Such services shall be provided in a manner which fully complies with all applicable federal, state and local laws, statutes, rules and regulations, as are now in effect or may be hereafter amended. 1) Project Summary The Agency shall use CDBG funds for eligible costs related to the purchase and installation of a new play structure and soft surface material at the Foster/Lee Phillips Playground at 13919 53rd South, Tukwila, King County. 2) Project Budget The Agency shall apply the following County funds to the project in accordance with the Line Item Budget Summary below: A. Project Files The Agency shall maintain files for this project containing the following items: 1. Notice of Grant Award. 2. Motions, resolutions, or minutes documenting Board or Council actions. 3. A copy of this Scope and the County's notice to proceed on this project. 4. Correspondence regarding budget revision requests. 5. Copies of all invoices and reports submitted to the County for this project. 6. Bills for payment. 7. Copies of approved invoices and warrants. 8. Documentation of the solicitation process used to select vendors and subcontractors with original purchase orders and subcontracts. 5) Invoicing Project Scope of Services No.1 - Page 2 • • The Agency shall submit invoices to the County within 10 business days after the end of each quarter in which the Agency incurs costs reimbursed under this Contract. The final invoice shall be submitted by the date specified in Part 1, Section 3 D of this Contract. The Agency shall submit invoices to the County in the form of a CDBG Program Voucher Reimbursement Request form. Such forms shall be signed by an authorized representative of the Agency and shall be accompanied by copies of supporting documents. 6) Reporting a) Program Accomplishment Report Form The Agency shall submit a Program Accomplishment Form in a format provided by the County within ten (10) business days after the end of each quarter. b) Project Funding Report The Agency shall submit a Project Funding Report form in a format provided by the County with the final invoice. 7) Fixed Price Procurement In accordance with Part 1, Section 18.F of this Contract, the Agency agrees to use a more restrictive procurement procedure than that specified in 24 CFR Part 84.40 through .48. The Agency agrees to use only lump sum fixed price contract for all goods and services procured with funds provided under this Contract. 8) County review and approval of procurement documents The Agency shall submit a draft of the following procurement documents to the County for review and approval at least fifteen (15) days prior to preparing the final version and advertising or soliciting responses for any type of good or service including, but not limited to, professional services and construction services: • construction bid specifications; • invitation to bid; • request for proposals; and • request for qualifications. The draft procurement documents shall include provisions required in the contract. The Agency shall specify the location in the draft procurement document of each of the required provisions. The Agency shall not prepare a final version of any of the above documents and advertise or solicit responses without the written approval of the County. 9) Construction Project Requirements The Agency shall not authorize any work under a construction contract assisted in whole or in part under this Contract to proceed until and unless King County Housing and Community Development Program staff have presented each prime contractor with detailed information Project Scope of Services No.1 - Page 3 • regarding compliance with CDBG Program Regulations including, but not limited to, federal labor standards, at a preconstruction conference. The Agency shall include in construction bid specifications and construction contracts assisted in whole or in part under this Contract, provisions requiring each prime construction contractor to submit a completed King County Final Affidavit of Amounts Paid to the County. The form, to be provided by the County, shall be submitted by the Agency to the County prior to the Agency's release of retainage to each prime contractor. The County shall retain ten percent (10%) of the value of funds provided under this project Scope. The County shall disburse the retained amount upon the County's verification that the Agency has complied with the provisions of this Contract that are applicable to construction contracts. 10) Compliance with Section 7 of the Endangered Species Act — No Effect Determination The County has determined that the project which is the subject of this Scope will not affect species listed pursuant to the Endangered Species Act. The County's determination is based on information submitted to the County by the Agency and set forth in the "No Effects Checklist" which is attached to this project Scope and incorporated by reference into this Contract. The Agency agrees that the information contained in the attached "No Effects Checklist", including the Project Description, is accurate. The Agency further agrees that it will comply with Specific Requirements set forth in the "No Effects Checklist". 11) Project Funding Sign During Construction The Agency shall include the following phrase on any sign erected during construction to identify funding sources used for the project: Funding for this project was provided by King County's Community Development Block Grant Program. AIR QUALITY (40 CFR Part 51.853) De Minimis Impact Criteria: HUD Environmental Review Regulations at 24 CFR Part 58, require projects assisted with Community Development Block Grant or other HUD funds administered by King County to be reviewed for compliance with 40 CFR Subpart W CFR Part 51.853(b) "Conformity of General Federal Actions to State or Federal Implementation Plans." This requirement is in addition to other state and federal Clean Air Act requirements, regulations, and permits. Correspondingly, the de minimis criteria do not apply to other requirements, regulations, and permits. Activities with de minimis Impact Projects that generate less than 100 tons of emissions of particulate matter, ozone precursors, i.e. volatile organic carbons and nitrogen oxides, and carbon monoxide per year in addition to those emissions subject to other permits are considered by the General Conformity regulations to have a de minimis impact on air quality. Projects that generate 100 or more tons of one or more of these substances per year in addition to those emissions subject to other permits must meet the General Conformity requirements which includes elimination of all emissions from the action. The following types of projects are considered to have de minimis impact on air quality: Criteria: 11 Interior rehabilitation of existing buildings. n Rehabilitation of existing buildings with no more than 100,000 square feet of commercial use (e.g., retail, office and services) added and no more than 400 parking spaces after rehabilitation. New construction of buildings containing no more than 100,000 square feet of commercial use (e.g. retail, office and services) with no more than 400 parking spaces. Rehabilitation of existing parks, play -grounds, or playfields with no more than 400 parking spaces after rehabilitation. n Development of new parks, playgrounds or playfields with no more than 400 parking spaces. n Rehabilitation or reconstruction of existing utility lines, street lighting, water treatment, stormwater or wastewater treatment facilities. n New construction of utility lines, street lighting, water treatment, stormwater or wastewater treatment facilities. n Rehabilitation of existing parks, play -grounds, or playfields with no more than 400 parking spaces after rehabilitation. ❑ Rehabilitation or new construction of residential developments with no more than 2,000 dwelling units total. Mixed use developments that do not exceed either 100,000 square feet of commercial development or 2,000 dwelling units. 5 • Determine if the project is located near a major noise source (Envir. For a projects located near a major noise source, determine whether the project site is in an "acceptable", "normally unacceptable" or "unacceptable" noise zone, based on 24 CFR Part 51.103. Use Noise Calculation Sheet(R:CDEnvirReview:Procedures:NoiseCalc Sheet) to calculate DNL for project site. (See SeaTac Noise Contour map) - Projects located in a "normally unacceptable noise zone" need a special environmental clearance on the ROF. This must be requested when RROF is submitted to HUD. - Projects in an "unacceptable noise zone" will need either an EIS or, if noise is the only environmental issue, Dept. Director can waive the EIS requirement. Conclusion (select applicable text and/or expand on if needed): The proposed project is located near a major noise source and will be affected by noise. Attach Documentation: Project environmental review map Noise Calculation Sheet 2) Hazardous Industrial Operations (24 CFR Part 51 Subpart C) & Toxic/Radioactive Materials (HUD Notice 79-33) (§ 50.3(I)) Criteria: - Print a HUD emap of the site (www.hud.gov/offices/cio/emaps/index.cfm), showing locations that produce or release hazardous materials. If such storage facilities exist near the project, contact owners/operators of the site to find out what is being stored there. Obtain Envir. Review map from ADM staff (Gary) showing landfill sites. - Check DOE's Hazardous Sites List: www.ecy.wa.gov/programs/tcp/mtca gen/hazsites.html - Contact the project contact person to find out previous uses of and owners of the site, particularly if any hazardous materials have been or are being stored on or near the site. - If unable to find the proper information through these channels, check with local officials and appropriate State agencies. Conclusion (select applicable text and/or expand on it): The project is not located within 3,000 feet of the end of a civil airport or within 2 1/2 miles from the end of a military airfield runway (there are no military airports in King County).
