HOW TO TESTIFY If you would like to address the Council, please go to the podium and state your name and address clearly for the record. Please observe the basic riles of courtesy when speaking and limit your comments to five minutes. The Council appreciates hearing from citizens but may not be able to take immediate action on comments received until they are referred to a Committee or discussed under New Business. COUNCIL MEETINGS No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given. Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council Meetings held on the 1 st and 3rd Mondays of each month at 7:00 p.m. Official Council action in the form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular Council meetings. Committee of the Whole Meetings - Council members are elected for a four -year term. The Council President is elected by the Council members to preside at all Committee of the Whole meetings for a one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m. Issues discussed are forwarded to the Regular Council meeting for official action. GENERAL INFORMATION At each Council meeting citizens are given the opportunity to address the Council on items that are not included on the agenda during CITIZENS COMMENTS. Please limit your comments to 5 minutes. Special Meetings may be called at any time with proper public notice. Procedures followed are the same as those used in Regular Council meetings. Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel matters. PUBLIC HEARINGS Public Hearings are required by law before the Council can take action on matters affecting the public interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the Tukwila Municipal Code states the following guidelines for Public Hearings: The proponent shall speak first and is allowed 15 minutes for a presentation. 2. The opponent is then allowed 15 minutes to make a presentation. Each side is then allowed 5 minutes for rebuttal. 4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at this time. 6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss the issue among themselves, or defer the discussion to a future Council meeting, without further public testimony. I am pleased to forward you the following applications to fill two of the three vacancies. Position #3 I am recommending the appointment of John Lindsay to Position #3. Mr. Lindsay is a Tukwila resident and a retired school teacher. He also completed the Tukwila Police Department Citizen's Academy in 2014. His term will expire on March 31, 2019. Position #5 I am recommending the appointment of Austin Hackett to Position #5. Mr. Hackett is a Tukwila resident, a member of United States Marine Corps reserves and a student at the University of Washington. His term will expire on March 31, 2019. BACKGROUND For the past seven years, the City has contracted with the U.S. Department of Agriculture, in partnership with eleven other agencies in the Puget Sound region, for wildlife services. The purpose of this program is to manage the population of non - migratory Canada Geese. The project focus in Tukwila is along the Duwamish River at Foster Golf Links. The City strives to be fiscally responsible and partnering with other agencies for this service achieves this. DISCUSSION The U.S. Department of Agriculture is asking the City to enter into an Interlocal Agreement from January 1, 2015 through December 31, 2018 along with the eleven other agencies that have partnered in this program in the past, to participate in the program. FINANCIAL IMPACT The annual expense for this program to the City of Tukwila will vary around $2,200 — $2,700. The expense for 2015 is $2,230. This service is budgeted for each year in Golf Maintenance. RECOMMENDATION The Community Affairs and Parks Council Committee is being asked to approve the Interlocal Agreement with the U.S. Department of Agriculture and forward to the Consent Agenda at the, April 6, 2015 Regular Meeting. ATTACHMENTS U.S. Department of Agriculture Interlocal Agreement 23 24 For Your Action 2015 -2018 Interlocal Agreement for Waterfowl (Canada Goose) Management Program Please Note: Final Form Ready for Your Submittal for Signature and Funding Authorization 25 2015 INTERLOCAL AGREEMENT FOR WATERFOWL (CANADA GOOSE) MANAGEMENT PROGRAM WHEREAS, Chapter 39.34.040 RCW (Interlocal Cooperation Act) permits local government units to make the most efficient use of their powers by enabling them to communicate and cooperate with other localities on a basis of mutual advantage and thereby to provide services in a manner pursuant to forms of government organization that will accord best with recreational, park and natural resources and other factors influencing the needs and development of local communities and WHEREAS, the various agencies, cities, counties, Washington State and agencies of the Federal Government listed in Exhibit A - Page 6 of this Agreement, desire to manage waterfowl, especially Canada Geese; and WHEREAS, all parties require assistance from the Wildlife Services Program of the U.S. Department of Agriculture, to reduce negative impacts on water quality, minimize resource damage, ensure safety from disease for park visitors, and enhance other property managed; and WHEREAS, yearly surveys by Wildlife Services indicates an increasing population trend for Canada geese in Lake Washington from the previous 10 years, expanding smaller groups of geese in surrounding areas and along Puget Sound, earlier pairing and nesting activity and a larger surplus of other waterfowl species in the Seattle area; and WHEREAS, this program will be an ongoing resource management activity attempting to maintain a manageable number of birds on a year -to -year basis; and NOW, THEREFORE, in consideration of the covenants herein, it is mutually agreed as follows: SECTION I - PURPOSE The purpose of this Agreement is to provide joint funding for an egg addling program, lethal control, population monitoring and census; mainly of Canada Geese, within King, Pierce, and Snohomish Counties. This program will assist each party in communicating, maintaining, and managing public and selected and approved private site impacts of surplus waterfowl. n: staffosp \d MwaterfwRagreem nt\Inter2015 26 SECTION II - SCOPE OF PROGRAM Wildlife Services (WS) will receive funds from each participating member for the continuation of an egg addling program, lethal control and evaluation during spring and summer 2015. Using best management practices WS will carry out an egg addling program, seeking as many accessible nesting areas as possible and will make every effort to minimize damage to the surrounding environment. With the assistance of Wildlife Services, the WMC members will continue a yearly program to increase monitoring activities that will enhance our location and access of nests on public and private land and to facilitate expanded egg addling program, including advertisement of an addling and nesting location hotline number for the general public and others, posters and webpage advertising and other activities to keep the public well informed of the Waterfowl Management Program. WS will also implement a program of "lethal control" as requested by the Waterfowl Management Committee, subject to the terms and conditions of a permit to be issued by the U.S. Fish and Wildlife Service. This will be done on a case by case basis in situations where an over population of Canada geese may result in an impact on human health and safety, such as potable water contamination, bird aircraft strikes, disease transmission or other situations as determined by WMC members. WS will provide an annual report to the members of the WMC which will include information regarding egg addling, the general location of nests and number of eggs addled, number of geese removed, difficulties encountered and whatever other information would be valuable to the WMC. 2015 will be the twenty- second year of an egg addling program and the fourteenth year utilizing "lethal control ". All methods and tools utilized to accomplish addling and "lethal control" activities in 2014 will again be used in 2015. WS will conduct a standardized monthly goose population survey of selected area parks and will annually conduct up to six goose surveys of Lake Washington by boat. As in previous years, census counts will be expanded using staff from local agencies and participants at times and places to be specified. Survey results will be presented annually to the WMC. Where possible, community outreach and educational programs such as `don't feed wildlife' and interpretive signage will be initiated to inform the public about urban Canada Geese, the associated problems, and the efforts of this committee at addressing those problems. n: staffosp \dh \waterfwl \agreemnt \Inter20I S 27 SECTION III - RESPONSIBILITIES Each party, represented on the Waterfowl Management Committee, as shown on Exhibit "A ", and incorporated by reference herein, will share in the ongoing review of the programs carried out by WS. Each party agrees that if necessary, an Oversight Committee will be appointed to monitor and report back to the general committee on a regular basis. Three members of the Committee will make up the Oversight Committee chaired by the Seattle Parks and Recreation representative. SECTION IV - COMPENSATION The total cost of the 2015 waterfowl management program shall not exceed twenty seven five hundred and twenty -eight dollars ($27,528). Each party shall contribute to the financial costs of the program. The costs are shared between the agencies. Individual costs per agency may vary year -to -year and are based upon the total number of agencies actively participating in the program and receiving services. Table 1 shows the 2015 minimum and maximum costs for each agency. SECTION V - TERM AND EXTENSION The Term of this Agreement is from January 1, 2015 to December 31, 2018. This Agreement may be extended in time, scope or funding by mutual written consent from all parties referenced herein. SECTION VI - TERMINATION This agreement may be unilaterally terminated by any of the parties referenced herein or Wildlife Services upon presentation of written notice to the Oversight Committee at least 30 days in advance of the severance date shown in Section V. Eggs will be coated with vegetable oil on dates to be determined by USDA - Wildlife Services. Participants will receive a report on the number of eggs addled and geese euthanized in 2015. SECTION VIII - FILING As provided by RCW 39.34.040, this agreement shall be filed prior to its entry and force with the City or County Clerks of the participating parties, the County Auditor and the Secretary of State, and, if found to be necessary, with the State Office of Community Affairs as provided by RCW 39.34.120. SECTION IX - LIABILITY Each party to this agreement shall be responsible for damage to person or property resulting from the negligence on the part of itself, its employees, its agents or its officers. Upon inspection, staff discovered that the 12- inch pipe between Andover Park East and Andover Park West was full of sewage and not flowing. A sewer break was discovered and a bypass pumping system was set up until a full repair could be designed and constructed. On October 15, 2014, R.L. Alia Company (Alia) was given a Notice to Proceed for the sewer repair and CHS was contracted to provide construction management. CHS' construction management fee was $36,317.00, and any contract under $40,000 does not require Council approval. ANALYSIS Due to scheduling issues by Alia, the project has taken longer than anticipated to complete. CHS is therefore requesting additional time for construction management. FINANCIAL IMPACT Supplement No. 1 with CHS is proposed in the amount of $10,000.00, which is reasonable for the scope of work required. The additional funds required to complete the project are budgeted in the 2015 Construction Management of the CBD Sanitary Sewer Rehabilitation Project. Slip lining the pipe will reinforce the strength with little impact to roadways and minimal excavation. JUSTIFICATION: If the pipe collapses, the street will have to be excavated and the cost of the repairs will be significant. In the last five years we have had two major pipe failures on Andover Park West. STATUS: A Public Works Trust Fund loan was successfully obtained in 2012 for construction. MAINT. IMPACT: Reduced maintenance and repair costs. COMMENT: The limits of the 2013 project is APW to APE from Minkler Blvd to S 180th St and will now include the repair to the sewer under the railroad tracks. The City desires to supplement the agreement entered into with the Consultant and executed on, October 2, 2014 and identified as Agreement No. 14 -152. All provisions in the basic agreement remain in effect except as expressly modified by this supplement. The changes to the agreement are described as follows: Scope of Services, for Supplemental Agreement #1 for Construction Management for the CBD Sanitary Sewer Rehabilitation Project. The purpose of this supplement is to add: 1. Construction Support 1.1. Field Observation — Complete observation of field work and coordinate with City Utilities Engineer or designated party regarding construction activities. 1.1.1. Construction Completion Letter — Provide written documentation to the City recommending the City accept the project as construction complete, stating the effective date of the warranty period and any holding periods required prior to releasing retainage. 2. Deliverables • Up to seven (7) additional inspector daily reports (IDRs). • CD containing all digital photos taken throughout the project. • Construction completion letter initiating the warranty period and any time periods necessary prior to releasing retainage. 3. Intergovernmental Update • South King Food Access Working Group: City staff attended the bimonthly meeting of the South King Food Access Working Group (SKFAWG) on March 11. Staff from cities in the South King County sub - region, service providers, and food access advocates discussed their current efforts to promote food access and a viable local food economy. City staff shared updates on the Comprehensive Plan update process and discussed a possible food truck rodeo in 2016. • Feedback to the Committee to End Homelessness: Human Services met with representatives other cities, the King County Housing Authority, and several non - profit organizations to continue providing feedback to the Committee to End Homelessness in conjunction with their draft strategic plan. • Highline Forum: Tukwila hosted the Highline Forum at Starfire Sports on March �5th The Highline Forum includes the cities of Tukwila, Burien, Des Moines, SeaTac, Normandy Park, and Federal Way (which does not attend); the Highline College, and Highline Public Schools. The topic of the meeting was innovative approaches to providing Parks and Recreation Services. CM Hougardy, the City's representative on the Forum, provided an update on activity in Tukwila. • King County City Managers /Administrators Meeting: Brandon Miles, Economic Development Liaison attended the monthly meeting of King County City Managers and City Administrators. Sound Transit and King County Metro each provided updates regarding transit system planning. Sound Transit noted that a priority project list for Sound Transit 3 will be released in May. City staff will closely monitor the release of the project list to evaluate possible transit projects for the City. • State Senate Bill 536: Last week Chief Villa testified at the House Judiciary Committee in opposition to State Senate Bill 5363, which would limit the ability to condemn in blighted areas. According to the Association of Washington Cities the Bill has died in committee in the State House. EYA City Administrator Report April 1, 2015 Page 2 II. Community Events • Preschool Open House On April 2 Tukwila Parks & Recreation hosted a Preschool Open House at the Tukwila Community Center. Parents and children were invited to tour the preschool room, meet the teacher and staff, and get enrollment information. • Project Feast Community Open House: On April 10 Tukwila Parks & Recreation in partnership with Project Feast will be hosting a community open house event featuring culture and cuisine from Mexico. This free event will be held in the Social Hall at the Tukwila Community Center. • S2 Inaugural Game: On March 21 S2, the second team for the MLS Seattle Sounders, kicked off their first season with a 4 -2 win over the Sacramento Republic. Mayor Haggerton and Council President Kruller and Councilmember Robertson participated in the pre -game coin toss and members of the Tukwila Police Honor Guard: Officer Chris Daugherty and Officer Isaiah Harris presented the colors. Staff has estimated that the games will bring approximately 4,000 people to Tukwila. Economic Development has provided a nominal amount of funds for the Sounders to test a game shuttle to get fans to the game. The shuttle connects S2 fans to Starfire with stops at Odin Brewery, the Mall, and the TIB Station. III. Staff Updates Public Safety • PD Leadership Summit: The Police Department leadership team (supervisors and above) attended a two -day leadership summit on March 17 and A. The primary objective was to continue to build a more cohesive "world- class" team and to ensure alignment of the Police Department vision and goals. Topics such as trust, conflict, commitment, accountability and results were discussed as well as why we exist, how we will succeed and as well as the department's current priority. Project Updates • 2o14 Employee Awards: The 2014 Department Employee of the Year Award recipients are: Lynn Miranda, DCD; Marty Grisham, Fire Department; Diane Jaber, Internal Services; Joyce Trantina, Mayor's Office; Julie Tran, Municipal Court; Marlus Francis, Parks & Recreation; Rick Mitchell, Police Department; and Laurie Werle, Public Works. This professional organization specializes in providing networking and training opportunities regarding open government, public disclosure best practices, leadership and strategic planning, and successful intergovernmental relationships. .; City Administrator Report April 1, 2015 Page 3 • Tree Risk Assessment and Tree Management: Department of Community Development and the Washington State Department of Natural Resources (DNR) hosted a second training class for City staff and local apartment managers on tree risk assessment and tree management. This class followed up on the earlier training on proper tree pruning techniques. • Westfield Mall Flood: While Round One was doing tenant improvements to add a bowling alley in the space above Seafood City a water leak was discovered. The leak came from a water line that flowed for over an hour before the main water supply was shut off. The Fire department had crews' onsite to remove as much standing water as possible. Due to the diligence of the Fire Department and the Department of Community Development the store was able to reopen March 27, earlier than initially expected. 0 4448 S. 164th Street: Code Enforcement is working with Public Works, the Police Department and the Fire Department to secure and clean up the property. 0 4736 S. 164th Street: Code Enforcement continues to work with the tenants on cleaning up the property. Neighbors should see a visible difference soon. • 1665 I S3rd Av S: On March g, Code Enforcement received a complaint regarding a vacant house. The front door had been broken in and Tukwila Police removed 2 individuals from the property. With collaborative efforts from Public Works, Police and Code Enforcement, the building has been secured. The debris and overgrowth will be addressed as soon as they receive approval from their client. • Tukwila Station: Sound Transit's contractor has requested final approval on their construction permit. There is an outstanding issue regarding removal of a 350 x loo foot pile of fill placed on their property sometime during the station's construction, in violation of City regulations. According to the contractor, Sound Transit is not closing the contract with them until a final approval is given by the City.
