Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council to order and led the audience in the Pledge of
Allegiance.

MOVED BY DUFFIE, SECONDED BY MORGAN, THAT COUNCILMAN BAUCH
BE EXCUSED FROM THE MEETING.
Mayor Van Dusen reminded Council of the meeting at 10:00
a.m., Thursday, for the official signing of the boundary line
adjustment between the Cities of Renton and Tukwila. The
meeting will be held at Andy's Tukwila Station on West Valley
Highway.

Attorney Haney read, in its entirety, a Formal Motion
rejecting petitions filed in May and July, 1985, calling for
annexation of the area commonly known as King County Fire
Protection District No. 1 to the City of Tukwila and
encouraging the initiators of such annexation to recirculate
and submit new petitions.
MOVED BY SIMPSON, SECONDED BY HARRIS, THAT THE FORMAL MOTION
BE ACCEPTED AS SUBMITTED. MOTION CARRIED.
Dwayne "Skip" Traynor, 14910 58th Ave. So., asked if anyone
has listed the benefits and penalties that the citizens of
Tukwila will incur with the proposed annexation? Have you
listened to the pros and cons? If this hasn't been done, he
suggested Council do it. The revenue generated in that area
is not sufficient to provide the services that we have today
in our City. Because of this, our present service, possibly

police protection, will be reduced. This annexation is not
in the best interest of the citizens of Tukwila unless they
can provide the revenue to furnish the services we have
today.
Councilman Simpson agreed that an EIS is needed. These
questions can't be answered until this is done.
Council Member Morgan said that Council has taken the posi-
tion that they want to encourage annexations but want to do
them thoughtfully. We need to go through the process so we
can find this out. We are encouraging annexation because (1)
we need to increase the amount of undeveloped land within the
City limits; (2) the City's reliance on one form of income as
its major source of revenue, namely the sales tax, will need
to be broadened; (3) the administration is now investigating
with Fire District #1 on the possibility of contracting for
fire services with that district. The contract is based on
the fact there are adequate revenues in that district to con-
tinue provision of services at its current level. The
contract can be terminated if the revenues are not adequate.
The area holds great possibilities for the future. Council
must look further into it. We would be remiss if we didn't
take the opportunity to look at the potential.
Mr. Traynor said he did not think this was an opportunity.
It is a detriment to the City and the citizens. You will
find that this is a burden to the City all of the time. You
were elected by the voters to represent them, not go out and
solicit areas that are going to cost them money and their
services.
Mayor Van Dusen noted that the Fire District #1 contract and
the annexation are two separate issues.
Council Member Harris said which every way we go, no matter
which direction, to annex it will cost the City money for the
first few years. This doesn't mean we would have to lose
services. The new residents might not get quite the same
kind of service as we have been used to. Whatever they get
would be better than what they are getting now. We do have
to look to the future. Our size of a City is not at all a
financially feasible size. Our Department Heads are being
paid the same amount as if we were a city of 25,000. We are
very expensive the size we are now. We need to get more
people in the City. We need to get more room to develop.
You have to look to the future. This could be one of the
bargains of a lifetime.
Mr. Traynor said that at one time he wanted to expand the
City, but found that that is not the way for the City to go;
that is not representing the citizen. I would accept most
annexations around except this one. The Boundary Review
Board is going to divide that area into two sections.
Tukwila will get the area lying south of Marginal Way. The
City of Seattle will get the area to the north. There goes
the revenue and you have picked up 3,900 people with no
revenue.
Mayor Van Dusen commented that the City has a lot of develop-
ment opportunities in the CBD. We have several big tracts
that are undeveloped and we have redevelopment going on.
The minute any annexation is completed we have to provide
them the same level of service.

Council Member Phelps said the Administration and Council are
proceeding very cautiously with this particular annexation.
I don't think a decision will be made on this until enough
information is gathered for review.
MOVED BY MORGAN, SECONDED BY SIMPSON, THAT THE PROPOSED
ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED.
City Attorney Haney read an ordinance of the City of Tukwila,
Washington, amending Chapter 16.16 of the Tukwila Municipal
Code to adopt the 1985 Edition of the Uniform Fire Code,
standards and appendices with certain exceptions and amend-
ments, providing for the regulation of flammable liquid,
liquefied petroleum gases and explosive storage, setting a
bail schedule for offenses under the uniform fire code,
setting a fee for permits required by the uniform fire code,
providing procedures for appeals and establishing penalties
for violation.

BE ADOPTED AS READ.*
Council Member Harris said that one of the members of our
business community questioned Section 16.16.040 which reads,
"The storage of flammable or combustible liquids in outside
above ground tanks is prohibited within the City." It needs
to be looked at further. Burying tanks makes it difficult to
tell if there is a leak until the ground is saturated.
Doug Gibbs, Fire Marshal, explained that it is the
discretionary power of Council to eliminate above ground
storage tanks.
Council Member Morgan asked the difference between the cost
of installing tanks above ground or underground. She com-
mented she would keep the proportionate cost item in the
Community Affairs Committee.
Doug Gibbs said that danger increases when a tank is
installed above ground. There are a lot of reasons why the
Fire Department does not want to see tanks above ground.

Schneider Homes, Inc., is requesting approval of a sub-
division for 14 single family lots on 4.8 acres lying at the
SW corner of So. 151st and 65th Ave. So.
Brad Collins, Planning Director, explained that Schneider
Homes met with the Planning Commission on July 24, 1986.
After a public hearing the Planning Commission recommended
approval subject to five conditions. Their decision was
based on the following reasons: (1) Conformance with
existing R -1 -12.0 zoning and Comprehensive Plan; (2) Desire
for single family units within the City; (3) Desire of City
to have well constructed and maintainable streets and utility
systems for residents. They recommended that the private
roadways be built to City standards and dedicated as public
streets. There will be some regrading on the site to meet
the street grades. Twenty feet of the property on the west
side will be reserved as a native growth easement. There are
provisions for planters in the cul -de -sacs. The Fire
Department has reviewed them and verified that the large
trucks can maneuver the turns as long as there is no parking
allowed on the street.

Attorney Haney noted that if Council is going to agree with
the Planning Commission's Findings and Conclusions, Council
will need to adopt those.
Mayor Van Dusen commented that this proposal meets all of the
goals and objectives Council has talked of for years and the
developer should be commended.
Gerald Schneider, applicant, explained when the grading is
complete, it will follow the contour of the street. It will
be graded to the west where fill is needed to make the lots
desireable. They have done a major soils test on the area
and found a lot of rock but none that will have to be
blasted.
There should be no problem with the drainage. This is a
request for a simple subdivision, and they plan to build
homes ranging from $150,000 to $200,000. This will be an
exclusive neighborhood.
MOVED BY MORGAN, SECONDED BY DUFFIE, THAT COUNCIL ADOPT THE
PLANNING COMMISSION'S FINDINGS AND CONCLUSIONS DATED JULY 24,
1986, AND THAT THE PRELIMINARY PLAT BE APPROVED WITH THE
CONDITIONS OUTLINED IN THE STAFF REPORT FOR THE MAPLETREE
PARK SUBDIVISION. MOTION CARRIED.
Council Member Morgan commented this is the type of develop-
ment the City has been hoping for.
MOVED BY STOKNES, SECONDED BY HARRIS, THAT BUDGET TRANSFER
MOTION NO. 86 -03 BE APPROVED AS SUBMITTED. MOTION CARRIED.
Council Member Phelps announced that she will be submitting a
letter of resignation from the Council later this fall as her
husband has accepted a job out of state.
