Legislature new taxing authority so they can put a transit expansion measure on the ballot sometime in the future V. 2015 Legislative Discussion — Rachel Smith, King County Director of Government Relations Ms. Smith briefed the Board on Governor Inslee's transportation budget and on King County's transportation legislative agenda. The Governor's budget included funding for a number of mega projects such as SR 520, I-405, SR 509, SR 167, funding for ferries, transit, bike and pedestrian projects. Regarding a statewide transportation package Ms. Smith reported there was strong agreement that the Senate needs to pass out transportation package first. She said King County is supporting more funding for transit and speed and reliability projects.
