DATE ATTACHMENTS 2/23/15 Informational memorandum dated 2/2/15 Ordinance Minutes from the Community Affairs and Parks meeting of 2/9/15 3/2/15 1 2 TO: Jim Haggerton, Mayor INFORMATIONAL MEMORANDUM Mayor Haggerton Community Affairs and Parks FROM: Brandon Miles, Economic Development Liaison DATE: February 2, 2015 SUBJECT: Display of Street Banners ISSUE Amending Title 19 "Sign Code" of the Tukwila Municipal Code (TMC) to permit the display of street banners to promote events and festivals within the City. BACKGROUND Many cities use street banners to advertise and promote city events. The banners can be divided into two categories. The first are light pole and utility pole banners, the type that the City used as part of its centennial. Figure 1 below is a representation of a typical light pole street banners. Figure 1: Light Pole Banners. 3 4 INFORMATIONAL MEMO Page 2 A second type of banner are street width banners that extend above and across a roadway and advertise specific events. Figure 2 shows a typical street width banner. "VOuuuuuddddddddili' ,11::1,,,:11:11:1::11:111:11:111:111111:11:11:11:11:11:11: 1111111111111111::::111111111, ■ Figure 2: Street Width Banner. As part of the City's centennial the City installed light pole banners throughout the Southcenter area, West Valley Highway and Tukwila International Blvd. The City's sign code at the time had a very broad exemption that permitted the Public Works Director to approve such signs. In 2010 the City adopted a new sign code and the exemptions for signs permitted in the right of way is narrow. In order to accommodate these banners the City needs to make a minor amendment to the Sign Code, Title 19. Many cities use banners in their downtown areas to promote events and activities, both private and public events. These events are either tied to community building or promoting tourism within the City. Last year the Sounders announced that its 2nd team will begin playing its inaugural season this spring, with all of the home games being played at Starfire. The Sounders have already sold 1,500 season tickets it's likely that the games at Starfire will be sold out. Economic Development has been working with the Sounders to create "fan hotspots" at restaurants and hotels where fans can hang out before and after the games. The City's retail sales tax and lodging tax will likely see a positive impact from the Sounder's games. Economic Development would like to install the first round of light pole banners to promote the Sounders games at Starfire. These light pole banners would be similar to the light pole banners installed by the City of Renton to promote the Seahawks. Cost of the banners, which is about $100 each, including installation, would be paid by the City's Lodging Tax funds and the City would also look for private contributions to install the banners. The first round of banners will be installed in key access routes to and from Starfire. In the future, banners, both the light pole banners and the street width banners could be used to promote a wide variety of events and activities. These could include Parks and Recreation events (Touch a Truck, Family Fourth at the Fort, etc), holiday shopping activities, and other events that draw tourist from outside the City. C:\ Users\ Brandon- m\AppData \Local \Microsoft \Windows \Temporary Internet Files\Content.Outlook\ 1 4Z3QFF6\ Draft Memo.doc INFORMATIONAL MEMO Page 3 DISCUSSION In order to permit street banners to be installed an exception to TMC 19.12.030 needs to be added. Staff proposes that the following language be added: "Banners within the City's right of way, located on light poles, street light signal poles, and hanging above the right of way when approved by the Director of Public Works or designee" FINANCIAL IMPACT None. Adopting the language that creates an exception in the TMC does not create a financial impact nor does it create an obligation for the City to install the banners. In the future, staff intends to request that the City Council authorize the use of lodging tax funds to allow the installation of street pole banners. RECOMMENDATION Forward to the February 23, 2015 Committee of the Whole meeting for discussion. Adoption of the Ordinance could occur at the March 2, 2015 regular council meeting. BUSINESS AGENDA A. Golf Cart Purchase — Foster Golf Links Staff is seeking Council approval to purchase 13 new EZ -GO TXT golf carts for a total of $63,557.00, thus expanding the total fleet to 71 carts. Foster Golf Links (FGL) averages over 14,000 power cart rentals per year with average annual revenue over $169,000. Expansion of the fleet is needed because between May 15 and September 15, 2014, there was a cart shortage for 86 of 124 days. FGL's operating budget includes a cart replacement plan so that expenditures will be balanced evenly and eventually the entire fleet will be EZ -GO, resulting in streamlined maintenance and transferability of parts. The purchase will be made under the National Intergovernmental Purchasing Alliance (NIPA) and the sales tax is waived because the carts are rented back to the public. Because of the six -year lifespan of the carts, it is expected that rental fees will pay back the cost within the first few years, turning to profit thereafter even when factoring in gas, maintenance and storage. APPROVAL. FORWARD TO FEBRUARY 17, 2015 REGULAR CONSENT AGENDA. B. Ordinance: Amending Tukwila Municipal Code Section 19.12.030 Staff is seeking Council approval of an ordinance that would amend Tukwila Municipal Code Section 19.12.030 (Exceptions — Sign Permits Not Required) to allow the Public Works Director to approve banners within the right -of -way, on City -owned light poles and signal poles, or hanging above the right -of -way. This will allow the City to use street banners to advertise and promote events in pursuit of building community and /or promoting tourism. Staff is currently working with the Sounders on promotional opportunities for its 2nd team, Sounders 2, which is premiering this Spring. Staff would like to install the first round of light pole banners to promote these games and intends to pursue funding from the City's lodging tax in combination with private donors. The City previously used light pole banners as part of the City's centennial celebration but when the sign code was revised in 2010 this exception was eliminated. If approved, this amendment would once again allow this opportunity. UNANIMOUS APPROVAL. BACKGROUND Tukwila Municipal Code Section 11.12.030 requires developers to install street frontage improvements prior to receiving a certificate of occupancy. This TMC section also authorizes the Public Works Director to allow the developer to pay the City for the improvements in lieu of constructing the improvements themselves. In that situation, the TMC specifies that the payment must be made before the City issues a building permit to the developer. DISCUSSION In some situations, it may be in the City's interest to allow the developer to make payments for the street frontage improvements after the City has issued a building permit. For example, the City is designing and will construct improvements to South 144th Street between Tukwila International Boulevard and 42nd Avenue South. The Tukwila Village developer (TVDA) and King County Library System (KCLS) will pay toward the S 144th St street improvements. It is very likely that TVDA and KCLS will want to pull building permits well before the City is ready to start construction of the street improvements. It does not seem reasonable to require the developer payments far in advance of when the City starts street improvement construction. The Ordinance attached includes the proposed revisions to TMC 11.12.030. FISCAL IMPACT This item has no budget impact to the City. RECOMMENDATION The Council is being asked to amend Ordinance No. 1995 setting required improvements for new buildings and developments and consider this item at the February 23, 2015 Committee of the Whole meeting and subsequent March 2, 2015 Regular Meeting. Complete street frontage improvements shall be installed along the entire frontage of the property at the sole cost of the permittee as directed by the Director. Street frontage improvements may include curb, gutter, sidewalk, storm drainage, street lighting, traffic signal equipment, utility installation or relocation, landscaping strip, street trees and landscaping, irrigation, street widening, and channelization. Beyond the property frontage, the permittee shall provide ramps from the new sidewalk or walkway to the existing shoulder, and pavement and channelization tapering back to the existing pavement and channelization as needed for safety. C. When (due to site topography, city plans for improvement projects, or other similar reasons) the Director determines that street frontage improvements cannot or should not be constructed at the time of building construction, the property owner shall, prior to issuance of the building permit, at the direction and discretion of the Director: 1. Enter into an agreement to Ppay to the City an amount equal to the property owner's cost of installing the required improvements. At the direction and discretion of the Director, the property owner shall be required to provide a bond or other financial security for its payment obligation. The property owner shall provide documentation satisfactory to the Director that establishes the cost of the materials, labor, and quantities; or 2. Record an agreement which provides for these improvements to be installed by the property owner by a date acceptable to the Director; or 3. Record an agreement to not protest a local improvement district to improve the street frontage. D. If, at a time subsequent to the issuance of a building permit, a local improvement district is established that includes the property for which the building permit was issued, the property may be considered in the compilation of the local improvement district assessment with the appropriate amount of costs of construction expended by the developer. E. The Director under either of the following conditions may waive the requirement for installation of frontage improvements: 1. If adjacent street frontage improvements are unlikely to be installed in the foreseeable future; or 2. If the installation of the required improvement would cause significant adverse environmental impacts. Section 2. Corrections by City Clerk or Code Reviser. Ordinance: Amending Tukwila Municipal Code Section 11.12.030 — Street Frontage Improvements Staff is seeking Council approval of an ordinance that would amend Tukwila Municipal Code Section 11.12.030 to allow flexibility in the timing of developer payments for street frontage improvements. The current code requires that developers install frontage improvements prior to receiving a certificate of occupancy. It also authorizes the Public Works Director to allow the developer to pay the City for the improvements in which case the payment must be made prior to issuance of a building permit. The proposed ordinance would allow a developer to enter into an agreement with the City regarding these payments, subject to the approval of the Public Works Director, and to provide a bond or other security for this obligation. Staff believes there are certain developments where it is unreasonable to require payment far in advance of when the City is ready to begin street construction, and this code amendment will allow that flexibility when appropriate.
