HomeMy WebLinkAbout95-111 - Solly Bruce / Solly Nancy - Possession and Use AgreementPOSSESSION AND USE AGREEMENT In the Matter of q -i.. /1/ IQ/ This AGREEMENT is made and entered into by and between the City of Tukwila, hereinafter referred to as the "City", and the undersigned, hereinafter referred to as the "Owners": WITNESSETH WHEREAS, the City affirms that any delay in its construction program is contrary to the public interest: AND WHEREAS, the City has made a firm and continuing offer to pay the amount of $ 12,500.00 for the purchase of the following described real estate situated in King County, in the State of Washington: Brookvale Garden tracts Portion of Lot 2 laying westerly of westerly MGN of 52nd Avenue South and southerly of southerly MGN of Southcenter Blvd. also known as Three Tree Point Road. AND WHEREAS. the owners require time to evaluate said firm offer and/or to resolve any questions concerning just compensation: NOW THEREFORE, it is agreed that: 1. The above described real estate is necessary for a public use of the City of Tukwila. 2. The City will issue a warrant in payment to the owners of the amount of the firm offer stated above, subject only to deduction of the value of interests of others therein. 3. If it becomes necessary for the City to institute condemnation proceedings, the owners have no objection to the City's forthwith entering of an Order Adjudicating Public Use provided by RCW 8.04.170 and that this instrument will be treated as and accorded the same provisions as the Order for Immediate Possession provided by RCW 8.04.090, et seq. 4. The Owners hereby waive the requirement of a written notice to move, as provided by RCW 8.26.180, and will surrender possession of the above described real estate to the City not later than October 31, 1995. It is understood and agreed that the delivery of this agreement is hereby tendered and that the terms and obligations hereof shall not become binding upon the City of Tukwila unless and until accepted and approved hereon in writing for the City of Tukwila, authorized representative.
