MINUTES REGULAR MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Dennis Robertson, Kate Kruller, Allan Ekberg, Verna Seal, Kathy Hougardy, De'Sean Quinn. SPECIAL PRESENTATION Tukwila Village status update. Derek Speck, Economic Development Administrator. Derek Speck, Economic Development Administrator, utilized a Powerpoint presentation to provide an update on this topic and to depict graphics and photos of the proposed Tukwila Village Development. Part of the phasing of the development plan is that the developer (TVDA) will do everything except the library, which will be built by the King County Library System (KCLS). Phase 2 will start within a few months of the start of Phase 1. Phase 3 may start a year or two after Phase 2 to enable the developer to capture rents. The phasing makes the project complicated since the easements and agreements have to take into account that the City may own some of the parcels when the developer owns the others. The City is trying to get the agreements in place for that. This is very important to the library because their foundation raised money for the project, and it can jeopardize their ability to raise funds. Also, they are concerned about increasing construction costs. The Access and Shared Parking Easement has been a challenge, and the City is working on that as well. Once the Access and Shared Parking Easement is recorded, the City is ready to close escrow. City's Immediate Goal - Sell Parcel D to KCLS: 1. Complete Declaration of Access & Shared Parking Easement • City seeking consensus with KCLS and TVDA 2. Close escrow • KCLS & TVDA sign a development agreement • City to modify DDA, DA, and temporary access easements to exclude Parcel D City's Next Steps: 1. Sell Parcel D to KCLS 2. Process permits and inspect construction 3. Negotiate frontage improvement agreement with TVDA 4. Sell parcels to TVDA 5. Negotiate CC &Rs (Covenants, Codes & Restrictions) for plaza 6. Partner with TVDA to form non - profit Examples of Recent Challenges: • Lot consolidation — Title gap • Access and Shared Parking Easement Example of Challenge with Access and Shared Parking TVDA and KCLS agreed to and submitted an integrated site plan with shared parking. TVDA and KCLS received a 10% parking reduction. ❖ TVDA and KCLS would like designated spaces included in the Access and Shared Parking Easement. ❖ An easement is not flexible for adapting as parking needs change. The Councilmembers thanked Mr. Speck for the update and asked clarifying questions regarding the presentation, primarily regarding potential delays and when the groundbreaking is likely to occur. Mr. Speck explained that issues regarding the Access and Shared Parking Easement have presented challenges. He is confident the parties will continue to come to the table and work through the remaining issues. While there is not yet a specific date for a groundbreaking, all of the parties are heavily invested in this project and are working to move it forward as soon as possible. PROCLAMATION A proclamation for "Peace Officers Memorial Day." Mayor Haggerton read a proclamation declaring May 11, 2015 as Peace Officers Memorial Day, when the flag at Tukwila City Hall will be flown at half mast, In Memory of Many, in Honor of All. Deputy Police Chief Linton accepted the proclamation from Mayor Haggerton. CITIZEN COMMENTS Kathleen Graf, 14153 37'" Avenue South, said she lives across from Cascade View Park and frequently calls "911" due to increased crime at the park from those who were displaced when the nearby motels closed. She noticed the Tukwila Village Development plan does not have a large bus area, which she feels is necessary. She expressed disappointment that Tukwila Village has taken so long to get developed, as she had hoped to move her business there and anticipates being retired before Tukwila City Council Regular Meeting Minutes May 4, 2015 Page 3 of 6 development occurs. She said there are parking problems in and around the park, and from her standpoint, there are issues associated with drugs, dubious activities occurring in the restroom, and littering. She has seen people dump garbage from their vehicles at the park, and she feels that signage needs to be provided in different languages. The Councilmembers asked clarifying questions of Ms. Graf and thanked her for bringing her concerns before the Council. Council President Kruller referenced the upcoming Open House on May 20, 2015 regarding the future of Tukwila International Boulevard at the Valley View Sewer District Offices, 3460 South 148th Street, at 4:30 p.m. She invited Ms. Graf to attend. CONSENT AGENDA a. Approval of Minutes: 4/20/15 (Regular Mtg.) b. Approval of Vouchers #369028- 369185; #150404 - 150406 in the amount of $998,469.68 c. An ordinance granting a non - exclusive franchise to the Zayo Group, LLC, for the purpose of constructing, operating and maintaining a telecommunications system in certain public rights -of -way in the City. An ordinance renewing a moratorium on the establishment, location, operation, licensing, maintenance or continuation of medical cannabis collective gardens or dispensaries. Tukwila City Council Regular Meeting Minutes May 4, 2015 Page 4 of 6 MOVED BY DUFFIE, SECONDED BY ROBERTSON THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Councilmember Ekberg asked Dave Johnson, Parks and Recreation Superintendent, to comment regarding park signage as it relates to multiple languages. Mr. Johnson explained that the park rules ordinance does not cover litter, as that is located in a different part of the Tukwila Municipal Code. He indicated they would look at alternatives to adding signage that would provide some of the more prevalent languages used in the community. Councilmember Seal suggested that staff work with the Equity and Diversity Commission on different methods for outreach on this topic. Councilmember Hougardy, a member of the Equity and Diversity Commission, agreed this would be a good agenda topic for the Commission. Councilmember Quinn offered that the use of visual graphics and pictures has proven to be a successful method for conveying information. Council President Kruller requested that staff circle back with Ms. Graf, who spoke under Citizen Comments, regarding next steps. *MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2476. c. Authorize the Mayor to sign a 5 -year lease with NCWP— Andover Executive Park, LLC, and the Tukwila Police Officers Guild to facilitate the Police Physical Fitness Program. MOVED BY HOUGARDY, SECONDED BY KRULLER TO AUTHORIZE THE MAYOR TO SIGN A 5 -YEAR LEASE WITH NCWP— ANDOVER EXECUTIVE PARK, LLC, AND THE TUKWILA POLICE OFFICERS GUILD TO FACILITATE THE POLICE PHYSICAL FITNESS PROGRAM.* Councilmember Robertson expressed that the $14,400 to be spent annually is a wise expenditure for a variety of reasons. Turnover in the Police Department can be frequent, and it takes a great deal of funding to train new officers over a period of time before they are ready for full deployment. While we certainly want healthy and fit police officers, it is also prudent to take steps to retain officers and minimize turnover, which is extremely expensive for the City. Councilmember Duffie supports the agreement and keeping officers in shape and preserving their life expectancy. Council President Kruller inquired about touching base with other police agencies regarding use of the facility and possible cost sharing. Bruce Linton, Deputy Police Chief, said that would take some time to research, and he would look into that issue. *MOTION CARRIED 7 -0. d. "Tukwila, City of Opportunity Scholarship" recipients: (1) Authorize the award of a $4,000 "Tukwila, City of Opportunity Scholarship" to Nandina Cengic. MOVED BY QUINN, SECONDED BY DUFFIE TO AUTHORIZE THE AWARD OF A $4,000 "TUKWILA, CITY OF OPPORTUNITY SCHOLARSHIP" TO NANDINA CENGIC. MOTION CARRIED 7 -0. (2) Authorize the award of a $3,000 "Tukwila, City of Opportunity Scholarship" to Ada Jannina Arquiza. MOVED BY KRULLER, SECONDED BY ROBERTSON TO AUTHORIZE THE AWARD OF A $3,000 "TUKWILA, CITY OF OPPORTUNITY SCHOLARSHIP" TO ADA JANNINA ARQUIZA. MOTION CARRIED 7 -0. MOTION CARRIED 7 -0. Mayor Haggerton said the Council increased the scholarship amount to $10,000, and only 3 applications were received this year. The City will be taking steps to spread the word more widely to increase the number of applications. He said that Nandina Cengic, who received a Tukwila scholarship this evening, was awarded the AWC scholarship as well. REPORTS a. Mayor Mayor Haggerton attended the recent Washington Recreation and Parks Association (WRPA) Conference in Tacoma. Tukwila's Teen Program Specialist, Nate Robinson, was honored with the "Upcoming Young Professional" award and received a standing ovation. On May 1, 2015, the Mayor attended the Valley Communications Board meeting, where the focus was on the recent PSERN (Puget Sound Emergency Radio Network) vote. The Mayor reported that based on a recent "911" call to Valley Com and the actions of the call taker, who may get national attention, he will be requesting that Lora Ueland from Valley Com provide a presentation to the Council. Additionally on May 1, the Mayor attended the Green River SWIF (System Wide Improvement Framework) meeting. The focus was on the area levees, and the Mayor reported that while 29 trees have been removed, they will be replaced with a combination of 200 trees and bushes that will provide shade to the river and benefit the fish population. The Mayor said there has been a great deal of activity this past week on the project known as the Northwest Arena. Tukwila's website has been updated to add a section where links can be found to documents associated with the project. While this is an important project, the City is utilizing staff and resources to ensure all the work of the City is handled at the highest level. b. City Council Councilmember Duffie provided an overview of the topics discussed at the Transportation Committee meeting that occurred directly before the Council meeting. Council President Kruller attended the King County Historical Society meeting on April 28, 2015, where Karen Meador won an award for her long -term work regarding the Military Road history project. At the April 29, 2015 Board Meeting, the Tukwila Pool Metropolitan Park District Commissioners discussed a change in governance. On April 30, 2015, she attended the PSRC (Puget Sound Regional Council) General Assembly, where there was a focus on providing input regarding the Boeing Access Road Station. She also attended the King County Go -Green Conference, and she brought back recycled cups (from bamboo) for the Mayor and Councilmembers. She reported that she will be hosting the Council Coffee Chat on Saturday, May 9, 2015 at the Tukwila Community Center; the Backyard Wildlife Fair will also be occurring during that time. Councilmember Ekberg attended the Showalter Cultural Fair on April 30, 2015. He also attended the recent retirement event for Captain Loren McFarland from the Tukwila Fire Department. Additionally, this past weekend, he spent a few hours pressure washing the area outside of the Tukwila Pool. Councilmember Seal attended the King County LEOFF1 Board Meeting on April 29, 2015. She offered a reminder that during this election season, it is important that all Councilmembers be mindful of speaking only on behalf of oneself as opposed to the full Council. Additionally, it is important to recognize that some topics have delicate subject matter and to refer to the process instructions provided to the Council in the past. Tukwila City Council Regular Meeting Minutes May 4, 2015 Page 6 of 6 Councilmember Hougardy reported on her recent trip to Washington D.C. that also included Councilmembers Seal and Kruller and David Cline, City Administrator. The Tukwila delegation worked with the City lobbyists to advocate for the City as it relates to COPS funding, support for the Boeing Access Road, grants for the Strander Blvd. Extension, Allentown and BNSF. It was extremely beneficial to have the opportunity to work with federal legislators about issues affecting Tukwila. Councilmember Quinn thanked Councilmembers Hougardy, Seal and Kruller for going to Washington D.C. to put a good face on the City of Tukwila to federal government officials and agencies. On April 25, 2015 he was invited to attend the Seattle Theater Group event, and was pleased to see the group has selected the Tukwila Community Center to be the home of the Alvin Ailey Dance Camp. He thanked the Mayor for being supportive of this great opportunity for the youth in the area. Mr. Quinn also attended the Showalter Cultural Fair on April 30, 2015. c. Staff David Cline, City Administrator, referenced the City Administrator (CA) Report and offered to answer any questions. Councilmember Seal referenced the portion of the CA report relating to Speeders(a)TukwilaWa.gov and expressed appreciation for this great service. This email address is intended to be an easier way to contact the Traffic Unit about speeding vehicles, parking complaints, abandoned vehicles, requests for radar trailer placement, and any other traffic questions or issues. Efforts will be made to respond to emails within one business day. d. City Attorney There was no report. e. Intergovernmental The Council Analyst was not present. MISCELLANEOUS Councilmember Duffie noticed a person in a blue Honda pickup truck taking pictures of houses in the area of South 144th Street and Tukwila International Boulevard. He also noticed that the person had been pulled over by a Police Officer, and he would like feedback on the result of that action. Council President Kruller acknowledged the Council's receipt of a 14 -page document from Bill Holstine, who has spoken under Citizen Comments at recent Council meetings, regarding residential housing. She would like to see his ideas researched with the possibility of discussion at a Community Affairs and Parks Committee meeting.
