City of Tukwila Jim Haggerton, Mayor TO: Mayor Haggerton Utilities Committee FROM: Bob Giberson, Public Works Director `'tf BY: Mike Cusick, Senior Program Manager DATE: March 20, 2015 SUBJECT: CBD Sanitary Sewer Rehabilitation Project Project No. 91140203, Contract No. 14-152 Supplemental Agreement No. 1 ISSUE Approve Supplemental Agreement No. 1 with CHS Engineers, LLC (CHS) to perform construction management services for the CBD Sanitary Sewer Rehabilitation Project On March 11, 2013, City staff received a call from a business owner on Andover Park East reporting sewage coming up in the parking lot. Upon inspection, staff discovered that the 12- inch pipe between Andover Park East and Andover Park West was full of sewage and not flowing. A sewer break was discovered and a bypass pumping system was set up until a full repair could be designed and constructed. On October 15, 2014, R.L. Alia Company (Alia) was given a Notice to Proceed for the sewer repair and CHS was contracted to provide construction management. CHS' construction management fee was $36,317.00, and any contract under $40,000 does not require Council approval. ANALYSIS Due to scheduling issues by Alia, the project has taken longer than anticipated to complete. CHS is therefore requesting additional time for construction management. FINANCIAL IMPACT Supplement No. 1 with CHS is proposed in the amount of $10,000.00, which is reasonable for the scope of work required. The additional funds required to complete the project are budgeted in the 2015 Construction Management of the CBD Sanitary Sewer Rehabilitation Project. Attachment: Consultant Supplement No. 1 W:\PW Eng\PROJECTS\A- SW Projects\CBD Sewer Rehabilitation (91140203)\Info Memo Consultant Agreement Supplement 1 CHS - sb.doc SUPPLEMENTAL AGREEMENT NUMBER I to CONSULTANT AGREEMENT NUMBER 14-152 THIS SUPPLEMENTAL AGREEMENT is entered into between the City of Tukwila, Washington, herein-after referred to as "the City", and CHS Engineers, LLC, hereinafter referred to as "the Consultant", in consideration of the mutual benefits, terms, and conditions hereinafter specified. The City desires to supplement the agreement entered into with the Consultant and executed on, October 2, 2014 and identified as Agreement No. 14-152. All provisions in the basic agreement remain in effect except as expressly modified by this supplement. The changes to the agreement are described as follows: C� Scope of Services, for Supplemental Agreement #1 for Construction Management for the CBD Sanitary Sewer Rehabilitation Project. The purpose of this supplement is to add: Construction Support 1.1. Field Observation — Complete observation of field work and coordinate with City Utilities Engineer or designated party regarding construction activities. 1.1.1. Civil Construction - Complete observation of field work including backfill, compaction, surface restoration and site restoration. 1.2. Documentation — All construction observers shall prepare daily reports, accompanied by photographs and/or sketches as suitable to clarify the report. 1.3. Pay Estimate Support — Review final pay estimate to confirm quantities for review and approval by City. 1.4. Construction Completion Letter — Provide written documentation to the City recommending the City accept the project as construction complete, stating the effective date of the warranty period and any holding periods required prior to releasing retainage. 2. Deliverables Up to seven (7) additional inspector daily reports (1DRs). CD containing all digital photos taken throughout the project. Construction completion letter initiating the warranty period and any time periods necessary prior to releasing retainage. 3. Payment, shall be amended as follows: Payment for the work provided by the Consultant as part of this supplement shall be made for an additional $10,000.00. The total amount for the Consultant for this contract shall not exceed $46,317.00 without express written modification of the Agreement signed by the City.
