Regular Meeting
CALL TO ORDER Mayor Van Dusen called the Regular Meeting of the Tukwila
and City Council to order and led the audience in the Pledge of
PLEDGE OF ALLEGIANCE Allegiance.

Administrator.
Councilman Duffie reported that the dog problem continues.
They are still running loose on his street. Councilman Bauch
said there is a problem in his area.
Alan Doerschel, Finance Director, explained that the Capital
Financial Plan has been revised to project an increase of 3%
for 1987 instead of the 9% originally used. This is due to
receipt of less sales tax monies than originally estimated.
If the proposal for a new Community Center stays in the CIP
there is the possibility of having the citizens approve an
alternate funding method.
Jim Haney, City Attorney, reported that a lawsuit has been
filed involving a former Tukwila Police Officer. It appears,
thus far, that the claim is without merit. A notice of
appearance has been filed on behalf of the officer.
Board of Adjustment Mr. Jim McKinley, 4404 So. 164th, requested that Item d
Rules (Revised Board of adjustment Rules) on the Consent Agenda be
removed to allow comments from the public.

ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED.
City Attorney Haney read an ordinance of the City of Tukwila,
Wash., imposing an additional sales or use tax pursuant to
RCW 82.14.020, fixing the rate of the tax, providing for the
administration and collection thereof, consenting to the
inspection of records, providing penalties for the violation
thereof, repealing ordinances 1279, 1305, and 1368, and
establishing an effective date.
MOVED BY HARRIS, SECONDED BY PHELPS, THAT ORDINANCE NO. 1399
BE ADOPTED AS READ.*
MOVED BY MORGAN, SECONDED BY DUFFIE, THAT SECTION 6 BE
AMENDED TO STATE THAT, "THE PROCEEDS OF THE TAX IMPOSED
HEREIN SHALL BE PLACED IN MUNICIPAL CAPITAL IMPROVEMENT FUNDS
FOR THE SPECIFIC USE OF STREET IMPROVEMENTS IN THE BUSINESS
DISTRICT. (The motion includes the Interurban Business
District)
Mayor Van Dusen commented that 80% of the budget is exactly
that.
Dwayne Traynor, 14910 58th Ave. So., commented that Council
has control of this money through the budget. It does not
have to be included in the ordinance.
*TIE VOTE MOTION FAILED WITH PHELPS, BAUCH, STOKNES, VOTING
NO.
*MOTION CARRIED WITH BAUCH VOTING NO.
MOVED BY BAUCH, SECONDED BY DUFFIE, THAT COUNCIL SET
SEPTEMBER 2, 1986, TO HOLD A PUBLIC HEARING TO CONSIDER A
REAL ESTATE EXCISE TAX. MOTION CARRIED.
MOVED BY PHELPS, SECONDED BY MORGAN, THAT SECTION 4 BE
AMENDED BY ADDING: "THE CITY COUNCIL SHALL REVIEW THE
DISTRIBUTION OF THE TAX PROCEEDS THREE YEARS FROM THE DATE OF
PASSAGE OF THIS ORDINANCE.
Council Member Phelps explained that it should be reevaluated
as to whether the open space projects that have been funded
are adequate, whether the City needs to continue the alloca-
tion of this Real Estate Excise Tax to future projects or
whether it is needed elsewhere and it can be reallocated to
some other kind of capital need.

MOVED BY PHELPS, SECONDED BY DUFFIE, THAT FORMAL MOTION NO.
07 -86, APPROVING AMENDED RULES OF PROCEDURE FOR THE BOARD OF
ADJUSTMENT BE APPROVED
Mr. McKinley, audience, reviewed the proposed amendments to
the Board of Adjustment Rules of Procedure and commented that
Council is giving away their control. The suggested changes

Council Member Harris noted that in the case of the actions
of the Board of Adjustment, appeal cannot be made to the City
Council. Any appeal has to go to civil court. The only
place, Council has any input is in the rules. I feel uncom-
fortable removing "and the concurrence of the City Council."
This is our only link with the actions of the Board.

fine up to this point.

Council Member Morgan introduced questions about the CIP for
the Council Committees to consider. She reviewed them. Her
hopes are they will temper discussions in the Committee
Meetings so that discussion will be more productive when this
item comes back to the Committee of the Whole. She commented
that Council is reviewing the Capital Improvement Program as
a package. They may accept the packet or reject parts of it.
The City will continue with the current sources of revenue as
the basis of payment for these items. She said she would
like Council to begin thinking about other sources of revenue
and whether or not these are all things we want.

EXECUTIVE SESSION AFTER A SHORT BREAK. MOTION CARRIED.
MOVED BY PHELPS, SECONDED BY DUFFIE, THAT COUNCIL GO OUT OF
EXECUTIVE SESSION. MOTION CARRIED.
MOVED BY DUFFIE, SECONDED BY PHELPS, THAT THE REGULAR MEETING
OF THE TUKWILA CITY COUNCIL ADJOURN. MO LON-- CARRIED.
