HOW TO TESTIFY If you would like to address the Council, please go to the podium and state your name and address clearly for the record. Please observe the basic riles of courtesy when speaking and limit your comments to five minutes. The Council appreciates hearing from citizens but may not be able to take immediate action on comments received until they are referred to a Committee or discussed under New Business. COUNCIL MEETINGS No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given. Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council Meetings held on the 1 st and 3rd Mondays of each month at 7:00 p.m. Official Council action in the form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular Council meetings. Committee of the Whole Meetings - Council members are elected for a four -year term. The Council President is elected by the Council members to preside at all Committee of the Whole meetings for a one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m. Issues discussed are forwarded to the Regular Council meeting for official action. GENERAL INFORMATION At each Council meeting citizens are given the opportunity to address the Council on items that are not included on the agenda during CITIZENS COMMENTS. Please limit your comments to 5 minutes. Special Meetings may be called at any time with proper public notice. Procedures followed are the same as those used in Regular Council meetings. Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel matters. PUBLIC HEARINGS Public Hearings are required by law before the Council can take action on matters affecting the public interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the Tukwila Municipal Code states the following guidelines for Public Hearings: The proponent shall speak first and is allowed 15 minutes for a presentation. 2. The opponent is then allowed 15 minutes to make a presentation. Each side is then allowed 5 minutes for rebuttal. 4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at this time. 6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss the issue among themselves, or defer the discussion to a future Council meeting, without further public testimony. The following requests were made by the Committee during the discussion: • Address Project P -9 (Table 8.2, South 152nd Place from End of Pipe to Sunwood Boulevard) sooner in the Capital Improvement Program. • A brief synopsis of the City's long term water strategies for use when addressing questions from residents on water conservation and climate change. • A table showing the revenues generated by each water customer category. BACKGROUND On July 21, 2014 Council adopted the 2013 Comprehensive Water Plan by Resolution No. 1834. After Council adoption on August 12, 2014, Washington State Department of Health (DOH) requested revisions to the Plan. The changes concerned fire flows in the Crystal Springs and Ryan Hill areas of the City. In March of 2015, the City submitted the requested revisions prepared by Carollo Engineers to DOH. On March 24, 2015 DOH approved the revisions to our Comprehensive Water Plan. The 2013 Comprehensive Water Plan has been updated and is now the 2015 Comprehensive Water Plan. DISCUSSION DOH requested the City of Tukwila provide additional information in the Comprehensive Water Plan for how the City provides fire flows to neighborhoods listed below: • The City has begun negotiations with Highline Water District regarding fire flow to the 12 accounts in the Crystal Springs neighborhood. • Currently the contractual water flow for the Ryan Hill area is 70 gallons per minute (GPM) by the agreement between Seattle Public Utilities (SPU) and Cascade Water Alliance. The actual flow from the SPU water tap is 1,300 GPM for the 140 accounts on Ryan Hill. The City will work with our supply partners, Cascade Water Alliance and SPU to increase the contract agreement for fire flows to the Ryan Hill neighborhood. DOH has accepted revised information in Chapter 6 and will issue an approval letter after Council passes the new Resolution for the 2015 Comprehensive Water Plan The Comprehensive Water Plan is available on the City's website at www. tukwilawa. qov/ pubwks/ water /2015ComprehensiveWaterPIan.pdf and on the Z drive in the 2015 Comprehensive Water Plan folder. Recent law enforcement raids have identified two instances in which this moratorium has been violated. DISCUSSION There are a couple of ways that the City can enforce its moratorium. The most efficient method would be for the City to seek injunctive relief from King County Superior Court. A preliminary injunction could most likely be obtained within several weeks. This issue was discussed at the April 13, 2015 Community Affairs and Parks committee meeting, and there was interest in bringing this option forward for consideration at the April 20, 2015 City Council meeting. FINANCIAL IMPACT There will be legal costs associated with an action for injunctive relief. It is difficult to estimate these costs at this time, however, they will likely range somewhere from $3,000 to $10,000. There are funds in the City's litigation budget that would cover these expenses. RECOMMENDATION The City Council is being asked to authorize the Mayor to institute legal proceedings against two property owners who are in violation of the City's medical cannabis moratorium. Such legal proceedings would include motions for preliminary and permanent injunctions, if necessary, as well as any related legal proceedings, such as any appeals that may follow. 33 34 Community Affairs & Parks Committee Minutes April 13, 2015 - Page 2 D. Marijuana Regulations Discussion At its March 23, 2015 meeting, the Committee requested a cross - departmental discussion on penalty and enforcement strategies for marijuana growing code violations. City Attorney Rachel Turpin opened the discussion by stating that the City's main objective is to get illegal grow operations stopped as soon as possible. The typical code violation process involving a notice and order is lengthy, involving an appeal process and hearing examiner decision prior to getting to a courtroom. A faster option would be to seek injunctive relief, which can be obtained in a matter of weeks, and the defendant's failure to comply would mean contempt of court and the potential for stiffer penalties. This will require Council action and a motion relating to certain properties in the City will be prepared for the April 20, 2015 Regular Meeting. Committee members and staff also discussed options for potential legislation, including an outright ban on collective gardens and a criminal zoning code violation. Regarding the former, marijuana - related legislation is still active at the State legislature and appropriate City actions are not yet clarified. If the City enacts a criminal code violation it is still the case that penalties are unlikely to be high and the potential for deterrant may not be as hoped. The Committee was supportive of the City Attorney's proposal for injunctive relief as a tool to combat illegal marijuana growing activities, and did not request that an ordinance be prepared at this time. INFORMATION ONLY. III. MISCELLANEOUS Councilmember Ekberg inquired about the status of the totem pole at the Duwamish Hill Preserve. It has been cut down due to safety concerns relating to internal rot, and pieces displaying the carvings will be relocated to sites within the park. ISSUE The April 28, 2015 Special Election ballot includes a proposition to lift the lid of the existing property tax levy to generate funding to replace King County's current emergency radio network which is facing obsolescence. BACKGROUND The existing King County public safety voice radio system is nearly twenty years old and will no longer be supported by its vendor after December 31, 2018. King County, the City of Seattle, Eastside Public Safety Communications Agency cities, and Valley Communications Center cities have entered into an interlocal agreement to work through implementation of a replacement system to be known as Puget Sound Emergency Radio Network (PSERN). PSERN will replace aging components and establish new technology to support emergency dispatch and incident scene communications. On Monday, March 2, 2015 the Metropolitan King County Council passed Ordinance 17993, placing on the April 28, 2015 special election ballot a nine-year property tax levy lid lift proposal to fund the PSERN project. Based on 2015 home values, the cost to the median homeowner would be $26.46 per year. DISCUSSION The proposed resolution expresses support for the passage of the levy and encourages registered voters in Tukwila to vote to approve it. Per the requirements of RCW42.17A.555 regarding ballot measures, public comments will be accepted at the Council Committee and full Council meetings where this topic is discussed. RECOMMENDATION The Committee is asked to approve the draft resolution and forward it to the April 20 Regular Meeting under New Business. Staff Updates Public Safety • Valley SWAT Training Exercise: Valley SWAT recently completed a breaching training exercise at the Spruce Motel, which gave this important team a unique opportunity to conduct realistic drills. • Lean Process Improvements: In March of 2015 the Special Services Division of the Tukwila Police Department initiated a Lean process on the Evidence processing of the Department. The Lean evaluation will look at the entire evidence process, from the time that an officer first takes an item into evidence, until it is released for the Department's custody. The goal is to increase efficiency and accountability for the Department's evidence program. We hope to implement changes identified by the Lean process by the end of 2015. 45 City Administrator Report April 15, 2015 Page 2 Project Updates • Business Outreach Tour: Mayor Haggerton, David Cline and Joyce Trantina visited the UPS Customer Center on Andover Park West to learn more about operations, and share highlights of City projects underway. • Meeting with Bellwether: Several staff met with staff from Bellwether, a non - profit developer of affordable housing, to discuss development opportunities across the City, particularly along Tukwila International Boulevard. • Thorndyke Safe Routes to School: Final grades have been set with curb and gutter in place. First layer of asphalt pavement has been scheduled. Sidewalk installation and final layer of pavement to follow. • Duwamish Gardens: Bids were advertised and opened on April 14. Results are being analyzed and bid tabulations will be brought forward to Committee and Council for formal bid award. • East Marginal Way Storm Pipe Replacement: At long last the project is substantially complete with all storm pipe in place, all pavement restoration and striping allowing traffic to be fully opened to traffic. Only minor cleanup and final payment issues remain to be completed. • Tukwila Village: The City, King County Library System (KCLS) and the developer are working to complete the lot consolidation and associated easements so that the City can sell a parcel of land to KCLS for the library. This is our most immediate task for the project and we hope to close escrow by the end of April. The City has completed its review of the library's building permit application and is ready to issue the permit once the land sale is complete. • Status of Boeing Access Road Station project: City staff continue to work with our coalition partners, including residents and businesses, to identify funding for the construction of the Boeing Access Road Sounder and Link Light Rail station. The coalition continues to work to get the station included in the ST3 package, which will go in front of the voters for approval in the fall of 2o16, as well as identify other potential sources of funding for the station. This topic will be one of the two focus areas of the Tukwila delegation traveling to Washington DC next week. • BNSF land purchase: Last week BNSF notified the City that they are purchasing a vacant lot on 44th PL S. between the addresses iAN and 12014. The City has confirmed that this is an existing empty lot. This lot will be used as a buffer, similar to other lots they own in the neighborhood. M.
