An ordinance of the City of Tukwila amending Section 8.80.020 of the TMC to add the adoption by reference of the Washington Clean Indoor Air Act, proscribing smoking in certain public places, requiring owners to post signs prohibiting or permitting smoking and establishing penalties for violations of the section. d. A resolution of the City Council of the City of Tukwila accepting the turnover of sidewalks, curbs, gutters, associated drainage and utility relocations adjacent to Tukwila Parkway, Andover Park East and Evans Black Drive constructed by Office and Warehouse Properties, Inc. e. A resolution of the City Council of the City of Tukwila accepting the turnover of the developed portion of 57th Ave. So. west of Interurban Ave. So., including roadway, storm sewer and associated public improvements, constructed by Western Pacific Properties, Inc. f. Budget Transfer Motion No. 86 -01, to provide professional assistance for unemployment claims against the City and to reduce liability for such claims. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED.* Councilman Bauch asked to have Items b. (Approval of Vouchers) and c. (Ordinance proscribing smoking in certain places) removed from the Consent Agenda. TUKWILA CITY COUNCIL REGULAR MEETING May 5, 1986 Page 2 BID AWARDS Allow Administration to order new aid unit NEW BUSINESS Motion to accept Christensen Green- belt, Phase III Project, Trail Const. Item 6b, Approval of Vouchers Item 6c, Ordinance #1387 to add the adoption by reference of the Wash., Clean Indoor Air Act, proscribing smoking in certain public places MOVED BY MORGAN, SECONDED BY SIMPSON, THAT COUNCIL APPROVE THE BID AWARD AS STATED IN THE PACKET.* Councilman Bauch verified that the box of the aid car is transferable to a new chassis. This was concurred with in a letter from the Fire Chief. Council is approving the base bid of $53,660 plus Washington State Sales Tax presented by Rescue Safety Products with Road Rescue, Inc. as builder. This bid does not include the Motorola radio or the siren. *MOTION CARRIED. MOVED BY DUFFIE, SECONDED BY HARRIS, TO ACCEPT CHRISTENSEN GREENBELT, PHASE III.* Council Member Phelps noted a couple of problems along the trail. There are two trees that are staked with a piece of rebar around the corner from the Old National Bank building and the staking is inadequate so the root system is exposed. The second problem is that plants and weeds are growing through the asphalt. Also, there was a stack of concrete pieces north of the 180th bridge that needs to be cleared up. They are a hazard for bicycles. *MOVED BY PHELPS, SECONDED BY DUFFIE, THAT THE MOTION BE AMENDED TO MOVE THIS ITEM FORWARD TO A FUTURE CITY COUNCIL MEETING PENDING A REPORT FROM THE ADMINISTRATION. MOTION CARRIED. Councilman Bauch noted that the Fire Department purchased Exercise Equipment for $404.63 from line item 31 which is Miscellaneous Supplies. This was not a budgeted item. They needed the signatures of three Council Members to purchase equipment. He asked to have this voucher removed. MOVED BY BAUCH, SECONDED BY MORGAN, THAT THIS ITEM BE REFERRED TO THE PUBLIC SAFETY COMMITTEE AND THAT THE REMAINDER OF THE VOUCHERS BE APPROVED. MOTION CARRIED. MOVED BY MORGAN, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Haney read an ordinance of the City of Tukwila, amending Section 8.80.020 of the Tukwila Municipal Code to add the adoption by reference of the Washington Clean Indoor Air Act, RCW 70.160.020 -.070, proscribing smoking in certain public places, requiring owners to post signs prohibiting or permitting smoking, and establishing penalties for violations of the section; directing the clerk to maintain on file a copy of state statutes adopted by reference and establishing an effective date. MOVED BY MORGAN, SECONDED BY HARRIS, THAT ORDINANCE NO. 1387 BE ADOPTED AS READ.* Councilman Bauch said this is a case of the State passing a law and passing the costs on to the City, and he said he doesn't believe the State should pass ordinances and pass enforcement onto Cities. *MOTION CARRIED WITH BAUCH VOTING NO. MISCELLANEOUS Donate Police Car Street Lights ADJOURNMENT MOVED BY BAUCH, SECONDED BY PHELPS, THAT THE MAYOR BE AUTHORIZED TO TALK TO THE MAYOR OF THE TOWN OF PACIFIC AND OFFER TO DONATE A POLICE CAR TO THEM.* Attorney Haney said the City is required by RCW to hold a public hearing prior to disposing of the property. *MOTION CARRIED. Council Member Harris commented that the City used to pay for street lights by the number of lights whether they were on or off. With the number of street lights that are off, we should amend the contract or see that we get better service. She asked to have someone check and see if we are still paying the same way. Mayor Van Dusen said the City is having problems getting the lights repaired. 7:50 p.m. MOVED BY HARRIS, SECONDED BY MORGAN, THAT THE REGULAR MEETING OF THE TUKWILA CITY COUNCIL ADJOURN.
