PROHIBITED SIGNS AND DEVICES
TMC 19.12.040 A sign, sign style or device is prohibited by this code and subject to removal
if it is not specifically permitted by this code. This indudes, but is not limited to, the
following examples: 7. The use of portable signs or other similar devices unless permitted
under Section 19.24.070; 9. Abandoned signs.
The four portable signs along Strander Blvd. are prohibited in the Cty of Tukwila
The pole sign is a Non - Conforming Sign (listed under Abandoned Signs)
Corrective Action: Remove the prohibited portable signs along Strander Blvd from the property,
and remove the non-conforming sign.
Compliance Date: 9/6/2014

Code Reference:
TMC 19.16.050 Removal of Abandoned Signs: A. The Director shall order the removal of
any sign that is abandoned as defined by TMC Section 19.08.020. The particular mitigation
measures shall be based on the circumstances outlined below:
1. Non-conforming Freestanding Sign. In the event that a nonconforming freestanding
sign has been abandoned and the sign is not covered under a grace period found in
Chapter 19.36, the Director shall order the property owner to remove the sign and sign
structure within 45 days of issuance of a Notice and Order from the City.
The non-conforming pole sign was never registered, it was required to either a)be
removed or b) be brought into compliance. However, instead, it has been refaced
completely from Furniture City to Foss Audio in violation of TMC 19.36.040 (C)
Corrective Action: Install blank face on the sign within 30 days.
Remove the non-conforming sign or Bring non - conforming sign into compliance within 45
days.

Department at 206 -431 -3670.
Compliance Date: 9/6/2014
FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO $500 PER DAY
PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PER TMC 8.45.100(2).
Appeal Provisions
A person may, within ten days of receipt of this notice, file with the City Berk a written notice of appeal
containing the following:
1. A heading with the words: "Before the Hearing Officer of the City of Tukwila"
2. A caption reading: "Appeal of " giving the names of all appellants participating
in the appeal.
3. A brief statement setting forth the legal interest of each of the appellants in the property Involved In the
notice and order.
4. A brief statement of the specific order or action protested, together with any material facts claimed to
support the contentions of the appellant(s).
5. A brief statement of the relief sought, and the reasons why it is daimed that the notice and order should be
reversed, modified, or otherwise set aside.
6. The signature of all persons named as appellants and their official mailing addresses.
7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters
stated in the appeal.
8. The appeal fee for violations in the LDR zone is $100.00. All other zones $200.00. Fees must accompany the
written notice of appeals.
Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional
administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for
further action.
