TMC 8.45.030.E.2 Failure to comply with TMC regulations
TMC 8.28.020 International Property Maintenance Code Adoption(IPMC)
Violation#1 ACCUMULATION OF RUBBISH OR GARBAGE
Code Reference: IPMC 308.1(as adopted in Tukwila Municipal Code Chapter 8.28.020)All exterior property
and premises shall be free from any accumulation of rubbish or garbage.
Garbage is defined as the animal or vegetable waste resulting from the handling,
preparation,cooking and consumption of food. Rubbish is defined as combustible and
noncombustible waste materials,except garbage;the term shall include the residue from
the burning of wood,coal,coke and other combustible materials,paper,rags,cartons,
boxes,wood excelsior,rubber,leather tree branches yard trimmings,tin cans,metals,
mineral matter,glass crockery and dust and other similar materials.
Rubbish,garbage and debris under the carport and around the property.(see photo)
Corrective Action: Remove all garbage,rubbish and debris from under the carport and the entire property.

Violation#2 VACANT BUILDINGS STRUCTURES AND PREMISES
Code Reference: TMC 8.28.030(A) All vacant buildings,structures and premises,and all vacant land,shall
be maintained in a clean,safe,secure and sanitary condition as required by the
International Property Maintenance Code,and shall at all times be secured against outside
entry,which shall include the provision of windows and doors with adequate strength to
resist intrusion. All doors and windows must remain locked.
(D) Abandoned premises,chronic nuisance buildings or premises,vacant nuisance
buildings,and vacant nuisance properties are found and declared to be nuisances.
On March 12,2015,Tukwila Police responded to a break-in in progress call and removed
individuals from the premises. A side door was found to have been kicked in and
unsecured.(see photo)
Corrective Action: Secure all structures from unlawful entry by covering/boarding,locking,all doors,windows
and all other openings.
Boarding sheet material shall be minimum 1/2-inch thick wood structural panels;
Boarding framing material shall be minimum nominal 2-inch by 4-inch solid sawn lumber;
Boarding fasteners shall be minimum 3/8-inch diameter carriage bolts of such a length as
required to penetrate the assembly and as required to adequately attach the washers and
nuts.
Compliance Date: 4/3/2015
Violation#3 WEEDS
Code Reference: IPMC(as adopted in TMC Chapter 8.28.020)302.4 All premises shall be maintained free
from weeds in excess of 24 inches.
All noxious weeds shall be prohibited. Weeds shall be defined as all grasses,annual plants
and vegetation,other than trees or shrubs provided,however,this term shall not include
cultivated flowers and gardens.
The entire property is covered with noxious uncultivated weeds,including blackberry vines,
in excess of 24 inches tall.
Corrective Action: Cut back and remove all noxious weeds from the property.
Compliance Date: 4/3/2015
FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO$500 PER DAY
PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PER TMC 8.45.100(2).
Appeal Provisions
A person may,within ten days of receipt of this notice,file with the City Clerk a written notice of appeal
containing the following:
1. A heading with the words:"Before the Hearing Officer of the City of Tukwila"
2. A caption reading:"Appeal of "giving the names of all appellants participating
in the appeal.
3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the
notice and order.
4. A brief statement of the specific order or action protested,together with any material facts claimed to
support the contentions of the appellant(s).
5. A brief statement of the relief sought,and the reasons why it is claimed that the notice and order should be
reversed,modified,or otherwise set aside.
6. The signature of all persons named as appellants and their official mailing addresses.
7. The verification(by declaration under penalty of perjury)of each appellant as to the truth of the matters
stated in the appeal.
8. The appeal fee for violations In the LDR zone is$100.00. All other zones$200.00. Fees must accompany the
written notice of appeals.
Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional
administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for
further action.
