CALL TO ORDER and PLEDGE OF ALLEGIANCE ROLL CALL OFFICIALS REPORTS Letter of Resignation from Doris Phelps Councilperson Dog Problems Non Conforming Signs CITIZEN'S COMMENTS 57th Ave. Street Project CONSENT AGENDA TUKWILA CITY COUNCIL Regular Meeting M I N U T E S Tukwila City Hall Council Chambers Mayor Van Dusen called the Regular Meeting of the Tukwila City Council to order and led the audience in the Pledge of Allegiance. MABEL J. HARRIS, DORIS E. PHELPS, JOE H. DUFFIE, Council President, EDGAR D. BAUCH, WENDY A. MORGAN, CHARLES E. SIMPSON, MARILYN STOKNES. JAMES HANEY, City Attorney, MAXINE ANDERSON, City Clerk, ROSS EARNST, City Engineer, DON MORRISON, City Administrator, BYRON SNEVA, Public Works Director. Council President Duffie read a letter dated September 2, 1986, from Council Member Phelps. "It is with a mixture of regret and anticipation that I submit this letter of resigna- tion from the Tukwila City Council. My last official day as an elected official will be September 26, 1986." Mrs. Phelps said that it has been a pleasure to serve the City of Tukwila. It has been a PLEASURE TO WORK WITH THE City Council and all the members of the Administration and Staff. Council President Duffie noted that Doris has been an asset to the City Council and will be missed. MOVED BY DUFFIE, SECONDED BY SIMPSON, THAT COUNCIL ACCEPT THE RESIGNATION OF DORIS PHELPS. MOTION CARRIED. Council President Duffie reported that he is still receiving complaints from citizens on dogs running the streets. Council Member Bauch said they have the same problems with dogs in his area and he hasn't seen a truck from animal control on his street for six months. Councilman Bauch reported on non conforming signs in the business district. These problems will be reported to the Planning Department. They are working with the City Attorney to enforce the Sign Code. Council Member Harris reported that Alaskan Campers replaced their sign and left the old discarded sign lying in the City right -of -way. Ron Wingfield, 14233 57th Ave. So., commented that the contractor has put "awful looking" railroad ties in front of his house. Before, there was grass on a nice even bank, and that is what I wanted so I had the ties removed. When I came home tonight, I found 22 feet of gravel up my driveway. I signed some papers for the work to go ahead. I didn't see anything about 22 feet of gravel. It really looks tackie. My house is too old to have this kind of improvement. I should be notified first; why didn't someone ask me? Mayor Van Dusen referred Mr. Wingfield to the Public Works Department. a. In order to become eligible for the State's Public Works Trust Fund loans, the City must have imposed a 4 of 1% excise tax on the sale of real property. Proceeds from the tax will be used to buy open space in conjunction with parks or other capital projects. Property conveyed by the City or to the City is exempt from the real estate transfer tax. The ordi- nance is subject to referendum procedure set forth in RCW 82.46.021. Mayor Van Dusen declared the Public Hearing open. Dwayne Traynor, 14910 58th Ave. So., asked about the Trust Fund Loan. Council Member Phelpsexplainedthat it is a Trust Fund created by the legislators that sets up a pool of money that is available to cities at low rates of interest on a loan basis to cover the cost of repairing and replacing infrastructure bridges, streets, water and sewer systems and others. There being no further comments, Mayor Van Dusen closed the Public Hearing. MOVED BY PHELPS, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Haney read an ordinance of the City of Tukwila, Washington, imposing an excise tax on sale of real estate, providing for the collection thereof, limiting the use of the proceeds therefrom, and fixing penalties for the violation thereof. MOVED BY PHELPS, SECONDED BY DUFFIE, THAT ORDINANCE NO. 1400 BE ADOPTED AS READ WITH THE EFFECTIVE DATE BEING SEPTEMBER 12, 1986.* Councilman Bauch reported that the Finance and Personnel Committee and the Parks and Recreation Committee both reviewed and approved this ordinance. *MOTION CARRIED. Street Project MISCELLANEOUS City Council Budget for 1987 ADJOURNMENT 8:08 P.M. MOVED BY HARRIS, SECONDED BY MORGAN, THAT COUNCIL ACCEPT THE SOUTH 140TH AND 55TH AVE. SO. STREET PROJECT COMPLETED BY FORD CONSTRUCTION.* Byron Sneva, Public Works Director, reported that the Contractor has a bond; the City is holding the retainage and there is a one year warranty on his work. The City would like to conclude the arrangement with Ford Construction Company so we can proceed with other resources. If the City needs to complete something, Ford is responsible and the cost will be subtracted from the retainage. *MOTION CARRIED. Councilman Bauch reported that the Finance and Personnel Committee have discussed the 1987 Budget for the City Council. The current budget looks good if the same figures are carried forward with a couple of changes. The travel figure should be increased to $6,000. Council Member Phelps asked to have retreats made a separate line item and include the amount of money it takes for a Professional Facilitator and the cost of a retreat. Councilman Bauch suggested that the funds for the part time secretary position be moved to the City Clerk's Budget.
